Preston Howard, Jr., P.E., Director October 10, 1997 Macon County WQC 401 Project #970567 APPROVAL of 401 Water Quality Certification Mr. M.J. Anderson NC Dot Post Office Box 1551 Andrews, NC 28901 Dear Mr. Anderson: You have our approval, in accordance with the attached conditions, to culvert 0.09 acres of waters for the purpose of paving SR 1364 at Franklin, as you described in your application dated September 25, 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108 This Certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This Certification replaces the one issued on July 21,1997. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Field Office 151 Patton Avenue Room 143 Asheville, N. C. 28801-5006 Dear Mr. Johnson: GARLAN1) B. GARRE"I-1- JR. SIVRHARY Fjt9 em(w NT 0 1-g9/ ACS?iFNCFs The North Carolina Department of Transportation is proposing to widen and pave SR 1364, Needmore Road, in Macon County. This is a REVISED submittal which is necessary due to some realignment and overall changes in the scope of our initial proposal. This project has 11 sites indicated where springs or branches cross the road. In order to construct this project in accordance with our current secondary road standards it will be necessary to replace these pipe culverts which carry stream flow of Bird Branch (DEM Class C) and other unnamed tributaries to the Little Tennessee River (DEM Class C). There are also several wet roadway ditches along this road which will be impacted by our proposed project. The approximate total surface area of these ditches is 0.09 Acre. These ditches will most likely be re-created in the area where the new roadway ditchline is proposed due to the presence of groundwater seepage. We are requesting authorization to proceed under Section 404 of the Clean Water Act. I am sending a location map, straight-line diagram, plan-profile sheets, erosion control plans and details, and a U.S.G.S. map indicating project area and location of proposed pipe culverts and trout stream buffer zone encroachments along the road. All pipe culverts are to be installed slightly below the existing streambed elevations where bedrock is not encountered to minimize impacts to wildlife habitat and allow the existing stream gradients to remain as unchanged as is physically possible. DIVISION OF HIGHWAYS P. O. Box 1551 Andrews, N. C. 28901 September 25, 1997 Mr. Bob Johnson Page 2 September 25, 1997 The best management practices will be used to minimize and control erosion and sedimentation on this project. The construction foreman. will review all erosion control measures daily to ensure erosion and sedimentation are being effectively controlled. If the planned devices are not functioning as intended, they will immediately be replaced with better devices. The rock silt screens and other erosion control devices will be in place prior to pipe culvert construction and will remain in place until the project is stabilized. By copy of this letter I am asking Mr. Mark Davis, North Carolina Wildlife Resources Commission (NCWRC) Western Mountain Region Coordinator, to comment directly to you concerning this 404 Nationwide Permit request. Also, by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management (DEM). We would like to begin construction as soon as possible. If further information is required, please call me at (704) 321-4105. Your early review and consideration will be greatly appreciated. It is made of pernieable filter fabric buried at the bottom, stretched and supported by steel posts. The silt fence reduces the water flow while retaining the sediment. They may also be used to divert water flow to protected outlets. Silt fences need to be checked after each significant rainfall to ensure there effectiveness. They must be maintained on a regular basis. Silt fences shall not be installed across streams, ditches, or waterways. AREAS OF USE: • At toe of fill sections where sediment runoff can be stored and contained inside the project limits. DESIGN CRITERIA: Material With Wire Without Wire Fabric Type 3 Class A Type 3 Class B Steel posts length 5 ft 5 ft. Post spacing 10 ft. The silt basin is built at the base of the ditch with its length being at least 2 times the width of the basin. The type-B silt basin is getieeally built in conjunction with temporary rock silt checks and other devices that control or slow down water flow. This device must be monitored closely and cleaned out on a regular basis until grass is established along the ditch line and sedimentation is no longer a problem. AREAS OF USE: • In conjunction with temporary rock silt checks and other devices used in drainage ditches. DESIGN CRITERIA: • Width - variable • Length - 2 times width • Depth - 2 ft. minimum storage - 1800 cubic feet/acre (equals L x W x D) l V1-12 March, 1993 TEMPORARY ROCK SILT CuECK TYPE-B S )0- A temporary rock silt check type-B (also called check dam) is a small dam with a weir used to reduce gullying in drainage ditches that are to be filled or permanently stabilized at a later date. These type-B rock silt checks help reduce the flow velocity and are generally made of class-B stone. They are used in ditches during construction where the grade meets and/or exceeds 3%. lk" T z a J a IIIII IIIII IIf ?l Illil IIIII IIII ?t 8 III II II I J - s a ? ?cl m - lilj iljlil ?n N !IIII] it 11 i IIIII um uiu ?I!III a IIIII l z 0 a W -1 W O N 7 m v Ini Co CL ~ 7 v) Q Ja! m xx? -i pO? j ..? Box 1551 Andrews, NC 28901 Dear Mr. Anderson: [D EHNR July 21, 1997 Macon County WQC 401 Project #970567 You have our approval, in accordance with the attached conditions, to culvert four 40 feet lengths of waters for the purpose of paving SR 1364 at Franklin, as you described in your application dated 3 July 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This Certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. C. 28801-5006 Dear Mr. Johnson: The North Carolina Department of "Transportation is proposing to widen and pave SR 1364, Needmore Road, in Macon County. In order to construct this project in accordance with our current secondary road standards it will be necessary to replace several pipe culverts which carry streamflow of Bird Branch (DEM Class C) and other unnamed tributaries to the Little Tennessee River (DEM Class Q. The best management practices will be used to minimize and control erosion and sedimentation on this project. The construction foreman will review all erosion control measures daily to ensure erosion and sedimentation are being effectively controlled. If the planned devices are not functioning as intended, they will immediately be replaced with better devices. The rock silt screens and other erosion control devices will be in A a Mr. Bob Johnson Page 2 May 22, 1997 place prior to pipe culvert construction and will remain in place until tile-project is stabilized. By copy of this letter I am asking Mr. Mark Davis, North Carolina Wildlile Resources Commission (NCWRC) Western Mountain Region Coordinator, to comment directly to you concerning this 404 Nationwide Permit request. It is made of permeable filter fabric buried at the bottom, stretched and supported by steel posts.
