The application provides adequate assurance that the discharge of fill material into the waters of Six-Mile Creek in conjunction with the proposed development will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that you submitted in your application, as described in the Public Notice. If you change your project, you must notify us and you may be required to submit a revised application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed below. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. Condition(s) of Certification: 1. Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices) shall be utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTUs in all fresh water streams and rivers not designated as trout waters; 25 NTUs in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters); 2. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored after the Division of Land Resources has released the project; 3. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 4. Should waste or borrow sites be located in wetlands, compensatory mitigation is required since it is a direct impact from road construction activities; i i 5. Compensatory mitigation shall be done in accordance with the Corps of Engineers requirements. DWQ shall be copied on the approved ratio, location, size and method of mitigation (restoration, enhancement, creation and preservation) within 30 days after the 404 is issued and annual reports for the entire length of the monitoring period. 6. Compensatory mitigation shall be done in accordance with the Corps of Engineers requirements. This will involve 9.8 acres of restoration at the Long Creek mitigation site in Mecklenburg County. DWQ shall be copied on the specific location of mitigation for this project, along with annual reports for the duration of the monitoring period. Violations of any condition herein set forth shall result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If this Certification is unacceptable to you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. If modifications are made to an original Certification, you have the right to an adjudicatory hearing on the modifications upon written request within sixty (60) days following receipt of the Certification. Please find enclosed the permit application and drawings for the above referenced project. The proposed roadway consists of two 12-foot lanes in each direction separated by a 21-foot raised median. The project begins from the proposed Providence Road West relocation in Mecklenburg County to NC 16 in Union County. The proposed project is approximately 5.5 miles and will be constructed mostly on new location. An analysis of various alternatives and the explanation of the preferred is detailed in the State Environmental Assessment (SEA), the State Finding Of No Significant Impact (SFONSI), and the Addendum to the State Finding of No Significant Impact, signed May 1994, May 1995, and March 1997 respectively. The state project number is 9.8100352. ENVIRONMENTAL IMPACTS Wetlands. The project will impact nine jurisdictional wetlands. Wetland delineations were conducted using the criteria specified in the 1987 Corps of Engineers Wetland Delineation Manual. The middle section of this project, from station 61 + 99.743 to station 76 + 14.194, was delineated by Kimley-Horn and Associates, Inc. and contains a portion of site 25 and all of site 25A, as shown on sheet 1 of the attached drawings. These delineations were verified by Mr. Steve Lund of the United States Army Corps of Engineers (ACOE) Asheville Regulatory Field Office on February 10, 1995. The rest of the project delineations were performed by NCDOT biologists and verified by Mr. Steve Lund on February 6, 1997. Wetland sites 20, 23, 25A, 31, 33, and 36, as identified on sheet 1 of 7 of the permit drawings, are characterized as wooded riparian systems dominated by sweet gum (Liquidambar stvraciflua); red maple (Acer rubrum), willow oak (Quercus phellos), green ash (Fraxinus 0) A 2 r ? ly?G` pennsylvanica) cardinal flower (Lobelia cardinalis), and privet (Ligustrum sinense). Site 10 is a scrub-shrub riparian system characterized by American elm (LTlmus americana), box-elder Acer ne do), soft rush (Juncus effusus), and shallow sedge (Carex lurida). Site 26 is an isolated depression characterized by goldenrod (Solida og_W.),. soft rush, panic grass (Panicum sp.), American elm, and red maple. Site 25 is a hardpan forest hydraulically connected to a riparian forest adjacent to Sixmile Creek. It is dominated by willow oak, sweet gum, American elm, and red maple. The Division of Water Quality rating system was applied to each site. The scores ranged from 26 to 54. Each wetland was also classified according to the United States Fish and Wildlife Service wetland classification (Cowardin) system and the North Carolina Natural Heritage Program Schafale and Weakley classification of the natural communities of North Carolina. The wetland communities and quality analysis are summarized in Table 1. TABLE 1. The 4.46 acres of wetland impacts listed in Table 1 is comprised of 3.79 acres of permanent fill and 0.67 acre of Method III mechanized clearing. The remaining 0.43 acre of impacts is due to fill in surface waters. There will be no steam crossing that will impact more than 150 linear feet of stream channel on this project. t 3 Based on preliminary wetland determinations, the SEA and SFONSI anticipated total jurisdictional wetland impacts of approximately 1.8 acres. However, after wetland delineations and final design, acreage increased to 4.46 acres because wetland sites 10, 20, 31, 33, and 36 were not identified in the SEA. Additionally, surface water impacts were not figured into the total in the SEA. Endangered Species. There are four federally listed species listed for Mecklenburg and Unions Counties, the Carolina heelsplitter (Lasmigona decorata), Michaux's sumac (Rhus Michauxii), smooth coneflower (Echinacea laevigata), and Schweinitz's Sunflower (Helianthus schweinitzii). Survey's for Michaux's sumac and smooth coneflower resulted in no species being identified in the project area. Environmental Commitment 3. in the SFONSI states "a search for the Carolina heelsplitter will be made during the spring prior to construction in the streams directly impacted by this project." NCDOT biologist have conducted the search and reached a biological conclusion of Not Likely To Adversely Affect. A copy of their study is attached. There is an established population of Schweinitz's sunflower (Helianthus schweinitzii) along Marvin-Weddington Road from station 30 + 00 to station 35 + 00, near the crossing of McBride Branch. Based on the original design discussed in the SEA and SFONSI, the project would have impacted some of these plants. However, since the project is state funded and the impacted plants were not within any federally permitted area, the ACOE determined that no Section 7 consultation was warranted. Nevertheless, the NCDOT committed to relocating these plants to an experimental- prairie restoration site in Mecklenburg County in a coordinated effort with the United States Fish and Wildlife Service (USFWS). Subsequently, due to the change of alignment addressed in the Addendum to the SFONSI, the project will impact more of the plants then the original design. Therefore, the ACOE will have to reevaluate the project to determine if the new design warrants a Section 7 consultation. The NCDOT will continue to coordinate with the USFWS on the relocation of the plants. This population has been grouped into nine subpopulations and labeled as Clusters A-1. The location of these nine clusters and the proposed placement of the new road are shown in the Appendix of this application. The following table summarizes the approximate number of stems in each cluster and indicates those clusters which would be impacted by the original and amended alignment with a YES: 4 TABLE 2. In the comments of July 21, 1993, the North Carolina Department of Cultural Resources recommended that no archaeological survey be performed in the project area. However, since that time, numerous archaeological surveys have been conducted within the general vicinity of the project. The results indicate the area near Sixmile Creek is quite rich in archaeological sites. Since the crossing at Sixmile Creek is a federally permitted area, the North Carolina Department of Cultural Resources, in a letter dated September 17, 1997, has recommended an intensive archaeological survey be conducted in project.area. However, the final decision on whether a survey will be required will be made by the ACOE. MITIGATION OPTIONS The ACOE has adopted a policy, through the Council on Environmental Quality (CEQ), a wetland mitigation policy that embraces the concept of "no net loss of wetlands" and sequencing. Mitigation of jurisdictional impacts has been defined by the CEQ to include avoiding impacts, minimizing impacts, and compensating for impacts. The NCDOT has employed many avoidance and minimization strategies during the planning phases of the SEA, SFONSI, and Addendum to the SFONSI. In addition, the following measures have or will be taken to minimize wetland impacts: • Slopes: The NCDOT will employ 2:1 fill slopes throughout all wetland impact areas. • Best Management Practices: Strict enforcement of sedimentation and erosion control Best Management Practices (BMP) for the protection of surface waters and wetlands. • Ditching: No lateral ditching will be employed in wetlands, thus attempting to preserve the hydrology of adjacent wetlands. • MedianWidth: The project is designed with a 21-foot median which is the narrowest acceptable design that ensures the integrity and safety of the road while minimizing impacts to wetlands. t • Special Construction Measures: To ensure that the hydrology of the hardpan forest be maintained, no excavation will be used in the impact area. The NCDOT proposes to utilize the Long Creek Mitigation Site to mitigate for the wetland impacts. Utilizing a 2:1 ratio for restoration, 9.8 acres of restored bottomland hardwoods will be offered to mitigate for the 4.89 acres of jurisdictional wetlands that will be impacted by this project. Both the project site and the mitigation site are located in the Catawba River basin. Table 3 reflects the original acreage, the allocated acreage, the proposed acreage, and the remaining acreage (NOT subtracting the proposed acreage) of the Long Creek Mitigation Site. It is anticipated that these activities will be authorized through an ACOE 404 Individual Permit. By copy of this application, the NCDOT requests that the N.C. Division of Water Quality review the proposal for authorization for a 401 Water Quality Certification. BOX 25201, RALEIGH, N.C. 27611-5201 SECRETARY October 13, 1997 Memorandum To: Michael Wood, Permit Specialist From: Tim Savidge, Environmental Biologist Environmental Unit Subject: Preconstruction survey for the Carolina heelsplitter at the Proposed crossing of Six Mile Creek for the Rea Road extension; Mecklenburg/Union Counties; TIP No. U-2506. The proposed project on new location involves a crossing of Six Mile Creek. Previous status surveys of Six Mile Creek conducted by the North Carolina wildlife Resources Commission (WRC) have not found the presence of the federally Endangered Carolina heelsplitter (Lasmigona decorata). However, several mussel species with viable populations have been found in Six Mile creek. As part of the COE 404 permit requirements, NCDOT committed to conducting a final survey in the water bodies impacted by this project. Six Mile Creek was surveyed at the proposed crossing on September 16, 1997 by NCDOT biologists Tim Savidge and Mike Wood, using tactile survey methodology. A total of 178 elliptio mussels (Elliptio spp.), of varying size classes and 3 eastern creekshell (Villosa delumbis), which is considered to be Significantly Rare (SR)* in North Carolina were found in the project footprint in 30 minutes. The creek was also surveyed by wading in the stream from a point 1/4 mile downstream and proceeding upstream to the project footprint. Mussels are common throughout this stretch of the stream an additional species, Carolina creekshell (Villosa vaughaniana), which is considered Special Concern (SC)* in North Carolina was also found in this stretch. No Carolina heelsplitter mussels were found. Biological Conclusion: No Effect Based on the survey results, it is apparent that the Carolina heelsplitter does not occur in Six Mile Creek. It can be concluded that project construction will not impact this species. Because of the viable mussel populations it is recommended that High Quality Waters (HQW) erosion control be implemented at the Six Mile Creek crossing. Additionally, the NCWRC should be notified prior to construction to allow for relocation of mussels in the project footprint. 0 North Carolina Status r * SR (Significantly Rare): "Any species which has not been listed by the NCWRC as an Endangered, Threatened, or Special Concern species, but which exists in the state in small numbers and has been determined by the NC Natural Heritage Program to need monitoring. * SC (Special Concern): "Any species of wild animal native or once-native to North Carolina which is determined by the WRC to require monitoring but which may be taken under the provisions of Article 25 of Chapter 113 of the General Statues; 1987". Please find enclosed the permit application and drawings for the above referenced project. The proposed roadway consists of two 12-foot lanes in each direction separated by a 21-foot raised median. The project begins from the proposed Providence Road West relocation in Mecklenburg County to NC 16 in Union County. The proposed project is approximately 5.5 miles and will be constructed mostly on new location. An analysis of various alternatives and the explanation of the preferred is detailed in the State Environmental Assessment (SEA), the State Finding Of No Significant Impact (SFONSI), and the Addendum to the State Finding of No Significant Impact, signed May 1994, May 1995, and March 1997 respectively. The state project number is 9.8100352. ENVIRONMENTAL IMPACTS Wetlands. The project will impact nine jurisdictional wetlands. Wetland delineations were conducted using the criteria specified in the 1987 Corps of Engineers Wetland Delineation Manual. The middle section of this project, from station 61 + 99.743 to station 76 + 14.194, was delineated by Kimley-Horn and Associates, Inc. and contains a portion of site 25 and all of site 25A, as shown on sheet 1 of the attached drawings. These delineations were verified by Mr. Steve Lund of the United States Army Corps of Engineers (ACOE) Asheville Regulatory Field Office on February 10, 1995. The rest of the project delineations were performed by NCDOT biologists and verified by Mr. Steve Lund on February 6, 1997. Wetland sites 20, 23, 25A, 31, 33, and 36, as identified on sheet 1 of 7 of the permit drawings, are characterized as wooded riparian systems dominated by sweet gum (Liquidambar 5Zraciflua); red maple (Acer rubrum), willow oak (Ouercus Rhellos), green ash (Fraxinus Eo 2 pennsylvanica) cardinal flower (Lobelia cardinalis), and privet (LiQustrum sinense). Site 10 is a scrub-shrub riparian system characterized by American elm (Ulmus americans), box-elder (Acer ne ndo ,soft rush (Juncus effusus), and shallow sedge (Carex lurida). Site 26 is an isolated depression characterized by goldenrod (Solidago W.), soft rush, panic grass (Panicum sp.), American elm, and red maple. Site 25 is a hardpan forest hydraulically connected to a riparian forest adjacent to Sixmile Creek. It is dominated by willow oak, sweet gum, American elm, and red maple. The Division of Water Quality rating system was applied to each site. The scores ranged from 26 to 54. Each wetland was also classified according to the United States Fish and Wildlife Service wetland classification (Cowardin) system and the North Carolina Natural Heritage Program Schafale and Weakley classification of the natural communities of North Carolina. The wetland communities and quality analysis are summarized in Table 1. TABLE 1. The 4.46 acres of wetland impacts listed in Table 1 is comprised of 3.79 acres of permanent fill and 0.67 acre of Method III mechanized clearing. The remaining 0.43 acre of impacts is due to fill in surface waters. There will be no steam crossing that will impact more than 150 linear feet of stream channel on this project. 3 Based on preliminary wetland determinations, the SEA and SFONSI anticipated total jurisdictional wetland impacts of approximately 1.8 acres. However, after wetland delineations and final design, acreage increased to 4.46 acres because wetland sites 10, 20, 31, 33, and 36 were not identified in the SEA. Additionally, surface water impacts were not figured into the total in the SEA. Endangered Species. There are four federally listed species listed for Mecklenburg and Unions Counties, the Carolina heelsplitter (Lasmigona decorata), Michaux's sumac (Rhus Michauxii), smooth coneflower (Echinacea laevigata), and Schweinitz's Sunflower (Helianthus schweinitzii). Survey's for Michaux's sumac and smooth coneflower resulted in no species being identified in the project area. Environmental Commitment 3. in the SFONSI states "a search for the Carolina heelsplitter will be made during the spring prior to construction in the streams directly impacted by this project." NCDOT biologist have conducted the search and reached a biological conclusion of Not Likely To Adversely Affect. A copy of their study is attached. There is an established population of Schweinitz's sunflower (Helianthus schweinitzii) along Marvin-Weddington Road from station 30 + 00 to station 35 + 00, near the crossing of McBride Branch. Based on the original design discussed in the SEA and SFONSI, the project would have impacted some of these plants. However, since the project is state funded and the impacted plants were not within any federally permitted area, the ACOE determined that no Section 7 consultation was warranted. Nevertheless, the NCDOT committed to relocating these plants to an experimental prairie restoration site in Mecklenburg County in a coordinated effort with the United States Fish and Wildlife Service (USFWS). Subsequently, due to the change of alignment addressed in the Addendum to the SFONSI, the project will impact more of the plants then the original design. Therefore, the ACOE will have to reevaluate the project to determine if the new design warrants a Section 7 consultation. The NCDOT will continue to coordinate with the USFWS on the relocation of the plants. This population has been grouped into nine subpopulations and labeled as Clusters A-I. The location of these nine clusters and the proposed placement of the new road are shown in the Appendix of this application. The following table summarizes the approximate number of stems in each cluster and indicates those clusters which would be impacted by the original and amended alignment with a YES: 4 TABLE 2. In the comments of July 21, 1993, the North Carolina Department of Cultural Resources recommended that no archaeological survey be performed in the project area. However, since that time, numerous archaeological surveys have been conducted within the general vicinity of the project. The results indicate the area near Sixmile Creek is quite rich in archaeological sites. Since the crossing at Sixmile Creek is a federally permitted area, the North Carolina Department of Cultural Resources, in a letter dated September 17, 1997, has recommended an intensive archaeological survey be conducted in project area. However, the final decision on whether a survey will be required will be made by the ACOE. MITIGATION OPTIONS The ACOE has adopted a policy, through the Council on Environmental Quality (CEQ), a wetland mitigation policy that embraces the concept of "no net loss of wetlands" and sequencing. Mitigation of jurisdictional impacts has been defined by the CEQ to include avoiding impacts, minimizing impacts, and compensating for impacts. The NCDOT has employed many avoidance and minimization strategies during the planning phases of the SEA, SFONSI, and Addendum to the SFONSI. In addition, the following measures have or will be taken to minimize wetland impacts: • Slopes: The NCDOT will employ 2:1 fill slopes throughout all wetland impact areas. • Best Management Practices: Strict enforcement of sedimentation and erosion control Best Management Practices (BMP) for the protection of surface waters and wetlands. • Ditching: No lateral ditching will be employed in wetlands, thus attempting to preserve the hydrology of adjacent wetlands. • Median Width: The project is designed with a 21-foot median which is the narrowest acceptable design that ensures the integrity and safety of the road while minimizing impacts to wetlands. • Special Construction Measures: To ensure that the hydrology of the hardpan forest be maintained, no excavation will be used in the impact area. U = D co 6 COMPENSATION. The NCDOT proposes to utilize the Long Creek Mitigation Site to mitigate for the wetland impacts. Utilizing a 2:1 ratio for restoration, 9.8 acres of restored bottomland hardwoods will be offered to mitigate for the 4.89 acres of jurisdictional wetlands that will be impacted by this project. Both the project site and the mitigation site are located in the Catawba River basin. Table 3 reflects the original acreage, the allocated acreage, the proposed acreage, and the remaining acreage (NOT subtracting the proposed acreage) of the Long Creek Mitigation Site. It is anticipated that these activities will be authorized through an ACOE 404 Individual Permit. By copy of this application, the NCDOT requests that the N.C. The proposed project on new location involves a crossing of Six Mile Creek. Previous status surveys of Six Mile Creek conducted by the North Carolina wildlife Resources Commission (WRC) have not found the presence of the federally Endangered Carolina heelsplitter (Lasmigona decorata). However, several mussel species with viable populations have been found in Six Mile creek. As part of the COE 404 permit requirements, NCDOT committed to conducting a final survey in the water bodies impacted by this project. Six Mile Creek was surveyed at the proposed crossing on September 16, 1997 by NCDOT biologists Tim Savidge and Mike Wood, using tactile survey methodology. A total of 178 elliptio mussels (Elliptio spp.), of varying size classes and 3 eastern creekshell (Villosa delumbis), which is considered to be Significantly Rare (SR)* in North Carolina were found in the project footprint in 30 minutes. The creek was also surveyed by wading in the stream from a point 1/4 mile downstream and proceeding upstream to the project footprint. Mussels are common throughout this stretch of the stream an additional species, Carolina creekshell (Villosa vaughaniana), which is considered Special Concern (SC)* in North Carolina was also found in this stretch. No Carolina heelsplitter mussels were found. Biological Conclusion: No Effect Based on the survey results, it is apparent that the Carolina heelsplitter does not occur in Six Mile Creek. It can be concluded that project construction will not impact this species. Because of the viable mussel populations it is recommended that High Quality Waters (HQW) erosion control be implemented at the Six Mile Creek crossing. Additionally, the NCWRC should be notified prior to construction to allow for relocation of mussels in the project footprint. a North Carolina Status * SR (Significantly Rare): "Any species which has not been listed by the NCWRC as an Endangered, Threatened, or Special Concern species, but which exists in the state in small numbers and has been determined by the NC Natural Heritage Program to need monitoring. * SC (Special Concern): "Any species of wild animal native or once-native to North Carolina which is determined by the WRC to require monitoring but which may be taken under the provisions of Article 25 of Chapter 113 of the General Statues; 1987". ATTENTION: Alice Gordon, Environmental Specialist Natural Resources, Permits and Mitigation Unit Pursuant to your request, a survey of marsh vegetation associated with the widening of the Freedom Memorial Bridge over the Trent River was performed by NCDOT biologist Bruce Ellis, on 26 September 1997. Specifically, the inspection focused on the marsh vegetation associated with the removal and installation of temporary work bridges on the northwest side of the Trent River (Figure 1). The survey area is bounded to the north by Lawson Creek and to the south by the Trent River. Standing water in the marsh increased in depth from Lawson Creek to the Trent River. Existing (non impacted vegetation) within this area is predominantly composed of big cordgrass (Spartina cynosuroides), and cattail (Typha spp.). Total length of the survey area is approximately 365 m (1200 ft). The temporary work bridge located in the northwest quadrant of the study area was removed in July 1997. Photos 1 and 2 show the extent of revegetation within the impact area following the removal of the bridge. The area is being revegetated with sedges (Cyperus spp. and Carex spp.), camphorweed (Pluchea spp.), and smartweeds (Polygonum spp.). Cattails are present within the impact area, however, their distribution is relatively sparse. Generally, the shallower portions of the impact area contain denser stands of vegetation than the deeper portions of the impact area. This condition is well illustrated in Photos 1 and 2. ?r A temporary work bridge is being installed within the northeast quadrant, (Photos 3 and 4). Vegetation within current construction impact area has been cleared. Construction of the bridge consists of a platform supported by pilings. The platform is not placed directly on the marsh sediments. Preconstruction vegetation within this impact area is dominated by big cordgrass, and cattail. Small open areas within the marsh contain scattered individual specimens of bull-tongue arrowhead (Sagittaria lancifolia). Shallower portions of the survey area, near Lawson Creek, contain sparse occurrences of sapling and shrub size red maple (Acer rubrum) and black willow (Salix nigra). The results of the survey indicate that revegetation of disturbed areas within the marsh proceeds rapidly. At this time, early successional species such as, the smartweeds and sedges have occupied the impact area in the northwest quadrant. It can be expected that big cordgrass and cattail will begin to revegetate this area within the next growing season. Construction methodologies for the installation of the temporary work bridges has reduced permanent impacts to the marsh. Placing the work platform on pilings significantly reduces compaction of the marsh sediments. Major impacts to the marsh vegetation result from cutting and clearing, and by shading from the bridge itself. Both of these impacts are temporary, and once the work bridges are removed, the area will be rapidly revegetated. U-2506). The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed extension of Rea Road a distance of 5.5 miles from Ballantyne Commons Parkway on the north to NC Highway 16 on the south. Most of the proposed project would be constructed on new location, however the southern approximate 1 mile of road would involve widening of existing Marvin-Weddington Road. The proposed roadway would be a four-lane divided facility with a 22-foot wide raised median and a 24-foot paved, curb and gutter section. This project would impact a total of 4.46 acres of wetlands at 9 separate locations. Of this total, 2.53 acres are characterized as wooded riparian wetlands dominated by sweet gum, red maple, green ash, willow oak and privet (Sites 20, 23, 25A, 31, 33, and 36). Approximately 0.95 acres are scrub shrub wetlands vegetated with American elm, box- elder, soft rush, sedge and panic grass (Sites 10 and 26). The remaining 0.98 acres consist of a wet hardpan forest dominated by willow oak, swamp red oak, and elm (Site 25). A total of 0.43 acres of surface waters would be filled. Pipe and box culvert installation will generally be less than 150 linear feet. A span bridge is proposed to be constructed over Six Mile Creek. The applicant proposes to mitigate for unavoidable wetland losses at their Long Creek Mitigation Site in northwest Mecklenburg County. A total of 9.8 acres of restored bottomland hardwood forest would be utilized to compensate for project impacts. The applicant completed a State Environmental Assessment on May 17, 1994 and a State Finding of No Significant Impact (FONSI) on May 10, 1995. An Addendum to the FONSI was completed on March 2, 1997. The purpose of the proposed work is to serve projected traffic volumes and provide access into the city from a developing area. Plans showing the proposed work are included with this public notice. 2 The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit ..v will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Department of Environment and Natural Resources (NCDENR) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. It has been determined that there are several subpopulations of Schweinitz's sunflower (Helianthus schweinitzii) within the permit area along Marvin- Weddington Road. Consultation with the US Fish and Wildlife Service under Section 7 of the Endangered Species Act has been initiated. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. 3 Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army (DA) permit serves as application to the NCDWQ for certification. Please find enclosed the permit application and drawings for the above referenced project. The proposed roadway consists of two 12-foot lanes in each direction separated by a 21-foot raised median. The project begins from the proposed Providence Road West relocation in Mecklenburg County to NC 16 in Union County. The proposed project is approximately 5.5 miles and will be constructed mostly on new location. An analysis of various alternatives and the explanation of the preferred is detailed in the State Environmental Assessment (SEA), the State Finding Of No Significant Impact (SFONSI), and the Addendum to the State Finding of No Significant Impact, signed May 1994, May 1995, and March 1997 respectively. The state project number is 9.8100352. ENVIRONMENTAL IMPACTS Wetlands. The project will impact nine jurisdictional wetlands. Wetland delineations were conducted using the criteria specified in the 1987 Corns of Engineers Wetland Delineation Manual. The middle section of this project, from station 61 + 99.743 to station 76 + 14.194, was delineated by Kimley-Horn and Associates, Inc. and contains a portion of site 25 and all of site 25A, as shown on sheet 1 of the attached drawings. These delineations were verified by Mr. Steve Lund of the United States Army Corps of Engineers (ACOE) Asheville Regulatory Field Office on February 10, 1995. The rest of the project delineations were performed by NCDOT biologists and verified by Mr. Steve Lund on February 6, 1997. Wetland sites 20, 23, 25A, 31, 33, and 36, as identified on sheet 1 of 7 of the permit drawings, are characterized as wooded riparian systems dominated by sweet gum (Liquidambar gyraciflu red maple (Acer rubrum), willow oak (Ouercus phellos ), green ash (F1'axinus ?? i 2 pennsylvanica) cardinal flower (Lobelia cardinalis), and privet (Ligustrum sinense). Site 10 is a scrub-shrub riparian system characterized by American elm (Ulmus americana), box-elder (Acer neg. ndo), soft rush (Juncus effusus), and shallow sedge (Carex lurida). Site 26 is an isolated depression characterized by goldenrod (Solidago st).),.soft rush, panic grass (Panicum sp.), American elm, and red maple. Site 25 is a hardpan forest hydraulically connected to a riparian forest adjacent to Sixmile Creek. It is dominated by willow oak, sweet gum, American elm, and red maple. The Division of Water Quality rating system was applied to each site. The scores ranged from 26 to 54. Each wetland was also classified according to the United States Fish and Wildlife Service wetland classification (Cowardin) system and the North Carolina Natural Heritage Program Schafale and Weakley classification of the natural communities of North Carolina. The wetland communities and quality analysis are summarized in Table 1. TABLE 1. The 4.46 acres of wetland impacts listed in Table 1 is comprised of 3.79 acres of permanent fill and 0.67 acre of Method III mechanized clearing. The remaining 0.43 acre of impacts is due to fill in surface waters. There will be no steam crossing that will impact more than 150 linear feet of stream channel on this project. 3 Based on preliminary wetland determinations, the SEA and SFONSI anticipated total jurisdictional wetland impacts of approximately 1.8 acres. However, after wetland delineations and final design, acreage increased to 4.46 acres because wetland sites 10, 20, 31, 33, and 36 were not identified in the SEA. Additionally, surface water impacts were not figured into the total in the SEA. Endangered Species. There are four federally listed species listed for Mecklenburg and Unions Counties, the Carolina heelsplitter (Lasmigona decorata), Michaux's sumac (Rhus Michauxii), smooth coneflower (Echinacea laevigata), and Schweinitz's Sunflower (Helianthus schweinitzii). Survey's for Michaux's sumac and smooth coneflower resulted in no species being identified in the project area. Environmental Commitment 3. in the SFONSI states "a search for the Carolina heelsplitter will be made during the spring prior to construction in the streams directly impacted by this project." NCDOT biologist have conducted the search and reached a biological conclusion of Not Likely To Adversely Affect. A copy of their study is attached. There is an established population of Schweinitz's sunflower (Helianthus schweinitzii) along Marvin-Weddington Road from station 30 + 00 to station 35 + 00, near the crossing of McBride Branch. Based on the original design discussed in the SEA and SFONSI, the project would have impacted some of these plants. However, since the project is state funded and the impacted plants were not within any federally permitted area, the ACOE determined that no Section 7 consultation was warranted. Nevertheless, the NCDOT committed to relocating these plants to an experimental prairie restoration site in Mecklenburg County in a coordinated effort with the United States Fish and Wildlife Service (USFWS). Subsequently, due to the change of alignment addressed in the Addendum to the SFONSI, the project will impact more of the plants then the original design. Therefore, the ACOE will have to reevaluate the project to determine if the new design warrants a Section 7 consultation. The NCDOT will continue to coordinate with the USFWS on the relocation of the plants. This population has been grouped into nine subpopulations and labeled as Clusters A-I. The location of these nine clusters and the proposed placement of the new road are shown in the Appendix of this application. The following table summarizes the approximate number of stems in each cluster and indicates those clusters which would be impacted by the original and amended alignment with a YES: 4 TABLE 2. In the comments of July 21, 1993, the North Carolina Department of Cultural Resources recommended that no archaeological survey be performed in the project area. However, since that time, numerous archaeological surveys have been conducted within the general vicinity of the project. The results indicate the area near Sixmile Creek is quite rich in archaeological sites. Since the crossing at Sixmile Creek is a federally permitted area, the North Carolina Department of Cultural Resources, in a letter dated September 17, 1997, has recommended an intensive archaeological survey be conducted in project area. However, the final decision on whether a survey will be required will be made by the ACOE. MITIGATION OPTIONS The ACOE has adopted a policy, through the Council on Environmental Quality (CEQ), a wetland mitigation policy that embraces the concept of "no net loss of wetlands" and sequencing. Mitigation of jurisdictional impacts has been defined by the CEQ to include avoiding impacts, minimizing impacts, and compensating for impacts. The NCDOT has employed many avoidance and minimization strategies during the planning phases of the SEA, SFONSI, and Addendum to the SFONSI. In addition, the following measures have or will be taken to minimize wetland impacts: • Slopes: The NCDOT will employ 2:1 fill slopes throughout all wetland impact areas. • Best Management Practices: Strict enforcement of sedimentation and erosion control Best Management Practices (BMP) for the protection of surface waters and wetlands. • Ditching: No lateral ditching will be employed in wetlands, thus attempting to preserve the hydrology of adjacent wetlands. • Median Width: The project is designed with a 21-foot median which is the narrowest acceptable design that ensures the integrity and safety of the road while minimizing impacts to wetlands. • Special Construction Measures: To ensure that the hydrology of the hardpan forest be maintained, no excavation will be used in the impact area. 6 COMPENSATION. The NCDOT proposes to utilize the Long Creek Mitigation Site to mitigate for the wetland impacts. Utilizing a 2:1 ratio for restoration, 9.8 acres of restored bottomland hardwoods will be offered to mitigate for the 4.89 acres of jurisdictional wetlands that will be impacted by this project. Both the project site and the mitigation site are located in the Catawba River basin. Table 3 reflects the original acreage, the allocated acreage, the proposed acreage, and the remaining acreage (NOT subtracting the proposed acreage) of the Long Creek Mitigation Site. It is anticipated that these activities will be authorized through an ACOE 404 Individual Permit. By copy of this application, the NCDOT requests that the N.C. The proposed project on new location involves a crossing of Six Mile Creek. Previous status surveys of Six Mile Creek conducted by the North Carolina wildlife Resources Commission (WRC) have not found the presence of the federally Endangered Carolina heelsplitter (Lasmigona decorata). However, several mussel species with viable populations have been found in Six Mile creek. As part of the COE 404 permit requirements, NCDOT committed to conducting a final survey in the water bodies impacted by this project. Six Mile Creek was surveyed at the proposed crossing on September 16, 1997 by NCDOT biologists Tim Savidge and Mike Wood, using tactile survey methodology. A total of 178 elliptio mussels (Elliptio spp.), of varying size classes and 3 eastern creekshell (Villosa delumbis), which is considered to be Significantly Rare (SR)* in North Carolina were found in the project footprint in 30 minutes. The creek was also surveyed by wading in the stream from a point 1/4 mile downstream and proceeding upstream to the project footprint. Mussels are common throughout this stretch of the stream an additional species, Carolina creekshell (Villosa vaughaniana), which is considered Special Concern (SC)* in North Carolina was also found in this stretch. No Carolina heelsplitter mussels were found. Biological Conclusion: No Effect Based on the survey results, it is apparent that the Carolina heelsplitter does not occur in Six Mile Creek. It can be concluded that project construction will not impact this species. Because of the viable mussel populations it is recommended that High Quality Waters (HQW) erosion control be implemented at the Six Mile Creek crossing. Additionally, the NCWRC should be notified prior to construction to allow for relocation of mussels in the project footprint. Approximately 37 of the 42 acres were planted in March 1997. The remaining 5 acres are scheduled to be planted by March 1998. A survival rate of 99.4%, which equates to 676 trees per acre, has been obtained this year. The second report, Table 1. Long Creek Monitoring Results (Nov. 1 - Jan 5), examines ground water level within monitoring wells. However, the growing season for Mecklenburg County is March 22 - November 11, so this data does not prove success in meeting the hydrologic criteria. This site consists of approximately 156 acres of land. The mitigation provides for approximately 42 acres restoration of bottomland hardwood forest II. U-2506). The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed extension of Rea Road a distance of 5.5 miles from Ballantyne Commons Parkway on the north to NC Highway 16 on the south. Most of the proposed project would be constructed on new location, however the southern approximate 1 mile of road would involve widening of existing Marvin-Weddington Road. The proposed roadway would be a four-lane divided facility with a 22-foot wide raised median and a 24-foot paved, curb and gutter section. This project would impact a total of 4.46 acres of wetlands at 9 separate locations. Of this total, 2.53 acres are characterized as wooded riparian wetlands dominated by sweet gum, red maple, green ash, willow oak and privet (Sites 20, 23, 25A, 31, 33, and 36). Approximately 0.95 acres are scrub shrub wetlands vegetated with American elm, box- elder, soft rush, sedge and panic grass (Sites 10 and 26). The remaining 0.98 acres consist of a wet hardpan forest dominated by willow oak, swamp red oak, and elm (Site 25). A total of 0.43 acres of surface waters would be filled. Pipe and box culvert installation will generally be less than 150 linear feet. A span bridge is proposed to be constructed over Six Mile Creek. The applicant proposes to mitigate for unavoidable wetland losses at their Long Creek Mitigation Site in northwest Mecklenburg County. A total of 9.8 acres of restored bottomland hardwood forest would be utilized to compensate for project impacts. The applicant completed a State Environmental Assessment on May 17, 1994 and a State Finding of No Significant Impact (FONSI) on May 10, 1995. An Addendum to the FONSI was completed on March 2, 1997. The purpose of the proposed work is to serve projected traffic volumes and provide access into the city from a developing area. Plans showing the proposed work are included with this public notice. 2 The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Department of Environment and Natural Resources (NCDENR) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. It has been determined that there are several subpopulations of Schweinitz's sunflower (Helianthus schweinitzii) within the permit area along Marvin- Weddington Road. Consultation with the US Fish and Wildlife Service under Section 7 of the Endangered Species Act has been initiated. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. s i 3 Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act.
