After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3114. This certification allows you to use Nationwide Permit Number 33 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any addii:.onal conditions listed below. 1. DOT shall follow guidance provided by DWQ in our 27 May 1997 letter for minimizing damage to aquatic resources until a final policy is developed in conjunction with DOT. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786. On January 25, 1997 the North Carolina Department of Transportation distributed a Categorical Exclusion document for the above referenced project proposing to proceed under a Nationwide Permit in accordance with 33 CFR Appendix A (B-23). On February 11, 1997, the Corps of Engineers verified the issue of a Nationwide 23 permit. The project now requires the construction of a temporary rock causeway to provide construction access. Construction of the proposed temporary rock causeway is depicted in the attached drawings (Sheets 1 to 5). The causeway will facilitate the construction of the drilled shafts and placement of the structural steel. Temporary fill in surface waters will be 0.146 acres. Restoration Plan: The temporary fill will consist of Class I riprap. No permanent fill will result from the subject activity. Reference elevations are available for the area of proposed construction of the temporary causeways. Following construction of the causeways, all material used in the construction of the temporary causeways will be removed. The temporary fill area will subsequently be restored to its original contour and rough surface texture. The causeways will not require the construction of haul roads in jurisdictional Waters of the United States. The haul road depicted on the attached sheets are in uplands. In order to prevent erosion and deposition of sediment in jurisdictional areas the haul road will be constructed with a 4 inch stone base. The e temporary impact area is expected to recover naturally, since the natural streambed and plant material will not removed. The NCDOT does not propose any additional planting in this area. Schedule: The project schedule calls for letting November 1998 with a date of availability of December 28, 1998. It is expected that the contractor will choose to start construction of the causeway at that time. We expect that the construction will be completed by May 15, 1998. The causeways will stay in place for about a year and should be removed between December 1999 and May 2000. It is anticipated that the above mentioned activities will be authorized under Section 404 Nationwide Permit 33 (Temporary Construction Access and Dewatering). We are, therefore, requesting the issuance of a nationwide permit authorizing construction of the causeway. We anticipate a 401 General Certification will apply to this project, and are providing one copy of the application to the North Carolina Department of Environmental Health and Natural Resources, Division of Water Quality, for their review.
