After reviewing your application, we have decided that this impact is covered by General Water Quality Certification Number 3101. This Certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. NORRIS TOLSON SECRETARY 101 \SSL'D Subject: Duplin County, Replacement of Bridge Nos. 22 and 34 over Goshen Swamp on NC 403, Federal Aid Project No. BRSTP-403(1), State Projcct No. 8.1241501, T.I.P. No. B-2826. On December 1997 the Corps of Engineers authorized the subject project using NWP 23 (Corps of Engineers Action I.D. 199704078). Bridge Nos. 22 and 34 will be replaced on new location approximately 21 meters (70 feet) downstream of the existing structures. Bridge No. 22 will be replaced with a bridge 40 meters (130 feet) long and 9.2 meters (30 feet) wide. Bridge No. 34 will be replaced with a two-barrel 3.7 x 2.4-meter (12 x 8-foot) reinforced concrete box culvert. Traffic will be maintained on the existing structures during construction. Project design now requires the relocation of an existing utility (sewer) line under the creek. The utility line will be placed under the creek and in the shoulder of the new right-of-way. The entire length of line to be replaced will be approximately 185 meters (606.8 feet), as shown on Sheet 2 of 4. The length of line under the creek will be approximately 30 meters (98.4 feet) and the length buried in the shoulder will be 155 meters (508.4 feet). The wetland impact associated with the construction of the shoulder was described in the Categorical Exclusion (CE) document and permitted under the NW 23 permit (Action I. D. 199704078). Therefore, there will be no additional impact to wetlands as a result of the utility line relocation. The installation of the line will result in approximately 0.06 acres of temporary impact to the surface waters of Goshen Swamp. Preconstruction contours will be restored in the stream bed. All material resulting from 0 2 excavation in the stream will be placed so that it is not dispersed by currents or other forces. Any excess material will be removed to upland areas and exposed stream banks stabilized immediately upon completion. Enclosed are drawings of the structures, project site map and Preconstruction Notification Form for the utility line replacement. The DOT requests that the COE authorize this activity in Duplin County under a Section 404 Nationwide Permit 12.
