District Engineer North Carolina Department of Transportation Route 1, Box 169C Marion, NC 28752 Dear Mr. Moore: Re: Proposed Paving of SR 1131 (Davis Town Road) DWQ Project # 980916 You have our approval, in accordance with the attached conditions, to place fill material in 0.11 acres of wetlands or waters for the purpose of paving SR 1131 (Davis Town Road) in McDowell County, as you described in your application dated 10 September 1998. After reviewing your application, we have decided that this till is covered by General Water Quality Certification Number 3103. This Certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application and in follow-up correspondence provided on October 29, 1998 to Ms. Liz Dickson of the DWQ Asheville Regional Office. This is to include planting of two rows of native shrubs adjacent to Lytle Creek from Station 0+00 to 12+70. Grading and clearing shall be minimized between Stations 6+50 and 91+20. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification an approval letter and is thereby responsible for complying with all conditions. Our obscrvati.Qne, questions, and recommendations are as follows: 1. Survey Stations 0+00 to 12+70: Lytle Creek (118-foot live creek") is very close to the right side of the existing gravel- road. How will DOT maintain erosion control with the stream located so close to the road? What will DOT do to minimize the impacts of the paving project? our recommendation is to plant shrubs, such as willows and silky dogwood, on this section to stabilize the stream bank and prevent erosion, i 3 2. Survey Station 6+50: We observed indicator plants for wetlands - tag aldty, sycamore, and red maple, and a small stream flowing in from the left side of the road. Please check this area to see if it is a wetlands. If so, what is the size of the wetlands to bt affecttd, and what measures will DOT take to protect the wetlands? What is the size of the wetlands to be affected in this area? The stream on the left side of the road has been ditched in the past - does DOT plan to reditch it or to leave it as is? 4. Davis Town Road is presently 14-16 feet wide. We plan to pave the road 18 feet wide and increase the typical section. The typical section is also attached. Grading will be moderate to heavy. The project begins at SR 1103 and continues in a easterly direction to SR 1123, a distance of 1.79 miles. We propose to extend one (1) culvert a length of twenty-eight feet at survey stations 91+20.
