Hunt, Jr., Governor Bill Holman, Secretary Kerr T. Stevens, Director kl'?W'A NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES September 30, 1999 Haywood County DWQ Project # 990913 APPROVAL OF 40lQuality Certification and ADDITIONAL CONDITIONS C.R. Styles NC DOT PO Box 250 Bryson City NC 28713 Dear Mr. Styles: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 350 linear feet of streams for the purpose of improving SR 1327 (Ross Road), as you described in your application dated July 30, 1999. 'After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3103 and 3108. These certifications allow you to use Nationwide Permit Numbers 14 and 26 when the Corps of Engineers issues them. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold. the .,new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. DWQ shall be copied with an as-built plan within 30 days of completion of the project. Stream relocation shall closely mirror existing pattern, dimension and profile. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh. N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. HUNT JR. GOVERNOR Haywood County SR 1327 Mr. Bob Johnson July 30, 1999 215 Army Corps of Engineers Reg. Field Office Room 75, Grove Park Ave. Asheville, NC 28801-2714 Dear Mr. Johnson: 04 YMFNT R??E?yF D DAVID MCCOY SECRETARY The North Carolina Department of Transportation is proposing to grade, drain, base and pave primarily along the existing roadway of SR 1327, Ross Road in Haywood County. In order to construct this project in accordance with our current secondary road standards, and due to the rechannelizations of an unnamed tributary to Jonathan Creek (DEM Class C, Tr), and the replacement and/or extension of three (3) pipe culverts in three unnamed tributaries to Jonathan Creek, we are requesting authorization under Section 404 of the Clean Water Act. am sending a straight-line diagram with our proposed erosion control and construction limits at various sites along this project. In addition, a typical section of the road, drawings for the channel changes and the pipe replacements in the unnamed tributaries of Jonathan Creek, general notes and standards on erosion control measures, and a marked County Map are enclosed. We propose to install the new culverts slightly below the existing stream bed elevation where bedrock is not encountered to minimize impact to Wildlife habitat and allow the existing stream gradients to remain as unchanged as physically possible. The best management practices will be used to minimize and control sedimentation and rogion on this project. The construction foreman will review all erosion control measures daily L to,:ensure sedimentation and erosion controls are being effectively controlled. If the planned :- . ?evices are not functioning as intended, they will immediately be replaced with better devices. The silt fences and other erosion control devices will be in place prior to pipe construction and will remain in place until the project is stabilized. P.O.
