After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed-regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The Department of Transportation is proposing to replace bridge #17 in Pender County with a new bridge. D.O.T. BRIDGE #17 REPLACEMENT Page Two 9. PROJECT DESCRIPTION The proposed project is a bridge replacement located on State Route 1103 in North Western Pender County. The site is located near the community of Still Bluff. It can be reached from Highway 421 by turning onto Highway 210 West and continuing on 210 to the intersection of State Road 1104 (Cane Tuck Road). Turn left onto SR 1104 and continue on SR 1104 until the second intersection with SR 1103 (Cane Tuck Loop Road, a.k.a. Heading Bluff Road). Turn left onto SR 1103 and continue on to the first bridged crossing of Lyon Creek Canal. The Department of Transportation is planning to replace the existing 52' x 19' concrete bridge with a new 105' x 24' reinforced concrete bridge at a shifted angle over Lyon Creek. Canal. State Route 1103 is being paved and slightly realigned in the area of the bridge. The existing and proposed road and bridge are shown on Sheet 2 of 4 of the plans. The bridge currently has vertical, wooden end bents stabilizing the creek banks on each side of the canal. During the bridge replacement process, these vertical banks would be laid back on a slope flat enough to be stabilized by rip-rap rock. This change will necessitate the proposed lengthening of the bridge structure to span the sloped banks of the creek. No wetlands are present. No wetland impacts are associated with the project. All portions of the existing bridge structure will be removed from the site. The existing bridge and the proposed bridge will be approximately the same height above mean high water. Currently there is between 2' to 5' of navigational clearance underneath the bridge depending upon the tidal stage. During low tide there is approximately 18-24" of water in the creek with as much as 4-5' of water at high tide. The channel at the bridge is about 50' wide. The waters of Lyon Creek Canal have been classified as C Sw by the Division of Water Quality. Class C is a fresh water classification. The best use for the Class "C" waters is described as aquatic life propagation and survival, fishing, wildlife, secondary recreation, and agriculture. The "Sw" refers to low velocity swamp waters. The waters are not a designated primary nursery area and are not evaluated by Shellfish Sanitation for shellfish resources. 10. ANTICIPATED UYIPACTS The proposed bridge replacement will likely result in some short-term turbidity associated with removal of the structure and construction of the new bent supports. There should be no material deposited into the creek and no excavation of the bottom. Temporary sediment control measures should be implemented to retain the disturbed soil on the site while the creek banks are being sloped and stabilized with the rip- rap rock. The amount of the land disturbance should be less than 10,000 square feet associated with this bridge replacement project. There are no known shellfish resources this far up the river and impacts to anadromous fish populations should be minimal. Janet M. PROJECT SUMMARY: The Department of Transportation is proposing to replace bridge #17 in Pender County with a new bridge. D.O.T. BRIDGE #17 REPLACEMENT Page Two 9. PROJECT DESCRIPTION The proposed project is a bridge replacement located on State Route 1103 in North Western Pender County. The site is located near the community of Still Bluff. It can be reached from Highway 421 by turning onto Highway 210 West and continuing on 210 to the intersection of State Road 1104 (Cane Tuck Road). Turn left onto SR 1104 and continue on SR 1104 until the second intersection with SR 1103 (Cane Tuck Loop Road, a.k.a. Heading Bluff Road). Turn left onto SR 1103 and continue on to the first bridged crossing of Lyon Creek Canal. The Department of Transportation is planning to replace the existing 52' x 19' concrete bridge with a new 105' x 24' reinforced concrete bridge at a shifted angle over Lyon Creek Canal. State Route 1103 is being paved and slightly realigned in the area of the bridge. The existing and proposed road and bridge are shown on Sheet 2 of 4 of the plans. The bridge currently has vertical, wooden end bents stabilizing the creek banks on each side of the canal. During the bridge replacement process, these vertical banks would be laid back on a slope flat enough to be stabilized by rip-rap rock. This change will necessitate the proposed lengthening of the bridge structure to span the sloped banks of the creek. No wetlands are present. No wetland impacts are associated with the project. All portions of the existing bridge structure will be removed from the site. The existing bridge and the proposed bridge will be approximately the same height above mean high water. Currently there is between 2' to 5' of navigational clearance underneath the bridge depending upon the tidal stage. During low tide there is approximately 18-24" of water in the creek with as much as 4-5' of water at high tide. The channel at the bridge is about 50' wide. The waters of Lyon Creek Canal have been classified as C Sw by the Division of Water Quality. Class C is a fresh water classification. The best use for the Class "C" waters is described as aquatic life propagation and survival, fishing, wildlife, secondary recreation, and agriculture. The "Sw" refers to low velocity swamp waters. The waters are not a designated primary nursery area and are not evaluated by Shellfish Sanitation for shellfish resources. 10. ANTICIPATED IldPACTS The proposed bridge replacement will likely result in some short-term turbidity associated with removal of the structure and construction of the new bent supports. There should be no material deposited into the creek and no excavation of the bottom. Temporary sediment control measures should be implemented to retain the disturbed soil on the site while the creek banks are being sloped and stabilized with the rip- rap rock. The amount of the land disturbance should be less than 10,000 square feet associated with this bridge replacement project.
