APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Vick:
You have our approval, in accordance with the attached conditions and those listed below, to fill
in 0.255 acres of wetlands or waters for the purpose of widening NC 16 at Charlotte as you described
in your application dated August 13, 1997. After reviewing your application, we have decided that
this fill is covered by General Water Quality Certification Numbers 3103 and 3100. This certification
allows you to use Nationwide Permit Numbers 14 and General Permit 031 when it is issued by the
Corps of Engineers. In addition, you should get any other federal, state or local permits before you
go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when
the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application
except as modified below. If you change your project, you must notify us and you may be required
to send us a new application. If total wetland fills for this project (now or in the future) exceed one
acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7).
For this approval to be valid, you must follow the conditions listed in the attached certification and
any additional conditions listed below.
1. DOT shall follow guidance provided by DWQ in our 27 May 1997 letter for minimizing damage
to aquatic resources until a final policy is developed in conjunction with DOT.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification
and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

SUBJECT: APPLICATION FOR NATIONWIDE 14 PERMITS AND BRIDGE
GENERAL PERMIT 31 FOR WIDENING OF NC 16 IN
MECKLENBURG COUNTY, TIP U-2510 B AND U-2510 C.
Attached for your information is the application packet for the subject project.
The North Carolina Department of Transportation (NCDOT) proposes to widen NC 16
(Old Providence Road) to a four lane divided median-facility with curb and gutter and a
16-foot raised grass median from the Charlotte Outer Loop to the existing multi-lane
facility beginning just north of McAlpine Creek.
Section U-2510 C, which runs from NC 51 to SR 3619, is currently under
construction. This section was permitted by a NWP 26 on 21 February 1995 with no
notification given to either the ACOE or the Division of Water Quality. It impacted three
jurisdictional wetlands totalin 016 acre. Construction is estimated to be completed 1
July 1999. Since this is after the expiration date of 13 December 1998 for NWP 26,
NCDOT is reapplying for NWP 14 in order to remain in compliance with the 404
regulations until completion of this project.
Section U-2510 B continues from NC 51 south to SR 3626 and is due to be let in
March 1998. There are a total of 16 crossings of surface waters impacting a total of 0.094
acre. The longest linear footage of surface water impact is 95 feet at Four Mile Creek.
This is also the longest culvert extension on the project, approximately 90 feet. No
wetlands will be permanently impacted. All crossings are anticipated to qualify for NWP
4 except the crossing at Four Mile Creek.
NCDOT committed to providing a structure at Four Mile Creek which will
accommodate a proposed greenway trail underneath the road for pedestrian and bicycle
traffic in the Finding Of No Significant Impact dated 1 April 1995. The current crossing

at Four Mile Creek is provided via five 8' x 14' reinforced concrete box culverts.
NCDOT proposes to extend these culverts to accommodate the widening of NC 16. The
culverts and creek in this area are choked with sediment. Through coordination with the
Mecklenburg County Parks and Recreation Department, NCDOT proposes to clean out 4
of the 5 existing culverts and channel bottom to approximately 2 feet above the invert.
The fifth culvert will be raised to approximately 6 feet above the invert and paved (see
attachment). This design accommodates a 50-year storm event while also providing a
trail for the greenway traffic. It is anticipated that these activities qualify for permitting
under a Department of the Army General Permit, Action ID No. 198200031.
The Providence Presbyterian Church and Cemetery is located north of NC 16 at
the McKee Providence/Providence Road West intersection and is listed on the National
Register of Historic Places. In order to avoid this site, part of this section, from Bellwood
Lane to Country Lane, will be constructed on new location.
Included in the proposed widening on section B is the addition of a turning lane
on High Ridge Road at the intersection with NC 16. One wetland site was identified
within the project area and its delineation verified by Mr. Steve Lund of the ACOE on
February 6, 1997. Approximately 0.01 acre of this wetland is expected to be temporarily
impacted from clearing activities. No mechanized grubbing will be needed.
In summary, 0.254 acre of jurisdictional waters of the United States will be
permanently impacted by construction of U-2510 B and C and an additional 0.01 acre
will be temporarily impacted. By copy of this letter, we are also requesting a 401 General
Water Quality Certification # 3103 (for NWP 14) and Certification # 3100 (for GP 31)
from the NC Division of Water Quality. If you have any questions or need any additional
