Box 25201 Raleigh, NC 27611 Dear Mr. Vick: You have our approval, in accordance with the attached conditions and those listed below, to fill in 0.19 acres of wetlands or waters for the purpose of temporary causeway at Pig Basket Creek, as you described in your application dated 18 June 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3114. This certification allows you to use Nationwide Permit Number 33 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. DOT shall follow guidance provided by DWQ in our 27 May 1997 letter for minimizing damage to aquatic resources until a final policy is developed in conjunction with DOT. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Chief, North Section Dear Sir: 970571 to, Nrq 'y > Subject: Nash County, Replacement of Bridge No. 2 over Pig Basket Creek on SR 1003, Federal Aid Project BRZ-1003(15), State Project No. 8.2320701, TIP No. B-2850 On February 1, 1996 the North Carolina Department of Transportation distributed a Categorical Exclusion document for the above referenced project proposing to proceed under a Nationwide Permit in accordance with 33 CFR Appendix A (B-23). On July 17, 1996, the Corps of Engineers verified the issue of a Nationwide 23 permit. The project now requires the construction of temporary work platforms to provide construction access. The new bridge cannot be constructed without the construction of temporary work platforms to provide construction access to Pig Basket Creek. Construction of the proposed work platform is depicted in the attached drawings (Sheet 1 to 2). The enclosed drawings describe the proposed method of supporting the drill rig for the drill shaft installation. The work platforms will consist of steel mats placed on the creek bottom, cribbing up with H-pile cut off and/or 6 by 12 timbers. If the creek bed is not level, minor amounts of rock will be placed to create a level area suitable for the steel mats. More steel mats will be placed on the timbers to provide the work platforms to support the drill rig. The steel mats are two sizes: 12 inches x 4 feet 3 inches x 20 feet and 21 inches x 4 feet x 40 feet in length. The mats which will be used instead of rip-raps are easier to install and remove and have minimal impacts on the creek bottom. 9 / I - 2 Following construction, all material will be removed. The work platform will be in place for approximately two weeks. The creek bottom will subsequently be restored to its original contour and rough surface texture. No haul roads or access roads will be constructed in association with the work platforms. There will not be any temporary impact areas above the normal water level. Since the mats will be in place for a short time and no haul roads will be built, the NCDOT does not propose any planting. In accordance with the environmental commitments set forth in the Categorical Exclusion, the North Carolina Department of Transportation will implement a construction moratorium associated with the bridge replacement from February 15 through May 31. In addition, the NCDOT's Best Management Practices for the Protection of Surface Waters and Sediment Control will be strictly enforced during construction of the project.
