TIP No. R-2917, State Project No. 8.174090 1, Federal Aid Proj. No. STP-601 (3). The North Carolina Department of Transportation (NCDOT) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers for the above referenced project. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The NCDOT proposes to widen US 601 from the US 52/1-77 connector to SR 1366 to a four-lane median divided highway. A new bridge will be constructed to the west of the existing bridge over Stewarts Creek. The bridge replacement will not impact any jurisdictional wetlands and surface water impacts will be limited to those necessary for the construction of bridge footings. A small perennial stream might be impacted at it's confluence with Stewarts Creek during bridge construction. The existing bridge will remain in place for continued traffic use. Stewarts Creek is not NCWRC Designated Public Mountain Trout Water. The stream supports smallmouth bass, redbreast sunfish and numerous nongame fish species at this location. Based on the information provided by the applicant and our information on the range of trout in the project area, this project will not impact waters supporting trout. Therefore, we do not object to the project as proposed. We are pleased that NCDOT is planning a new bridge at this location instead of a multi-cell box culvert. After reviewing your application, we have decided that this impact is covered by General Water Quality Certification Number 3107. This Certification allows you to use Nationwide Permit Number 23 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this .approval to be valid, you must follow the conditions fisted in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Since that time, construction plans have been modified to include a temporary work causeway in Stewarts Creek. The causeway is necessary to construct interior bent number one of the new bridge. Temporary impacts to surface ?I waters from the temporary causeway total 0.32 acre. All material used for the temporary , ? causeway will be removed after construction is complete. Attached for your information is a copy of the NW 23 previously issued. Temporary impacts to surface waters from the temporary causeway total 0.32 acre. All material used for the temporary causeway will be removed after construction is complete. As stated in the original application, the North Carolina Department of Transportation proposes to widen US 601 in Surry County to a multi-lane facility from the proposed US 52/1-77 connector to SR 1366. From the proposed US 52/I-77 connector to SR 1456, US 601 will be widened to a four-lane median divided facility. A new bridge will be constructed to the west of the existing bridge over Stewarts Creek. The existing bridge will remain in place and will continue to be used by northbound traffic. The existing median divided section between SR 1456 and SR 1484 will remain a divided section, but will be resurfaced and improved to current design standards. Temporary impacts to surface waters from the temporary causeway total 0.32 acre. All material used for the temporary causeway will be removed after construction is complete. As stated in the original application, the North Carolina Department of Transportation proposes to widen US 601 in Surry County to a multi-lane facility from the proposed US 52/1-77 connector to SR 1366. From the proposed US 52/I-77 connector to SR 1456, US 601 will be widened to a Four-lane median divided facility. A new bridge will be constructed to the west of the existing bridge over Stewarts Creek. The existing bridge will remain in place and will continue to be used by northbound traffic. The existing median divided section between SR 1456 and SR 1484 will remain a divided section, but will be resurfaced and improved to current design standards. The majority of this work will be contained within the existing right-of=way. 1 4 It is anticipated that the temporary work causeway will be authorized under a Section 404 Nationwide Permit 33 (Temporary Construction Access and Dewatering). The DOT is therefore requesting the issuance of a nationwide permit authorizing the causeway. Enclosed is a project site map, construction drawings, as well as a completed pre- construction notification form for a Nationwide Permit 33 and General 401 Water Quality Certification. Since this project occurs in a designated trout county, the DOT is also requesting that the NC Wildlife Resources Commission (WRC) provide comments to the COE regarding the application. A new bridge will be constructed to the west of the existing bridge over Stewarts Creek. The existing bridge will remain in place and will continue to be used by northbound traffic. The existing median divided section between SR 1456 and SR 1484 will remain a divided section, but will be resurfaced and improved to current design standards. The majority of this work will be contained within the existing right-of-way. It is anticipated that the temporary work causeway will be authorized under a Section 404 Nationwide Permit 33 (Temporary Construction Access and Dewatering). The DOT is therefore requesting the issuance of a nationwide permit authorizing the causeway. Enclosed is a project site map, construction drawings, as well as a completed pre- construction notification form for a Nationwide Permit 33 and General 401 Water Quality Certification. Identify the streams potentially impacted by the project. The stream classifications should be current. B. Identify the linear feet of stream channelizations/ relocations. If the original stream banks were vegetated, it is requested that the channelized/relocated stream banks be revegetated. C. Number of stream crossings. D. Will permanent spill catch basins be utilized? DEM requests that these catch basins be placed at all water supply stream crossings. Identify the responsible party for maintenance. E. Identify the stormwater controls (permanent and temporary) to be employed. F. Please ensure that sediment and erosion and control measures are not placed in wetlands. G. Wetland Impacts 1) Identify the federal manual used for identifying and delineating jurisdictional wetlands. 2) Have wetlands been avoided as much as possible? 3) Have wetland impacts been minimized? 4) Discuss wetland impacts by plant communities affected. 5) Discuss the quality of wetlands impacted. 6) Summarize the total wetland impacts. 7) List the 401 General Certification numbers requested from DEM. 0 Melba McGee December 9, 1994 Page 2 H. Will borrow locations be in wetlands? Borrow/waste areas should avoid wetlands to the maximum extent practicable. Prior to approval of any borrow/waste site in a wetland, the contractor shall obtain a 401 Certification from DEM. I. Did NCDOT utilize the existing road alignments as much as possible? Why not (if applicable)? J. To what extent can traffic congestion management techniques alleviate the traffic problems in the study area? K. Please provide a conceptual mitigation plan to help the environmental review. The mitigation plan may state the following: 1. Compensatory mitigation will be considered only after wetland impacts have been avoided and minimized to the maximum extent possible. 2. On-site, in-kind mitigation is the preferred method of mitigation. In-kind mitigation within the same watershed is preferred over out-of-kind mitigation. 3. Mitigation should be in the following order: restoration, creation, enhancement, and lastly banking. Please note that a 401 Water Quality Certification cannot be issued until the conditions of NCAC 15A: 01C.0402 (Limitations on Actions During NCEPA Process) are met. This regulation prevents DEM from issuing the 401 Certification until a FONSI or Record of Decision (ROD) has been issued by the Department requiring the document. If the 401 Certification application is submitted for review prior to issuance of the FONSI or ROD, it is recommended that the applicant state that the 401 will not be issued until the applicant informs DEM that the FONSI or ROD has been signed by the Department. Written concurrence of 401 Water Quality Certification may be required for this project. Applications requesting coverage under our General Certification 14 or General Permit 31 will require written concurrence. The purpose of this memo is to address changes in the scope of this project since the scoping meeting. 1. After further study, it was found that control of access exists on US 601 throughout most of the project. The existing right of way and control of access is offset to accommodate a 4-lane divided section. US 601 will be widened to a 4-lane divided facility from the US 52/I-77 connector to SR 1456. The existing divided section between SR 1456 and SR 1484 will be improved if it is below current design standards, but will remain a 4-lane divided section. It is anticipated that the existing right of way will accommodate these improvements. Some construction easements will likely be necessary. 2. Because of the existing offset control of access and the existing 4-lane section north of SR 1456, the 5-lane section has been eliminated from study. 3. The transition from the existing 4-lane divided section to the proposed 4-lane divided section with 46' median will be on the north side of the bridge over Stewarts Creek. A new bridge will be built just west of the existing bridge over Stewarts Creek to handle southbound traffic. Any questions regarding this project should be directed to me at 733-7842. The section of US 601 between SR 1484 and SR 1366 is a five lane section 64 feet face to face curb and gutter. The section of US 601 from SR 1456 to SR 1484 is presently a four lane facility divided by a raised concrete island. It ?# ?ot October 4, 1994 Page 2 has been recommended that the northern project limit be moved to SR 1456 since US 601 north of the intersection is a multi-lane facility. Further investigation will be done to determine if there is control of access along this section. After consulting with the City of Mt. Airy it has been determined that commercial development is expected along this section. The City of Mt. Airy recommends that this section of US 601 be a 5 lane curb and gutter section. The Division Engineer also recommends 5-lane curb and gutter along this section. 2. TIP Project R-98BB will widen US 601 south of the proposed project to a four lane divided facility with a 46' median. The proposed widening will taper back into the existing two lane section approximately 1000 feet south of Stewart's Creek. A section of pavement on existing US 601 is to be removed under R-98BB at the taper. This section of pavement will then be replaced under R-2917. A recommendation was made to coordinate with R-98BB to leave the existing pavement at this location and use pavement markings for the taper. After a typical section has been determined for this project, coordination concerning the tie-in of the two projects will be started. 3. The Division Engineer recommends that the 5 lane section south of SR 1366 be resurfaced as a part of this project. 4. A recommendation was made to move the transition from a four lane divided facility to a five lane curb and gutter section north of Stewarts Creek. Another bridge would be built to handle southbound traffic. This alternative was excluded because of the additional cost of building a new bridge versus the cost of widening the existing bridge. 5. This project has power lines, telephone lines and underground fiber optic telephone lines. A Utility Conflict Rating of medium was suggested for this project. 6. Roadway Design will provide a "worst case" estimate of the construction limits for this project by mid-December 1994. Preliminary Design will be provided by August 1995. 7. SHPO listed two sites along the project that may be eligible for the National Register. These sites are: - Eng Bunker Corn Crib (south of US 601 SR 1360 intersection) - Whitlock House (1542 Airview Drive) October 4, 1994 Page 3 8. The project schedule for R-2917 is: Environmental Assessment: (in progress) (complete - Oct. 1995)* Finding of No begin - Nov. 1995 Significant Impact: complete - Jul. 1996 Right of Way Acquisition: begin - FFY 1997 Construction: - FFY 1998 An asterisk (*) indicates a schedule revision. EA completion date has been revised to October 1995. This is the schedule established at the June Barchart meetings and should have been changed earlier.
