The activities are authorized in conjunction with the construction of NC 127 from US 321 to SR 1184 in Catawba County. The project should be constructed in accordance with your application dated June 21, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3108 and 3103. This certification corresponds to the Nationwide Permit Numbers 26 and 14, respectively. In addition, you should acquire any other federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying 404 permit unless otherwise specified in the Water Quality Certification. This approval is valid solely for the purpose and design described in your application (unless modified below). Should your project change, you must notify the DWQ and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of total impacts to streams (now or in the future) exceed 150 linear feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the conditions listed in the attached certification. The 401 Water Quality Certification authorizes impacts as described below: • Site 1: Fill into 413 linear feet of streams at Site No. 1 is authorized with General Water Quality Certification Number 3103. • Site 2: Fill into 374 linear feet of streams at Site No.2 is authorized with General Water Quality Certification Number 3108. • Mitigation for 561 linear feet of streams will occur on site as described in the permit application dated June 21, 1999. Dear Sir: The North Carolina Department of Transportation (NCDOT) proposes to improve NC 127 in Catawba County, from the US 321 /NC 127 interchange to SR 1184. This 1.4 mile project involves both widening the existing roadway of NC 127 and construction on new location, including a new crossing of the Henry Fork River. A five lane curb and gutter section is proposed. The project has a let date of February 2000. NEPA Documentation The proposed revision of NC 127 has been described in two environmental documents. The Federal Highway Administration (FHWA) signed the Environmental Assessment and Draft Section 4 (f) Evaluation for the project in September 1995. The FHWA approved the Finding of No Significant Impact (FONSI) in October 1996. The FHWA signed the Final Section 4(f) Evaluation in August 1997. These documents include studies that investigated impacts to natural systems and protected species. Copies of each document have been provided to regulatory agencies involved in the permit review process. The NCDOT has reviewed the list of federally-protected species produced by the U. S. Fish and Wildlife Service for Catawba County. The only species listed for this ?t 33 county at the completion of the environmental documents was dwarf flowered heartleaf (Hexastylis naniflora). Since completion of the FONSI, no new species have been added for this county (as of the May 13, 1999 listing). Impacts to Waters of the United States Impacts to waters of the United States cannot be avoided in order to construct the proposed project. Project impacts to surface waters result from stream relocation, culvert construction, and a new bridge crossing of the Henry Fork River. The project lies in the Catawba River Basin (Hydrologic Catalog Unit 03050102). Road construction will result in 0.19 acre of fill in surface water, 787 feet of impact to streams and 226 feet of stream loss. A field visit to determine the potential presence of wetlands in the project study area was conducted in September 1997 by NCDOT biologists. Wetland delineations were conducted using the field delineation methods outlined in the 1987 U.S. Army Corps of Engineers Wetland Delineation Manual. Based on this criteria, it was determined that wetlands are not present in the project study area. Table 1 summarizes impacts to surface waters that will occur at two sites. These impacts are detailed in surface area impact, existing stream length impacted, relocated stream length and stream loss. The existing culvert will be removed, and a new culvert will be constructed. The existing stream is vegetated, but is entrenched and scoured. Based on a field review, it appears that the area below the existing culvert has been dredged and a levee established to contain the stream and inhibit flooding. The NCDOT has designed the relocation at Site 1 using natural stream channel techniques. The stream banks will be vegetated. Based on the described impacts, the NCDOT believes that this site can be authorized under a Section 404 Nationwide Permit 26. Site 2 involves only stream relocation. The NCDOT has designed the relocation at Site 2 using natural stream channel techniques. The stream banks will be vegetated. Based on the described impacts, the NCDOT believes that this site can be authorized under a Section 404 Nationwide Permit 26. As mentioned previously, this project includes a new crossing of the Henry Fork River. This bridge will not have any piles located in the river, nor necessitate a causeway for bridge construction. A plan view of the proposed bridge has been attached. Based on this information, the NCDOT believes that a Section 404 permit is not required. Compensatory Mitigation The impact associated with Site 1 will result in stream loss greater than 150 feet. Therefore, the NCDOT must provide mitigation for this impact per the requirement of the N. C. Division of Water Quality (NCDWQ). The total amount of compensatory mitigation required for the project is 190 feet. Based on existing conditions of the stream, the NCDOT proposes 1:1 mitigation for the impact by contributing funds to the N. C. Wetland Restoration Program (NCWRP) as compensation for this impact to a first order stream. The project is located in the Catawba River Basin. The Catalog Unit for this impact area is 03050101. The NCDOT requests that the NCWRP provide an acceptance letter to the USACE and the NCDWQ stating that the NCWRP will provide mitigation for this impact. Summary of Project Impacts In summary, the project will result in the fill 0.19 acre of surface waters and the impact of 787 feet of stream. Of this impact amount, 561 feet of stream will be relocated using natural stream channel design techniques. There will be 226 feet of stream loss from project construction. Compensatory mitigation for stream impacts totals 190 feet. The NCDOT requests that the USACE issue a Section 404 Nationwide Permit 26 for the proposed road project. However, the NCDOT is concerned about the expiration of this permit. Therefore, the NCDOT has included a application form for an Individual Permit with this project. The NCDOT requests that the USACE use its discretion in determining permit applicability for this project. Application for 401 Water Quality Certification is also requested from the NCDWQ. The NCDOT also asks that the N. C. Wildlife Resources Commission provides comments and a concurrence letter to the USACE since the project lies in a trout county. Dear Sir: The North Carolina Department of Transportation (NCDOT) proposes to improve NC 127 in Catawba County, from the US 321/NC 127 interchange to SR 1184. This 1.4 mile project involves both widening the existing roadway of NC 127 and construction on new location, including a new crossing of the Henry Fork River. A five lane curb and gutter section is proposed. The project has a let date of February 2000. NEPA Documentation The proposed revision of NC 127 has been described in two environmental documents. The Federal Highway Administration (FHWA) signed the Environmental Assessment and Draft Section 4 (f) Evaluation for the project in September 1995. The FHWA approved the Finding of No Significant Impact (FONSI) in October 1996. The FHWA signed the Final Section 4(f) Evaluation in August 1997. These documents include studies that investigated impacts to natural systems and protected species. Copies of each document have been provided to regulatory agencies involved in the permit review process. The NCDOT has reviewed the list of federally-protected species produced by the U. S. Impacts to Waters of the United States Impacts to waters of the United States cannot be avoided in order to construct the proposed project. Project impacts to surface waters result from stream relocation, culvert construction, and a new bridge crossing of the Henry Fork River. The project lies in the Catawba River Basin (Hydrologic Catalog Unit 03050102). Road construction will result in 0.19 acre of fill in surface water, 787 feet of impact to streams and 226 feet of stream loss. A field visit to determine the potential presence of wetlands in the project study area was conducted in September 1997 by NCDOT biologists. Wetland delineations were conducted using the field delineation methods outlined in the 1987 U.S. Army Corps of Engineers Wetland Delineation Manual. Based on this criteria, it was determined that wetlands are not present in the project study area. Table 1 summarizes impacts to surface waters that will occur at two sites. These impacts are detailed in surface area impact, existing stream length impacted, relocated stream length and stream loss. Table 1. The existing culvert will be removed, and a new culvert will be constructed. The existing stream is vegetated, but is entrenched and scoured. Based on a field review, it appears that the area below the existing culvert has been dredged and a levee established to contain the stream and inhibit flooding. The NCDOT has designed the relocation at Site 1 using natural stream channel techniques. The stream banks will be vegetated. Based on the described impacts, the NCDOT believes that this site can be authorized under a Section 404 Nationwide Permit 26. Site 2 involves only stream relocation. The NCDOT has designed the relocation at Site 2 using natural stream channel techniques. The stream banks will be vegetated. Based on the described impacts, the NCDOT believes that this site can be authorized under a Section 404 Nationwide Permit 26. As mentioned previously, this project includes a new crossing of the Henry Fork River. This bridge will not have any piles located in the river, nor necessitate a causeway for bridge construction. A plan view of the proposed bridge has been attached. Based on this information, the NCDOT believes that a Section 404 permit is not required. Compensatory Mitigation The impact associated with Site 1 will result in stream loss greater than 150 feet. Therefore, the NCDOT must provide mitigation for this impact per the requirement of the N. C. Division of Water Quality (NCDWQ). The total amount of compensatory mitigation required for the project is 190 feet. Based on existing conditions of the stream, the NCDOT proposes 1:1 mitigation for the impact by contributing funds to the N. C. Wetland Restoration Program (NCWRP) as compensation for this impact to a first order stream. The project is located in the Catawba River Basin. The Catalog Unit for this impact area is 03050101. The NCDOT requests that the NCWRP provide an acceptance letter to the USACE and the NCDWQ stating that the NCWRP will provide mitigation for this impact. Summary of Project Impacts In summary, the project will result in the fill 0.19 acre of surface waters and the impact of 787 feet of stream. Of this impact amount, 561 feet of stream will be relocated using natural stream channel design techniques. There will be 226 feet of stream loss from project construction. Compensatory mitigation for stream impacts totals 190 feet. The NCDOT requests that the USACE issue a Section 404 Nationwide Permit 26 for the proposed road project. However, the NCDOT is concerned about the expiration of this permit. Therefore, the NCDOT has included a application form for an Individual Permit with this project. The NCDOT requests that the USACE use its discretion in determining permit applicability for this project. Application for 401 Water Quality Certification is also requested from the NCDWQ. The NCDOT also asks that the N. C.
