After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3103 and 308. This certification allows you to use Nationwide Permit Numbers 14 and 26 when the Corps of Engineers issues them. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This replaces the one issued on March 9, 1998. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate for these impacts to wetlands and/or streams. In accordance with 15A NCAC 2R .0500, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H .0506(h). According to 15A NCAC 2H .0506(h), 155 feet of restoration will be required. Until the Wetland Restoration Program receives and clears your check (made payable to: DEHNR - Wetland Restoration Program), wetland or stream till shall not occur. Mr. Ron Ferrell should be contacted at 919-733-5083 ext. 358 if you have any questions concerning the Wetland Restoration Program. You have one month from the date of this Certification to make this payment. For accounting purposes, this Certification authorizes the fill of 155 feet of streams, in Catawba River and subbasin 155 feet of stream restoration are required. Please be aware that the Wetland Restoration Program (WRP) rules require rounding of acreage amounts to one-quarter acre increments (15A 211 .0503(b)). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The North Carolina Department of Transportation (NCDOT) proposes to widen Interstate 85 from north of SR 1500 to north of SR 2528 in Rowan County. This project will widen the existing facility from four lanes to eight over the course of 5.2 kilometers (3.2 miles). The construction limits will extend approximately 15 meters (50 feet) from the current roadway toe-of-slope. There will also be improvements to interchanges along this project. The U. S. Army Corps of Engineers (COE) authorized this project under provisions of NW Permit 26 on July 17, 1995 (Action ID No. 199503165). The N.C. Division of Water Quality (DWQ), formerly the Division of Environmental Management, issued a Section 401 Water Quality Certification pursuant to General Water Quality Certification No. 2671 for the project (DWQ project No. 95469) on June 22, 1995. Copies are included for reference. Since the referenced permits were issued , there have been changes in both the Nationwide Permit and General Certification programs. Nationwide Permit No. 26 will expire on December 13, 1998 and will not be reissued. Therefore, the previously issued Department of the Army permit will no longer be usable for this project. LA- Information regarding the project description has not changed since the distribution of the original NW 26 permit application. As indicated in the attached drawings and summary sheets, the project will impact 0.52 acres ofjurisdictional wetlands. The project will also impact 261 linear feet of stream channel through the extension of existing pipes and culverts. One site, site C, exceeds the single site surface water threshold of 150.0 linear feet. Site C involves extending an existing culvert a total of 155.0 linear feet. The North Carolina Department of Transportation proposes to mitigate for the additional 5.0 linear feet of impacts by paying into the North Carolina Division of Water Quality's Wetlands Restoration Program. The NCDOT requests the proposed construction be authorized by a Regional General Permit No. 3 1. By copy of this letter, a Section 401 Water Quality Certification by the Division of Water Quality is also requested. This improvement consists of widening the existing roadway from four lanes to eight lanes over the course of 3.2 miles. The construction limits will extend approximately 50 feet from the current roadway toe-of-slope. There will also be improvements to interchanges along the project length. The project will result in an approximately 0.6 acre impact to wetlands and stream channel in the headwaters of unnamed tributaries to Town Creek. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). You should contact Mr. John Dorney, telephone (919) 733-1786, regarding the above mentioned water quality certification. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for two years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. Also, this verification will remain valid for the two years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the two years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced or are under contract to commence, in reliance upon the nationwide permit, will remain authorized. This is provided the activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation.
