Dear Mr. Vick:
You have our approval, in accordance with the attached conditions, to place fill in 0.71 acres of wetlands
or waters for the purpose of constructing the High Point Intermediate at Loop from NC 68 to SR 1471 as you
described in your application dated December 17, 1997. After reviewing your application, we have decided
that this fill is covered by General Water Quality Certification Number 3100. This Certification allows you to
use General Permit Number 31 which has been issued by the Corps of Engineers. In addition, you should get
any other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General. Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). You are also advised that the impacts approved under this
certification will be added to the project total when you apply for future segments of the High Point
Intermediate Loop. For this approval to be valid, you must follow the conditions listed in the attached
certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Here Is the information you requested regarding U-2536. jn High Point. The developer of the mall site was
responsible for obtaining the permits (per the contract with DOT). The COE Issued a NWP 26 on June 14, 1993 and
the OEM Issued the 401 on June;;16, 1993. The SEA/ FONSI for the 9 section.of the project states that 4.9 +1- of
wetlands would be impacted by mail, construction/ road project, with 0.4 acres of impacts from the road project. The
SEA/ FONSI does not say.if the wetlands were In fact delineated and confirmed by the COE_ I can send you a copy
of the SEA/ FONSI if you'd like.

to SR 1471 (Montilieu Avenue), State Project No. 9.8071087; TIP No. U-2536 C.
The North Carolina Department of Transportation (DOT) proposes to construct a second
segment of the High Point Intermediate Loop. This project, identified as TIP No. U-2536 C,
connects NC 68 (Eastchester Drive) with SR 1471 (Montilieu Avenue) by constructing a new
location facility and widening US 29 A (East College Drive). The project has a let date of
October 1998.
The subject project has been described in a State Environmental Assessment (EA), that
was signed on September 28, 1995. The State Finding of No Significant Impact (FONSI) for the
project was signed on June 26, 1997. These documents, particularly the EA, include studies
pertaining to impacts to natural systems and protected species for the combined project. Copies
of these documents have been provided to regulatory agencies involved in the permit review
process.
The project involves the construction of two roadway facilities. The DOT proposes to
construct a four-lane divided curb and gutter facility on new location from NC 68 to US 70 A
(Lexington Avenue). From US 70 A, the existing facility will be widened to a five-lane curb and
gutter. This portion of the project extends to SR 1471 (Montilieu Avenue). Total project length
is 2.4 miles.
Construction of the proposed project necessitates impacts to waters of the United States.
Impacts include the replacement/ extension of an existing culvert and cut/ fill of wetlands.

Jurisdictional wetlands for the project have been delineated by DOT biologists (October
1995) using criteria described in the 1987 U.S. Army Corps of Engine rs (COE) Wetland
Delineation Manual. This delineation during the natural resource investigation, revealed four
sites within the project study area for U-2536 C. Wetland evaluations have also been performed
according to Guidance for Rating the Values of Wetlands in North Carolina, Fourth Version, by
the Division of Environmental Management (DEM).
The DOT has avoided and minimized impacts to wetlands and streams to the extent
practicable. During the natural resources inventory investigation for the EA, the DOT delineated
jurisdictional wetlands and located these wetlands using Global Positioning Systems (GPS).
Based on this information, the DOT avoided one (1) wetland in the C section of the project and
three (3) wetlands in the A section of the project. Minimization of wetland impacts has also
occurred by selecting the roadway facility which requires the least amount of right of way, and
therefore minimizing impacts to wetlands. Figure 7 in the EA depicts the selection of the
recommended alternative and the avoiding of jurisdictional wetlands. This mitigation process
has been documented in the EA.
Table 1 summarizes impacts to waters of the United States by the project, and includes
DWQ rating, Cowardin classification, and impact areas for wetlands and surface waters.
Cowardin classification refers to guidelines developed to classify wetlands and deepwater
habitats as outlined in Classification of Wetlands and Deepwater Habitats of the United States by
Cowardin et al (1979).

Note: PFO 1 C denotes palustrine broad-leaved deciduous forested, that is seasonally flooded.
Of the wetland impacts, 0.04 acre will result from mechanized clearing. The remaining
0.67 acre involves fill and cut of wetlands. These wetlands are associated with a drainage
channel which transitions to a intermittent stream at Station 12+70. These wetlands are disturbed
bottomland systems with areas of the forests dominated by blackberry (Rubes sp.), greenbrier
(Smilax sp.), Japanese honeysuckle (Lonicera japonica) and poison ivy (Toxicodendron
radicans).
At Station No. 27+36, two culverts will be installed, one for a greenway crossing and
the other for Boulding Branch. The crossing is associated with US 29 A (East College Drive)
which will be widened. The length of stream enclosure is 106 feet, or 0.03 acre.
As mentioned earlier, wetlands and streams impacted by the project have been minimized
by project planning. The DOT believes the wetlands are of low quality. The DOT believes that
compensatory mitigation for project impacts should not be required.

During project construction, the DOT will utilize standard Best Management Practices
(BMPs). The EA states that Design Standards in Sensitive Watersheds will be used in the Oak
Hollow drainage area. This section of the project does not lie within this area.
The DOT has investigated issues related to cultural resources and Areas of Potential
Effect (APE). The DOT has received concurrence from the State Historic Preservation Office
that the culvert crossing at Boulding Branch will have no effect on the High Point College
historic district, which is an eligible National Register property. The concurrence form has been
attached to this letter.
Since completion of the EA and the FONSI, the bald eagle (Haliaeetus leucocephalus)
has been listed for Guilford County. This issue has been reviewed, and a biological conclusion
of "No Effect" has been rendered. A copy of this report has been enclosed with this permit
application.
In summary, the proposed project impacts 0.71 acre of wetlands and 0.03 acre of surface
waters (106 linear feet). The DOT has taken practicable measures to avoid and minimize
impacts to waters of the United States. The DOT believes that the proposed project can be
authorized by the COE under a Section 404 General Permit 31. Enclosed with this letter is a
completed preconstruction notification form and permit drawings that depict impacts to waters of
the United States from project construction. Application is also made for 401 Water Quality
Certification by the Division of Water Quality.

Natural Resources Technical Report for TIP No. U-2536, by

Since completion of the referenced report, the US Fish and Wildlife Service
(FWS) has added the bald eagle to its listing for Guilford County. The FWS has listed
the bald eagle as Threatened, a species that is likely to become an endangered species
within the foreseeable future throughout all or a significant portion of its range. A
description of the bald eagle has been provided, as well as a biological conclusion.
Haliaeetus leucocephalus (bald eagle) T
Adult bald eagles can be identified by their large white head and short white tail.
The body plumage is dark-brown to chocolate-brown in color. In flight bald eagles can be
identified by their flat wing soar.
Eagle nests are found in close proximity to water (within a half mile) with a clear
flight path to the water, in the largest living tree in an area, and having an open view of the
surrounding land. Human disturbance can cause an eagle to abandon otherwise suitable
habitat. The breeding season for the bald eagle begins in December or January. Fish are
the major food source for bald eagles. Other sources include coots, herons, and wounded
ducks. Food may be live or carrion.
Biological Conclusion: No Effect
No habitat for the bald eagle exists in the project study area. The nearest water
body is Oak Hollow Lake, which is over 0.5 miles southeast of the project's beginning at
NC 68 (Eastchester Drive). A mall exists between the beginning of the project and the
lake.
The database of the NC Natural Heritage Program was consulted on October 31,
1997, in regard to the presence of the bald eagle. This search revealed no occurrence of
the bald eagle in the project study area. The proposed bridge replacement project will
have no impact upon the bald eagle.

The North Carolina Department of Transportation (DOT) proposes to construct a
second segment of the High Point Intermediate Loop. The DOT requested the Corps of
Engineers authorize the project under a Section 404 Nationwide Permit 31 in a letter
dated November 19, 1997. The permit drawings were inadvertently left out of that
transmittal. Drawings are being distributed with this letter.
A more descriptive vicinity map has also been included. This map depicts the
project in regard to its individual sections.
The B section of the project was documented in a State Environmental
Assessment/ Finding of No Significant Impact (EA/FONSI). This document was signed
on December 10, 1993. Construction on the B section began in June 1994 and was
completed in August 1995.

SUMMARY OF ENVIRONMENTAL AND SPECIAL PROJECT COMMITMENTS
A. A bicycle and pedestrian culvert is proposed at the existing High Point Greenway near
McGuinn Drive. This greenway culvert will provide electrical conduit to allow for
lighting, and the City of High Point will be responsible for the lights (refer to discussion in
Section II.E of this document).
B. Hazardous spill catchment basins are proposed along the project between Old Winston
Road and Johnson Street because this portion is located within the critical area of the Oak
Hollow Lake watersupply watershed (refer to discussion in Section I.F of the
Environmental Assessment (EA)).
C. Sidewalks are proposed along both sides of the project between SR 1471 (Montlieu
Avenue) and US 70A (Lexington Avenue). These sidewalks will connect with the
existing greenway (refer to discussion in Section II.D of this document).
D. The project relocates approximately 30 meters (100 feet) of unnamed stream #2 (US #2).
The relocated channel will be designed according to the NC Wildlife Resources
Commission (NCWRC) guidelines "NC Stream Protection and Improvement Guidelines."
The proposed channel design will be similar to the original channel in width, depth,
gradient, and substrate. Site specific requirements for re-establishment of bank vegetation
with planting regime, meanders, and habitat structures will be determined through
coordination with the NCWRC field staff during the hydraulic design phase of the project
(refer to discussion in Section II.B of this document).
E. Erosion and sedimentation in the area draining to Oak Hollow Lake will be controlled
through the specification, installation, and maintenance of erosion and sedimentation
control appropriate for high quality waters (refer to discussion in Section IV.B.4.b of the
EA).
F. The project may require a floodway modification. If required, the NCDOT Hydraulics
Design Unit will coordinate with the Federal Emergency Management Agency (FEMA)
and local authorities during final design regarding application and approval for the
necessary floodway revisions (refer to discussion in Section II.C of this document).

I. DESCRIPTION OF THE RECOMMENDED ACTION
The North Carolina Department of Transportation (NCDOT) proposes to construct the
Intermediate Loop as a multilane facility involving mostly new location. The project is divided
into two parts: (1) Part A, from US 311 (North Main Street) to Johnson Street and (2) PartC,
from NC 68 (Eastchester Drive) to SR 1471 (Montlieu Avenue), a length of approximately 3.8
kilometers (2.4 miles). The middle portion of the Intermediate Loop (U-2536 B) between
Johnson Street and NC 68 has been constructed.
The project is included in the 1997-2003 Transportation Improvement Program (TIP).
The estimated project costs are summarized as follows:

The estimated cost in the TIP is $12,475,000, which includes $5,425,000 for right of way and
$7,050,000 for construction. The current estimated cost is $10,446,500, which includes
$4,996,500 for right of way acquisition and $5,450,000 for construction. Part C is scheduled for
right of way acquisition in fiscal year 1997 (FY 1997) and construction in FY 1999. Part A is
scheduled for right of way acquisition in FY 2000 and construction in FY 2002.
The recommended alternative (Alternative 2) provides a five-lane curb and gutter section
and a four-lane divided curb and gutter section with a raised median. The five-lane curb and gutter
section extends from US 311 (North Main Street) to Old Winston Road and from US 70A
(Lexington Avenue) to SR 1471 (Montlieu Avenue). The four-lane divided curb and gutter
section extends from Old Winston Road to Johnson Street and from NC 68 (Eastchester Drive) to
Lexington Avenue. Refer to Figures 1B, 2A, and 2B for proposed typical sections and their
locations.
The five-lane curb and gutter cross section provides a 19.2-meter (64-foot) roadway with
two travel lanes in each direction and a continuous center turn lane. The four-lane divided curb
and gutter section provides a 21.3-meter (71-foot) roadway with two travel lanes in each
direction and a 5.7-meter (19-foot) raised median. Both typical sections include 3.6-meter (12-
foot) lanes and 3.0-meter (10-foot) berms on each side of the road behind the curbs.
II. ACTIONS REQUIRED BY OTHER AGENCIES
A. Permits Reauired
Impacts to jurisdictional wetlands and surface waters are anticipated. In accordance with
provisions of Section 404 of the Clean Water Act (33 U.S.C. 1344), a permit will be required
from the US Army Corps of Engineers (COE) for the discharge of dredged or fill material into
"Waters of the United States."
Impacts to surface waters and jurisdictional wetlands resulting from the proposed project
may be authorized under one or more Nationwide Permits (NWP), i.e. NWP 14 or NWP 26. A
NWP 14 is likely to be applicable at most ditch and stream crossings found in the project study
area provided criteria set by the permit are met. A NWP 26 is anticipated for any discharge of
dredged or fill material into headwaters and/or isolated jurisdictional wetlands provided conditions
set by the permit are met.
In addition, this project will also require a 401 Water Quality General Certification from
the DEM prior to the issuance of a Nationwide Permit. Section 401 of the Clean Water Act
requires that the state issue or deny water certification for any federally permitted or licensed
activity that may result in a discharge to Waters of the United States. Final decisions concerning
applicable permits for the subject project rests with the COE.
B. Stream Rechannelization
Approximately 30 meters (100 feet) of an unnamed stream (US #2) will be relocated with
the project. Coordination will be conducted with the appropriate Wildlife Resource Commission
(WRC) district fisheries biologist during the hydraulic design phase of the project. The relocation
of the stream will be similar in nature to the original channel in terms of width, depth, gradient,
and substrate. Site specific requirements for re-establishment of bank vegetation with planting
regime, meanders, and habitat structures (root wads, wing deflectors, etc.) will be determined
through coordination with WRC field staff. These items will follow WRC's established document
entitled "NC Stream Protection and Improvement Guidelines" and will incorporate any highway
specific guidance jointly developed between WRC and the NCDOT Hydraulics and Roadside
Environmental Units.
C. Floodwav Modification
The project crosses an unnamed tributary to Boulding Branch that is included in the High
Point Flood Insurance Study. This crossing is in a designated flood hazard zone and is included
in a detailed flood study. The stream has established regulatory floodplain and floodway limits
and corresponding established water surface elevations. Because the roadway grade will need to
be raised to accommodate the proposed culvert extension and supplementation, the project may
require a floodway modification. If required, the NCDOT Hydraulics Design Unit will coordinate
with the Federal Emergency Management Agency (FEMA) and local authorities during final
design regarding application and approval for the necessary floodway revisions.
D. Sidewalks
Sidewalks are recommended along both sides of the roadway between Lexington Avenue
and Montlieu Avenue in the vicinity of High Point University. The sidewalks will connect with
the Boulding Branch greenway. NCDOT will participate in 60 percent of the sidewalk cost up to
a total of two percent of the project construction cost. The City will be responsible for the
remaining 40 percent, as outlined in the NCDOT Pedestrian Policy Guidelines.
E. Bicycle and Pedestrian Culvert
A 4.3-meter (14-foot) by 2.4-meter (8-foot) reinforced concrete box culvert is proposed
at the existing High Point Greenway near McGuinn Drive to allow bicycle and pedestrian traffic
to cross under the Intermediate Loop. The proposed greenway culvert will provide electrical
conduit to allow for lighting, and the City of High Point will be responsible for the lights.
III. NEED FOR ACTION
The roadways in the vicinity of the project are mostly radial facilities which carry traffic
between the High Point central business district and outlying suburban areas. Several of these
radials are currently experiencing congestion during peak periods and have accident rates two to
three times the statewide average for similar roadways. In addition, the existing roadway
network does not provide adequate mobility between the radial facilities.
The proposed Intermediate Loop will increase mobility in the area by connecting these
radials and completing a loop around the central business district. The project implements a
portion of the High Point Urban Area Thoroughfare Plan and will function as an urban minor
arterial to improve access to the northwestern portion of the city. This facility will provide
greater traffic carrying capacity and will help reduce the accident potential by decreasing the
traffic volumes and congestion on the intersecting roads.
IV. CIRCULATION OF ENVIRONMENTAL ASSESSMENT
The environmental assessment was circulated among the following federal, state, and local
agencies. Written comments were received from agencies noted with an asterisk (*).

V. COMMENTS RECEIVED ON ENVIRONMENTAL ASSESSMENT
A. City of High Point
Comment:
The lane configurations at the following intersections along the Intermediate Loop
may need to be altered or further investigated (refer to letter in Appendix A for specific
recommendations):
US 311 (North Main Street)
Old Winston Road
Johnson Street
SR 1507 (Centennial Street)
SR 1471 (Montlieu Avenue)
Response:
The projected traffic volumes and proposed lane configurations at each of the
above intersections have been reviewed. The results of this review are described below.
At US 311, a shared through and left turn lane was considered for the westbound
approach but not recommended. This shared lane does not allow desirable signal phasing
at the intersection. In addition, the projected left turning traffic volumes do not justify
dual left turns. At Old Winston Road, an additional northbound through lane was
considered but not recommended. The northbound through volumes on Old Winston
Road are not high enough to justify this additional through lane. At Johnson Street, dual
lefts were considered along the westbound approach but not recommended. The
westbound left turning movements onto Johnson Street do not warrant dual left turn lanes.
At Centennial Street, dual left turn lanes were considered along the southbound approach
of Centennial Street but not recommended because of right of way constraints at the
intersection. An exclusive right turn lane is needed at this approach to separate turning
traffic from the high volume of through traffic. At Montlieu Avenue, a single left turn lane
was considered along the southbound approach but not recommended. Dual lefts are
needed to accommodate the high volumes of left turning traffic. The auxiliary through
lane on Montlieu Avenue will be of sufficient length to safely merge the traffic into a
single lane.
VI. COMMENTS RECEIVED DURING AND SUBSEQUENT TO
THE PUBLIC HEARING
On 1/23/96, a public hearing for the subject project was held in the Fellowship Hall of
Christ United Methodist Church. Approximately 175 people attended the hearing including
representatives from the City of High Point, High Point University, and NCDOT. The following
organizations expressed their support for the Intermediate Loop:
City of High Point
High Point University
High Point Chamber of Commerce
High Point Economic Development Commission, Transportation Committee
Oak Hollow Mall
Christ United Methodist Church
First Wesleyan Church Complex
These groups believe the project will reduce congestion and improve accessibility to this northern
portion of the city. In addition, these groups requested that the project schedule be further
accelerated to keep up with the increasing travel demands.
Comments and suggestions were also offered by the public. Principal topics of concern
and responses to these concerns are discussed below:
Comment:
Noise barriers or landscape buffers should be considered at the Wesleyan Arms
Retirement Village near Centennial Street and at residences adjacent to the project in the
Greenbrier Subdivision.
Response:
Based upon the traffic noise analysis included in the Environmental Assessment,
noise barriers are not justified. However, a landscaping buffer will be included at these
locations to act as a visual screen between these properties and the proposed roadway.
NCDOT's Landscaping Guidelines make provisions for including trees and shrubs up to
3/4 of a percent of the construction cost. Additional landscaping may be incorporated
into the project if the City wants to participate in the funding. The responsibilities of the
City and the NCDOT regarding the proposed landscaping will be finalized during the
preparation of the Municipal agreement.
Comment:
Representatives from Christ United Methodist Church, Wesleyan Arms Retirement
Village, and the R. L. Honbarrier Company requested that NCDOT maintain suitable access to
their properties.
Rest:
During the final design stage of the project, the NCDOT Roadway Design Unit
will review the property owners' requests in maintaining acceptable access to these
properties.
Comment:
A median opening and traffic signal should be considered at Windchase Court to improve
access for residents of Windchase Townhomes.
Response:
A median opening will be provided at Windchase Court. However, a traffic signal
is not recommended at this location because the distance between Windchase Court and
Johnson Street is less than the desired spacing between signalized intersections.
Comment:
Consider shifting the alignment to follow more of existing College Drive on the north side
of Lexington Avenue.
Response:
The northern approach of College Drive intersects Lexington Avenue at a different
angle from the south approach. To connect with Centennial Street at the proposed
location, the alignment cannot be acceptably designed to use all of the northern portion of
College Drive.
Comment:
The Norwood Avenue and Centennial Street intersection will be located approximately 45
meters (145 feet) from the Intermediate Loop. Improvements should be considered to make
Norwood Avenue a safe intersection.
Response:
A minor realignment of Norwood Avenue is proposed at its intersection with
Centennial Street. This realignment will enhance safety at this location by increasing the
spacing between the intersections and improving sight distance.
VII. REVISIONS TO THE ENVIRONMENTAL ASSESSMENT
A. Cost Estimates
The project is currently estimated to cost $10,446,500, which includes $4,996,500
for right of way acquisition and $5,450,000 for construction.
B. Cross Section
The median width along the four-lane divided cross section has been increased
from 4.8 meters (16 feet) to 5.7 meters (19 feet). This provides sufficient room to contain
a 0.5-meter (1.5-foot) curb and gutter on each side of the median and a 1.2-meter (4-foot)
island where left turn lanes are needed. The berm width along the entire length of the
project has increased from 2.4 meters (8 feet) to 3.0 meters (10 feet) in accordance with
recently adopted design guidelines. This wider berm allows more space for sidewalks and
utilities.
C. Right of Way
The proposed right of way width has increased from 27.4 meters (90 feet) to 30.5 meters
(100 feet) throughout the length of the project.
D. Design SReed
The design speed has been revised from 70 km/hr (45 mph) to 80 km/hr (50 mph).
E. Intersection Improvements
The lane configurations at the following intersections have been revised since the EA was
approved.
US 311 (North Main Street)
Channelization is proposed along the east and west approaches of the Intermediate Loop
at the US 311 intersection to prevent conflicts with left turning traffic at the intersection.
Pine Valley Drive
Section I.D of the EA stated that a "T" intersection is proposed at Pine Valley Drive to
provide direct access only to the southern portion of Pine Valley Drive. However, the distance
between the Intermediate Loop and the Sunview Avenue/ Pine Valley Drive intersection is not
sufficient for providing a safe intersection with the project. For this reason, Pine Valley Drive will
no longer intersect directly with the project but will be accessed from Old Winston Road.
Centennial Street
Figure 4C of the EA shows dual left turn lanes on both approaches of Centennial Street
and on the northbound approach of the Intermediate Loop. Because of right of way constraints at
this intersection, these dual left turn lanes are no longer recommended.
US 70A (Lexington Avenue)
Channelization is proposed along the south approach of the Intermediate Loop at
the Lexington Avenue intersection to prevent left turning conflicts at the intersection.
F. Median Openings
Nine median openings are proposed along the project at signalized intersections and
designated locations. Median openings will be provided at the following locations (refer to
Figure 3):
Old Winston Road
Windchase Court
Johnson Street
NC 68 (Eastchester Drive)
Northern Entrance to Wesleyan Arms Retirement Village
SR 1507 (Centennial Street)
Southern Entrance to Wesleyan Arms Retirement Village
Entrance to Christ United Methodist Church
US 70A (Lexington Avenue)
G. Retaining Wall
To avoid relocating the High Point University track, a 67-meter (220-foot)
retaining wall is proposed along the west side of the roadway beside the track.
H. Alignment Shift
Representatives from the City of High Point and Wesleyan Arms Retirement
Village requested that the alignment be shifted away from the retirement complex west of
Centennial Street. A shift of approximately 9 meters (30 feet) is recommended near the
retirement community to provide a buffer between the roadway and to minimize impacts
to the property.
Wetland Findings
Executive Order 11990 requires appropriate documentation to show that there is no
practicable alternative to the proposed construction and that the proposed action includes all
practicable measures to minimize harm to jurisdictional wetlands. Jurisdictional wetlands, as
defined by 33 CFR 328.3, are those areas that are inundated or saturated by surface or ground
water at a frequency and duration sufficient to support, and that under normal circumstances do
support, a prevalence of vegetation typically adapted to life in saturated conditions.
All practicable steps have been taken both to avoid and minimize impacts to
wetlands. The alignment was located to avoid three wetland sites associated with
Unnamed Stream #1 (US #1) between Pine Valley Drive and Johnson Street (refer to
Figure 7 in the EA for locations). However, because of the fixed endpoints on Part C and
the extent of the development on each side of the project corridor, Sites 1, 2, and 3 near
Centennial Street cannot be avoided. The proposed curb and gutter cross section
minimizes impacts to these unavoidable wetlands with its relatively narrow construction
limits. The actual wetland impacts have slightly increased from 0.2 hectare (0.6 acre) to
0.3 hectare (0.7 acre) due to an alignment shift, but the adjusted alignment minimizes
impacts to the Wesleyan Arms Retirement Village.
Impacts to wetlands have been minimized to the extent practicable. During
construction, NCDOT will implement stringent erosion and sedimentation control
measures along with Best Management Practices to control sedimentation in adjacent
wetlands and to ensure that the amount of impacted wetlands will be minimized. Based on
the above considerations, there is no practicable alternative to the proposed construction
in wetlands, and the proposed action includes all practicable measures to minimize harm to
these resources.
VIII. BASIS FOR FINDING OF NO SIGNIFICANT IMPACT
Based upon a study of the proposed project documented in the Environmental
Assessment, and upon comments received from federal, state, and local agencies and the public, it
is the finding of the North Carolina Department of Transportation that this project will not have a
significant adverse impact upon the human or natural environment. Therefore, an environmental
impact statement will not be required.

(EA) for the High Point Intermediate Loop, from US 311 (North Main Street) to Johnson

Staff biologists with the N. C. Wildlife Resources Commission have reviewed the subject EA and
arc familiar with habitat values in the project area. The purpose of this review was to assess project
impacts to fish and wildlife resources. Our comments are provided in accordance with certain provisions
of the North Carolina Ftivironmental Policy Act (G.S. 113A-1 et seq., as amended; 1 NCAC 25).
NCDOT proposes to construct a two segments of the High Point Intermediate Loop, mostly on new
location, from US 311 to Johnson Street and from NC 68 to SR 1471. The proposed roadway is a multi-
lane, curb and Sutter facility. The project length-is approximately 2.4 miles. Approximately 0.60 acres
of wetland impacts are anticipated and will likely be covered under nationwide permits.
The EA adequately addresses impacts to wildlife and fisheries resources in the project area. Due to
the developed nature of the project area and the environmental commitments included in the document,
we concur with this EA and anticipate concurrence with the upcoming Finding of No Significant Impact
(FONSi).

The subject document has been reviewed by this office. The Division of
Environmental Management is responsible for the issuance of the Section 401 Water
Quality Certification for activities which impact waters of the state including wetlands.
The document states that approximately 0.6 acres of waters including wetlands will be
impacted. Approximately 100 feet of a tributary to Oak Hollow Lake will be relocated.
DOT has committed to implementing HOW soil and erosion control measures for this
project. Hazardous spill catch basins will be installed due to the water supply critical
area. Stream relocation will be accomplished using DOT's stream relocation
guidelines. Due to these commitments, DEM concurs with the project.
DOT is reminded that endorsement of an EA or FONSI by DEM would not preclude
the denial of a 401 Certification upon application if wetland or water impacts have not
been avoided and minimized to the maximum extent practicable.

My staff and I have reviewed the Environmental Assessment for the Intermediate Loon
(TIP Project No. U-2536) in High Point. Although we do have comments regarding the lane
configurations in Figures A-D, we do not feel a Environmental Impact Statement is necessary.
After review of the EA we determined that many of the intersection diagrams were not illustrated
as they currently exist. Enclosed with this letter are the existing lane configurations and our
recommendations for the proposed Intermediate Loop. A revised capacity analysis calculation
may be necessary to correspond with the revised intersection lane designs.

Intermediate Loop and North Main St. (US 311)
At this intersection, we currently have westbound dual lefts from the Intermediate Loop
onto Main St. We feel that the dual lefts will still be needed in the future. The outside
left turn lane could be a shared left and through lane with the appropriate signal phasing.
Intermediate Loon and Old Winston Road
Due to the amount of traffic that travels on Old Winston Rd. and Oakview Rd., we would
like to see if it is feasible to carry an additional northbound lane on Old Winston Rd.
from the Intermediate Loop to Oakview Rd. This section is approximately 450 feet long
and the lane would be designated as a right turn only lane.
Intermediate Loop and Johnson St.
Along the finished section of the Intermediate Loop between Johnson St. and Eastchester
Drive, lies the Oak Hollow Regional Mall with numerous outparcels. At the intersection
of the Intermediate Loop and Johnson St., we are currently operating the Intermediate
Loop with dual left turn lanes and dual right turn lanes. We feel that it will be necessary
to continue to operate the Intermediate Loop with dual left turn lanes onto southbound
Johnson St.
Intermediate Loop and Centennial St.
At this intersection, we feel that there is not a need for a southbound right turn lane on
Centennial St. Instead, we feel there is a need for southbound dual left turn lanes from
Centennial St. onto the Intermediate Loop.
Intermediate Loop and Montlieu Ave.
We feel there is not a need for southbound dual left turn lanes from the Intermediate Loop
onto Montlieu Ave. We feel that the dual left turn lanes may create a safety problem due
to the short section of the two eastbound through lanes before it merges into one through
lane. Also, we currently do not plan to pursue any widening on that section of Montlieu
Ave.

The North Carolina Department of Transportation (DOT) proposes to construct a second
segment of the High Point Intermediate Loop. This project, identified as TIP No. U-2536 C,
connects NC 68 (Eastchester Drive) with SR 1471 (Montilieu Avenue) by constructing a new
location facility and widening US 29 A (East College Drive). The project has a let date of
October 1998.
The subject project has been described in a State Environmental Assessment (EA), that
was signed on September 28, 1995. The State Finding of No Significant Impact (FONSI) for the
project was signed on June 26, 1997. These documents, particularly the EA, include studies
pertaining to impacts to natural systems and protected species for the combined project. Copies
of these documents have been provided to regulatory agencies involved in the permit review
process.
The project involves the construction of two roadway facilities. The DOT proposes to
construct a four-lane divided curb and gutter facility on new location from NC 68 to US 70 A
(Lexington Avenue). From US 70 A, the existing facility will be widened to a five-lane curb and
gutter. This portion of the project extends to SR 1471 (Montilieu Avenue). Total project length
is 2.4 miles.
Construction of the proposed project necessitates impacts to waters of the United States.
Impacts include the replacement/ extension of an existing culvert and cut/ fill of wetlands.

Jurisdictional wetlands for the project have been delineated by DOT biologists (October
1995) using criteria described in the 1987 U.S. Army Corps of Engineers (COE) Wetland
Delineation Manual. This delineation during the natural resource investigation, revealed four
sites within the project study area for U-2536 C. Wetland evaluations have also been performed
according to Guidance for Rating the Values of Wetlands in North Carolina, Fourth Version, by
the Division of Environmental Management (DEM).
The DOT has avoided and minimized impacts to wetlands and streams to the extent
practicable. During the natural resources inventory investigation for the EA, the DOT delineated
jurisdictional wetlands and located these wetlands using Global Positioning Systems (GPS).
Based on this information, the DOT avoided one (1) wetland in the C section of the project and
three (3) wetlands in the A section of the project. Minimization of wetland impacts has also
occurred by selecting the roadway facility which requires the least amount of right of way, and
therefore minimizing impacts to wetlands. Figure 7 in the EA depicts the selection of the
recommended alternative and the avoiding of jurisdictional wetlands. This mitigation process
has been documented in the EA.
Table 1 summarizes impacts to waters of the United States by the project, and includes
DWQ rating, Cowardin classification, and impact areas for wetlands and surface waters.
Cowardin classification refers to guidelines developed to classify wetlands and deepwater
habitats as outlined in Classification of Wetlands and Deepwater Habitats of the United States by
Cowardin et al (1979).

Note: PFO1C denotes palustrine broad-leaved deciduous forested, that is seasonally flooded.
Of the wetland impacts, 0.04 acre will result from mechanized clearing. The remaining
0.67 acre involves fill and cut of wetlands. These wetlands are associated with a drainage
channel which transitions to a intermittent stream at Station 12+70. These wetlands are disturbed
bottomland systems with areas of the forests dominated by blackberry (Rubus sp.), greenbrier
(Smilax sp.), Japanese honeysuckle (Lonicera japonica) and poison ivy (Toxicodendron
radicans).
At Station No. 27+36, two culverts will be installed, one for a greenway crossing and
the other for Boulding Branch. The crossing is associated with US 29 A (East College Drive)
which will be widened. The length of stream enclosure is 106 feet, or 0.03 acre.
As mentioned earlier, wetlands and streams impacted by the project have been minimized
by project planning. The DOT believes the wetlands are of low quality. The DOT believes that
compensatory mitigation for project impacts should not be required.

During project construction, the DOT will utilize standard Best Management Practices
(BMPs). The EA states that Design Standards in Sensitive Watersheds will be used in the Oak
Hollow drainage area. This section of the project does not lie within this area.
The DOT has investigated issues related to cultural resources and Areas of Potential
Effect (APE). The DOT has received concurrence from the State Historic Preservation Office
that the culvert crossing at Boulding Branch will have no effect on the High Point College
historic district, which is an eligible National Register property. The concurrence form has been
attached to this letter.
Since completion of the EA and the FONSI, the bald eagle (Haliaeetus leucocephalus)
has been listed for Guilford County. This issue has been reviewed, and a biological conclusion
of "No Effect" has been rendered. A copy of this report has been enclosed with this permit
application.
In summary, the proposed project impacts 0.71 acre of wetlands and 0.03 acre of surface
waters (106 linear feet). The DOT has taken practicable measures to avoid and minimize
impacts to waters of the United States. The DOT believes that the proposed project can be
authorized by the COE under a Section 404 General Permit 31. Enclosed with this letter is a
completed preconstruction notification form and permit drawings that depict impacts to waters of
the United States from project construction. Application is also made for 401 Water Quality
Certification by the Division of Water Quality.

Reference: Natural Resources Technical Report for TIP No. U-2536, by
Phillip Todd, dated May 3, 1995.
Since completion of the referenced report, the US Fish and Wildlife Service
(FWS) has added the bald eagle to its listing for Guilford County. The FWS has listed
the bald eagle as Threatened, a species that is likely to become an endangered species
within the foreseeable future throughout all or a significant portion of its range. A
description of the bald eagle has been provided, as well as a biological conclusion.
Haliaeetus leucocephalus (bald eagle) T
Adult bald eagles can be identified by their large white head and short white tail.
The body plumage is dark-brown to chocolate-brown in color. In flight bald eagles can be
identified by their flat wing soar.
Eagle nests are found in close proximity to water (within a half mile) with a clear
flight path to the water, in the largest living tree in an area, and having an open view of the
surrounding land. Human disturbance can cause an eagle to abandon otherwise suitable
habitat. The breeding season for the bald eagle begins in December or January. Fish are
the major food source for bald eagles. Other sources include coots, herons, and wounded
ducks. Food may be live or carrion.
Biological Conclusion: No Effect

No habitat for the bald eagle exists in the project study area. The nearest water
body is Oak Hollow Lake, which is over 0.5 miles southeast of the project's beginning at
NC 68 (Eastchester Drive). A mall exists between the beginning of the project and the
lake.
The database of the NC Natural Heritage Program was consulted on October 31,
1997, in regard to the presence of the bald eagle. This search revealed no occurrence of
the bald eagle in the project study area. The proposed bridge replacement project will
have no impact upon the bald eagle.
