Box 25201 Raleigh, NC 27611-5201 Dear Mr. Vick: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.03 acres of wetlands or waters for the purpose of paving SR 1605 in Surry County, as you described in your application dated 10 April 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3127. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1) Little Fisher River and it's tributaries are classified as C Trout Waters, with WSII designation. DOT should implement High Quality Sediment and Erosion Control Measures plus Design Standards in Sensitive Watersheds in the construction of this project. 2) Work in the vicinity of the unnamed tributary crossed at Station 15 should be conducted upslope, away from the stream, to the extent practical. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. This approval will expire when-the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786. Dear Mr. Jolly: The North Carolina Department of Transportation, District I Maintenance plans to grade this road primarily along the existing alignment in the 1997 - 1998 Fiscal Year. We will be replacing/extending existing pipes which involve live streams at Station 19+00, 36+80, 40+50, and 92+00. We will also be extending or replacing various other pipe culverts throughout the project which do not involve live streams. We will be encroaching upon the 25' trout stream buffer as follows: 1) Lt of Station 11+00 to 15+30+-. We will install gabion baskets filled with Class B Stone in this area where any work exceeds the existing slopes to avoid relocating the stream. We will also shift away from the stream as much as possible; however, this will be limited since we must tie to existing pavement in this area. 2) Rt of Station 92+00 to 93+25+-. Work will not exceed the existing slope in this area. It is impossible to shift away from the stream since we have to tie to the existing bridge at Station 93+25. This work is to improve the typical section and the safety of the road. We are requesting a 404 Nationwide Permit (#3 Maintenance) from your agency. I am sending a straight line sketch with the proposed erosion control, stream, and cross sections of the affected areas. In addition, I am sending a typical section of the road, general notes on erosion control and a marked map. A request will be made on this project for a Temporary Encroachment in the Trout Water Buffer Zone of tributaries to an unnamed DEHNR Trout Stream and I am asking Ms. Goudreau to comment directly to me concerning the Trout Water Buffer Zone Encroachment. Also, by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. We would plan to begin construction in fall of `97. If further information is required, please let me know. Your early review and consideration of this request will be greatly appreciated. Generally, the order of installation of the erosion control measures will be as follows: Temporary silt basins shall be installed before clearing and grubbing begins.
