APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Bolick:
You have our approval, in accordance with the attached conditions and those listed
below, to place fill material for the purpose of paving SR 1116 (Roger's Ridge Road) in
Avery County, as you described in your application dated June 8, 1998. After reviewing your
application, we have decided that this fill is covered by General Water Quality Certification
Number 3103. This certification allows you to use Nationwide Permit Number 14 when the
Corps of Engineers issues it. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Non-Discharge and Water Supply Watershed regulations. This approval will
expire when the accompanying 404 permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your
application except as modified below. If you change your project, you must notify us and
send us a new application. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying with all conditions.
If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and
any additional conditions listed below.
The relocation of an unnamed tributary to. Little Plumtree Creek shall be completed in
accordance with recommendations of the North Carolina Wildlife Resources Commission.
The new channel shall be constructed and stabilized in the dry prior to diversion of the
stream into the new channel. Disturbance of adjacent wetland areas shall be minimized.
The stream shall be relocated to the original channel where possible. Use of rip rap should
be restricted to the minimal amount necessary to stablize the banks. The new channel
should have the same average depth, width and gradient as the existing channel.
2. Sediment and erosion control measures shall adhere to the Design Standards for Sensitive
Watersheds (T 15A:04B .0024).

Dear Mr. Baker:
The Department of Transportation is scheduled to grade, drain, base, and pave
SR 1116, Roger's Ridge Road, in Avery County when the necessary permits are
obtained. This project will require two (2) cross-line pipes and performing one (1)
channel change 352' long which carry unnamed tributaries to Little Plumtree Creek.
Little Plumtree Creek has the DEM classification, WS-III Tr. Due to the proposed work,
we are requesting a 404 Nationwide Permit.
I am sending a joint application form, typical roadway section, straight line sketch
with the proposed erosion control, notes on pipe installation, general notes on erosion
control, cross sections of proposed encroachments in trout water buffer zone, and a
marked county map.
By copy of this letter, I am requesting Mr. Joe Mickey, Western Piedmont Region
Coordinator to comment directly to you concerning the 404 Nationwide Permit request.
Since a request will be made for a temporary encroachment in the trout water buffer
zone, I am also requesting Mr. Mickey to comment directly to me concerning the
encroachment.
Also, by copy of this letter, I am requesting a 401 Certification from the Division of
Environmental Management for this project.
We would like to perform this work as soon as possible. If additional information is
required, please let me know. Your early review and consideration will be greatly
appreciated.

Where slope pratectian treatment is required, Secticn 868 and
Section 1042 of the 1°010 Standard Specifications for Roads
and Structures will be followed. Any material obtained from
the project must be clean before being placed.
Generally, the order of installation of the erosion control
measures will be as follows:

clearing and grubbing begins.
