After reviewing your application, we have decided that this impact is covered by General Water Quality Certification Number 3127. This Certification allows you to use Nationwide Permit Number 25 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Page 3.0 (WELL BE ATTACHED WHEN RECEIVED FROM THE VARIOUS AGENCIES & MUNICIPALITIES) NCDOT PROJECT NO. 5.7941 Page 4.0 DESCRIPTION OF WORK INVOLVED: STAGING OF WORK: It is anticipated the work will be accessed utilizing staging areas at the closed Long Shoals Public Access Area, and at the Duke Power Access Area at the Oxford Dam Facility. Barges are anticipated to be used to complete the removal work. They will be tied off to the old bridge piers, the existing bridge piers, or be anchored to the lake bottom. A small dock will be needed at the shorelines at the existing NC 127 bridge to permit employee access to/from NC 127. Contractor's launch will be tied up at the Wittenburg Public Access Area at night. It is anticipated the work will be done between September 8, 1998 and April 15, 1999, so as to minimize interference with recreational use of the lake. Contractor's barges will be required to be lighted in accordance with US Coast Guard regulations. REMOVAL WORK: All concrete and reinforcing steel will be removed down to Elev 915.0 Ft.. The pier portions above water will be removed by explosives and mechanical means and retrieved for disposal. The pier portions below water (Elev. 932.0 Ft.) will be removed by explosives and mechanical means and allowed to fall to the lake bottom. Blasting mats, underwater cutting of reinforcing steel, sawing of concrete, and use of other mechanical means for removal will be utilized. NCDOT PROJECT NO. 5.7941 DISPOSAL WORK: Page 4.1 The pier portions above water will be retrieved and sunk 100'ft east of old Pier No. #3 (deepest part of lake) so as to not interfere with any future bridge project. The portions below water level will be blasted and allowed to fall to the lake bottom adjacent to the old piers. Reinforcing steel will be cut off no higher than Elev. 915.0 Ft.. No materials will be allowed to remain above Elev. 915.0 Ft.. CLEAN UP / RESTORATION: All removal work will be inspected for completeness by underwater divers. The old piers were left in place when the existing NC 127 bridge was completed in 1968, and the old bridge bridge superstructure was removed. Their removal will improve the natural look of the lake. The old piers being sunk in 60 Ft. of water should not interfere with the use of the lake. In summary, there should be no negative impact from the removal of the old bridge piers. NCDOT PROJECT NO. 5.7941 ANTICIPATED CHANGES IN PROJECT: Possible changes in the project are: 1. Removal of more of the old piers than planned ( lower than Elev 915.0 Ft.) Page 6.0 2. Method of removal may need to be modified to insure complete removal to the required elevation. 3. Minor changes in accessing the lake and removal work may be required, to suit contractors equipment and method of removal. NCDOT PROJECT NO. 5.7941 Page 7.0 ENVIRONMENTAL IMPACT SUMMARY: Environmental impact should be minimal. The following impacts will be considered: 1. Floating oil absorbing soom will be required around contractor's barges to absorb any oil or fuel. 2. Explosive concussion will likely kill fish, however the number killed should be minimal, (5-10 per shot, approximately 25 shots anticipated ). 3. Use of mats during blasting will control flying concrete. 4. The silty lake bottom will be disturbed by the sinking of the concrete piers, and the inspection activities. Disturbance should be minimal. 5. Erosion and sediment control devices will be used at staging areas, as required. NCDOT PROJECT: 5.7941 PUBLIC INTEREST: Page 8.0 Removal of the old piers is being done as the result of collisions of boats with the old piers. In June 1997, a boat collided with Pier No. 2, resulting in one fatality and two others being seriously injured. The collision occured at night . The old piers are not lighted, but have reflective warning signs at each end. There are many scrape marks on the old piers, indicating past collisions. The old piers do not line up with the piers of the existing bridge, and therefore present an obstacle to boat traffic, which becomes a hazard during hours of darkness. The old piers serve no useful purpose for either the public or the Department of Transportation. The removal work will be scheduled during fall and winter months, to minimize interference to recreational use of the lake. " No Wake" buoys and signs will be erected in the area of the removal work during the contractor's operations, so as to minimize barge movement during use of drilling, sawing, and other equipment. Traffic on the adjacent NC 127 bridge will need to be interrupted during demolition blasting shots, as a precaution. Barges are anticipated to be used to complete the removal work. They will be tied off to the old bridge piers, the existing bridge piers, or be anchored to the lake bottom. A small dock will be needed at the shorelines at the existing NC 127 bridge to permit employee access to/from NC 127. Contractor's launch will be tied up at the Wittenburg Public Access Area at night. It is anticipated the work will be done between September 8, 1998 and April 15, 1999, so as to minimize interference with recreational use of the lake. Contractor's barges will be required to be lighted in accordance with US Coast Guard regulations. REMOVAL WORK: All concrete and reinforcing steel will be removed down to Elev 915.0 Ft.. The pier portions above water will be removed by explosives and mechanical means and retrieved for disposal. The pier portions below water (Elev. 932.0 Ft.) will be removed by explosives and mechanical means and allowed to fall to the lake bottom. Blasting mats, underwater cutting of reinforcing steel, sawing of concrete, and use of other mechanical means for removal will be utilized. NCDOT PROJECT NO. 5.7941 DISPOSAL WORK: Page 4.1 The pier portions above water will be retrieved and sunk 100'ft east of old Pier No. #3 (deepest part of lake) so as to not interfere with any future bridge project. The portions below water level will be blasted and allowed to fall to the lake bottom adjacent to the old piers. Reinforcing steel will be cut off no higher than Elev. 915.0 Ft.. No materials will be allowed to remain above Elev. 915.0 Ft.. CLEAN UP / RESTORATION: All removal work will be inspected for completeness by underwater divers. The old piers were left in place when the existing NC 127 bridge was completed in 1968, and the old bridge bridge superstructure was removed. Their removal will improve the natural look of the lake. The old piers being sunk in 60 Ft. of water should not interfere with the use of the lake. In summary, there should be no negative impact from the removal of the old bridge piers. NCDOT PROJECT NO. 5.7941 ANTICIPATED CHANGES IN PROJECT: Possible changes in the project are: 1. Removal of more of the old piers than planned ( lower than Elev 915.0 Ft.) Page 6.0 2. Method of removal may need to be modified to insure complete removal to the required elevation. 3. Minor changes in accessing the lake and removal work may be required, to suit contractors equipment and method of removal. NCDOT PROJECT NO. 5.7941 Page 7.0 ENVIRONMENTAL IMPACT SUMMARY: Environmental impact should be minimal. The following impacts will be considered: 1. Floating oil absorbing soom will be required around contractor's barges to absorb any oil or fuel. 2. Explosive concussion will likely kill fish, however the number killed should be minimal, (5-10 per shot, approximately 25 shots anticipated ). 3. Use of mats during blasting will control flying concrete. 4. The silty lake bottom will be disturbed by the sinking of the concrete piers, and the inspection activities. Disturbance should be minimal. 5. Erosion and sediment control devices will be used at staging areas, as required. NCDOT PROJECT: 5.7941 PUBLIC INTEREST: Page 8.0 Removal of the old piers is being done as the result of collisions of boats with the old piers. In June 1997, a boat collided with Pier No. 2, resulting in one fatality and two others being seriously injured. The collision occured at night . The old piers are not lighted, but have reflective warning signs at each end. There are many scrape marks on the old piers, indicating past collisions. The old piers do not line up with the piers of the existing bridge, and therefore present an obstacle to boat traffic, which becomes a hazard during hours of darkness. The old piers serve no useful purpose for either the public or the Department of Transportation. The removal work will be scheduled during fall and winter months, to minimize interference to recreational use of the lake. " No Wake" buoys and signs will be erected in the area of the removal work during the contractor's operations, so as to minimize barge movement during use of drilling, sawing, and other equipment. Traffic on the adjacent NC 127 bridge will need to be interrupted during demolition blasting shots, as a precaution.
