SUBJECT: Request for Nationwide 33 Permit Modification for
Replacement of Bridge No. 39 over the North Toe River on US
19E; State Project No. 8.1720901; TIP B-2509.
Dear Sir:
Attached for your information are copies of U. S. Army Corps of Engineers
Nationwide Permit Nos. 6, 23, and 33 tear sheet (Survey Activities, Approved
Categorical Exclusion, and Temporary Causeway and dewatering) and the Division of
Water Quality 401 Certifications for the above referenced project. The project involves
replacing Bridge No. 39 over the N. Toe River on US 19E near Plumtree; Avery County.
We have received the environmental permits currently required for construction of
this project. The USCOE Nationwide Permit Nos. 6 and 23 (Action ID# 199830160)
were issued on February 20, 1998, along with the NCDWQ Water Quality Certification
(DWQ No. 971010) on December 2, 1997. The USCOE Nationwide Permit No. 33
(Action ID# 19930072) was issued on December 2, 1998, along with the NCDWQ Water
Quality Certification (DWQ Np. 981024) on October 16, 1998.

At the time of the Preconstruction eeting on March 7, 2000, the contractor was
concerned that the length of the Temporary Causeways would not be sufficient for bridge
demolition and removal. Therefore, the DOT has modified the current construction plans
to accommodate for the insufficient size of causeways. Previously, the description of
activity included to construct causeways of clean rock fill on both the east and west banks
of the North Toe River totaling 0.10 acres of fill and 200 cubic yards of material (see
attachment). The additional causeways will add 0.0092 acres of fill and 89 cubic yards of
material into the streambed (see attachment) Total fill into the streambed would equal
approximately 0.11 acres of fill and 289 cubic yards of material into the streambed.
Since the newly proposed work description is different from the previous
described work description, we are requesting the COE to modify the previously issued
Nationwide Permit 33. If you have any questions or need any additional information,

BRIDGE DEMOLITION PLAN
8.1720901, AVERY COUNTY
1) Place Class II rip rap, approximately 100 tons, in existing stream channel, between
existing Bent #2 and proposed-Rid Bent #taccess causeway. This small pad (approximate
size 40' x 20' x 3') will remain in-place only as long as necessary to facilitate bridge demolition.
Two (2) 18"o CMP may be required to aid in water flow. Current water flow in this area is
minimal, though.
2) Saw out deck Span C, leaving 1" thickness unsawed to protect stream from slurry. Taylor
& Murphy will remove last 1" by carefully removing deck with crane and track hoe so as not to
get concrete spalls in the river.
3) Remove Span D and Bent #3 with a cruncher.
4) Place spalls from concrete demolition in End Bent #2 causeway, land portion ONLY!
Place temporary erosion control measures, as required by Engineer.
5) Remove Span B with cruncher, allowing spalls to fall onto.causeway and proposed rock
pad. Spalls, placed in End Bent #1 access ramp, end land only, will be cleaned up each day so
as not to allow entry into the stream.
6) Remove Bent #2 by turning over onto rock pad and causeway, then demolishing by
crunsher. Spalls will be placed in End Bent #1 access ramp, land only.
7) Place temporary erosion control measures for End Bent #1 access ramp, as required by
Engineer.
8) Remove rock pad from stream channel.
9) Remove Span A and Bent #1 with cruncher. Spalls will be placed in End Bent #1 access.
ramp, land only, or approved waste pit.
10) Cleanup job site of all bridge demolition.
11) Place rock for causeways not yet completed.

Dear Mr. Gilmore:
You have our approval, in accordance with the attached conditions and those listed below, for the
purpose of a temporary causeway for replacing bridge # 39, as you described in your application dated
October 7, 1998. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3114. This certification allows you to use Nationwide Permit
Number 33 when the Corps of Engineers issues it. In addition, you should get any other federal, state or
local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will
expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your new application except
as modified below. If you change your project, you must notify us and send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby
responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed
one acre, compensatory mitigation may be required as described in 15A NCAC 2H 00506(h) (6) and (7). For
this approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
1. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds
(T 15A:04B.0024).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

SUBJECT: Avery County, Replacement of Bridge No. 39 over North Toe River on
NC 19E. TIP No. B-2509, State Project No. 8.1720901, Federal Aid
Project No. BRSTP-19E(1),
The construction of this project was authorized under Nationwide Permit No. 23 (NW 23),
Action ID. 199830160, by letter dated 20 February 1998. The design for the project remains
unchanged from the referenced permit. However, present construction plans not only include
those documented in the Categorical Exclusion (CE) for the subject project but also involve the
construction of a temporary causeway in the North Toe River. The temporary causeway is
necessary in order to construct the new bridge. Temporary impacts to surface waters from the
temporary causeway total 0.10 acre. The temporary causeway will be constructed of clean rock
and will remain in place for approximately ten months from the start of construction. After
construction it will be removed to the greatest extent practical without extensive disturbance of
the existing streambed. Some residue may remain. Construction plans detailing the proposed
causeway are depicted in the attached drawings.
As stated in the CE document, Bridge No. 39 will be replaced in essentially the same location as
the existing structure. The new bridge will be 32 feet wide and approximately 200 feet long.
Traffic will be maintained during construction using a temporary detour approximately 700 feet
south of the existing bridge. It is anticipated that the above mentioned activities will be
authorized under a Section 404 Nationwide Permit 33 (Temporary Construction Access and
Dewatering). The DOT is therefore requesting the issuance of a nationwide permit authorizing
the construction of the causeway.
Enclosed are a project site map, construction drawings, as well as a completed pre-construction
notification form. Since this project occurs in a designated trout county, the DOT is also
requesting that the NC Wildlife Resources Commission (WRC) provide comments to the COE
regarding the application. By copy of this letter, the DOT also asks that the appropriate General
401 Water Quality Certification be issued by the Division of Water Quality for this construction
