Atkins NC DOT Elkin District Office PO Box 558 Elkin NC 28621 Dear Mr. Atkins: You have our approval, in accordance with the attached conditions, to place fill material in 0.15 acres of wetlands or waters for the purpose of maintaining SR 1141, as you described in your application dated January 15, 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3127. This Certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept my of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 davs of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The North Carolina Department of Transportation (NCDOT) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of" Engineers. The NCWRC has reviewed information provided by the applicant, and tield biologists on our staff are familiar with habitat values of the project area. 'T'hese continents are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). 'T'ile project will impact tributaries to Meadow Fork and the headwaters of the Little River. Streams to be impacted are to small to contain trout, however, both streams downstream of the project site contain wild brook and rainbow trout. Meadow Fork immediately below the junction of SR 1141 and SR 1 193 is Designated Public Mountain Trout Water, however, no wild trout are found in this upper section of Meadow Fork due to a fish stop falls located further downstream (NCWRC data, 11/93). On the Little River drainage, wild rainbow trout are found below the.j unction of SR 1 141 and NC 18. Pipes will be replaced or extended at Stations 57+80, 58+20 and 62+20 on the Meadow Fork drainage. Encroachment of the trout stream buffer zone will occur at stations 21+00 to 25+50 on the Little River drainage and Stations 67+00 to 69+35 on the Meadow Fork drainage. We are pleased that NC DOT has adjusted the road alignment to avoid working in the stream and trout stream buffer zone as much as possible. Paving of this road, along with proper construction and seeding of ditch lines should help reduce off site sedimentation currently coming from the existing gravel road. We have no objection to the project as proposed provided the following conditions are implemented: 1. Instream work and land disturbance within the 25-foot wide buffer zone is prohibited during the trout spawning season of October 15 through April 1 to protect the egg and fry stages of trout from off site sedimentation. 2. Stringent erosion control measures should be installed where soil is disturbed and maintained until project completion. Temporary or permanent herbaceous vegetation should be planted on all bare soil within 15 days of ground disturbing activities to provide long-term erosion control. We prefer a `seed- as-you-go" strategy rather than allowing a large area of exposed earth to remain bare. If seeding is done after 1 October 1997, then the NCDOT should return after 1 April 1998 to reseed any bare areas if necessary. Thank you for the opportunity to review and comment on this project. Dear Mr. Jolly: The North Carolina Department of Transportation, District I Maintenance plans to grade this road primarily along the existing alignment in the 1998 - 1999 Fiscal Year. We will be replacing/extending existing pipes which involve live streams at Station 57+80, 58+20, and 62+20. We will also be extending or replacing various other pipe culverts throughout the project which do not involve live streams. We will be encroaching upon the 25' trout stream buffer as follows: 1) Lt of Station 21+00+- to Station 25+50+- and 2) Lt of Station 67+00+- to Station 69+35. We have made minor shifts in the alignment in these areas to avoid relocating the stream. Also, we will narrow the shoulder as necessary to avoid working in the stream. This work is to improve the typical section and the safety of the road. We are requesting a 404 Nationwide Permit (#3 Maintenance) from your agency. I am sending a straight line sketch with the proposed erosion control, stream, and cross sections of the affected areas. In addition, I am sending a typical section of the road, general notes on erosion control and a marked map. By copy of this letter I am asking Mr. Joe Mickey, Mountain Region Coordinator of the North Carolina Wildlife Resources Commission to comment directly to you concerning the 404 Nationwide Permit request. Jolly Page 2 January 15, 1998 A request will be made on this project for a Temporary Encroachment in the Trout Water Buffer Zone of tributaries to Meadowfork Creek, a designated mountain trout water, and I am asking Mr. Mickey to comment directly to me concerning the Trout Water Buffer Zone Encroachment. Also, by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. We would plan to begin construction in the summer of 1998. If further information is required, please let me know. Your early review and consideration of this request will be greatly appreciated.
