Stevens, Director August 8, 1999 Rutherford County DWQ Project # 990771 Approval of 401 Water Quality Certification Roger Bryan NC DOT PO Box 3279 Asheville, NC 28802 Dear Mr. Bryan: You have our approval, in accordance with the attached conditions, to place fill material in 0.01 acres of water for the purpose of paving SR 1728, as you described in your application dated July 21, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification number 3108. This Certificate allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permit before you go ahead with your project including (but not limited to) Sediment and Erosion, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying wit all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506(h). For this approval to be valid, you must follow the conditions listed in the attached Certification. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If you do not accept any of the conditions of this Certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statues to the Office of Administrative Hearings, PO Box 27447, Raleigh, NC 276 1 1-7447. This Certification and its conditions are final and binding unless you ask for hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. I have enclosed a straight line diagram with erosion control plan, a PCN application for NWP #26, and a location map relative to the paving project on SR 1728, North Fork Road, Rutherford County, NC. North Fork Road is currently a 14-16 foot wide gravel road. Division of Highways plans to pave the road 20 feet wide and increase the typical section. Grading will be light to moderate. No changes of the typical sections at Bridge # 200 and #201 are planned. The project starts at the intersection of SR 1728 and NC 226 and proceeds northerly for 1.32 miles. We propose to extend culverts on unnamed tributaries of North Fork at survey stations 20+25, 23+70, 23+97, and 57+30 (see attached culvert sheet). The total distance of culvert extensions within surface waters will be 122 linear feet. Existing channel morphology will be maintained upstream and downstream of the culverts to facilitate movements of aquatic organisms. Riparian vegetation will be reestablished along disturbed areas associated with culvert extensions. Natural substrates will be placed in disturbed channels following placement of culverts. By copy of this letter, we request Mr. Mark Davis, North Carolina Wildlife Resources Commission Mountain Region Coordinator, to comment directly to the Corps concerning the permit request. Silt fences and temporary silt ditches shall be installed after clearing and before grading. Temporary stone ditch checks shall be installed as soon as ditch line is established.
