Box 250 Bryson City, NC 28713 Dear Mr. Styles: You have our approval, in accordance with the attached conditions and those listed below, to relocate 0.02 acres of waters for the purpose of widening SR 1545, as you described in your application dated 8 July 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. DOT shall follow the DOT/DEHNR stream relocation guidelines for the relocated stream segment. If there is a net loss of stream length, off-site mitigation is required either through the Wetlands Restoration Program or off-site mitigation. DWQ shall be copied on the stream relocation plans and written approval from DWQ must be received before the stream is moved. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Box 250 Bryson City, NC 28713 July 8, 1997 "?'?''oNa> 199', Ei.V444 The North Carolina Department of Transportation is proposing to grade, drain, base and pave primarily along the existing roadway of SR 1545, Sorrells Cove Road, in Haywood County. In order to construct this project in accordance with our current secondary road standards, and due to the re-channelization of Bowen Branch (DEM Class C) we are requesting authorization under Section 404 of the Clean Water Act. I am sending a straight-line diagram with our proposed erosion control and construction limits at various sites along this project. In addition, a typical section of the road, cross sections, drawings for the channel change, general notes and standards on erosion control measures, and a marked county map are enclosed. We propose to build the new channel in the dry, using rip-rap to stabilize the banks only. Natural substrate will be left on the bottom of the channel to minimize impact to wildlife habitat and allow the existing stream gradients to remain as unchanged as physically possible. The best management practices will be used to minimize and control sedimentation and erosion on this project. The construction foreman will review all erosion control measures daily to ensure sedimentation and erosion controls are being effectively controlled. If the planned devices are not functioning as intended, they will immediately be replaced with better devices. The silt fences and other erosion control devices will be in place prior to pipe construction and will remain in place until the project is stabilized. By copy of this letter I am asking Mr. Mark Davis, Habitat Coordinator Western Mountain District, of the NCWRC to comment directly to you concerning the 404 Nationwide permit request. It is made of permeable filter fabric buried at the bottom, stretched and supported by steel posts. The silt fence reduces the water flow while retaining the sediment. They may also be used to divert water fl6w to protected outlets. Silt fences nerd to be checked after each significant rainfall to ensure there effectiveness. They must be maintained on a regular basis. Silt fences shall no be installed across streams, ditches, or waterways. SECRETARY ENVIRONMENTAL SCIENCES The North Carolina Department of Transportation is proposing to grade, drain, base and pave primarily along the existing roadway of SR 1545, Sorrells Cove Road, in Haywood County. In order to construct this project in accordance with our current secondary road standards, and due to the re-channelization of Bowen Branch (DEM Class C) we are requesting authorization under Section 404 of the Clean Water Act. I am sending a straight-line diagram with our proposed erosion control and construction limits at various sites along this project. In addition, a typical section of the road, cross sections, drawings for the channel change, general notes and standards on erosion control measures, and a marked county map are enclosed. We propose to build the new channel in the dry, using rip-rap to stabilize the banks only. Natural substrate will be left on the bottom of the channel to minimize impact to wildlife habitat and allow the existing stream gradients to remain as unchanged as physically possible. The best management practices will be used to minimize and control sedimentation and erosion on this project. The construction foreman will review all erosion control measures daily to ensure sedimentation and erosion controls are being effectively controlled. If the planned devices are not functioning as intended, they will immediately be replaced with better devices. The silt fences and other erosion control devices will be in place prior to pipe construction and will remain in place until the project is stabilized. By copy of this letter I am asking Mr. Mark Davis, Habitat Coordinator Western Mountain District, of the NCWRC to comment directly to you concerning the 404 Nationwide permit request. It is made of permeable filter fabric buried at the bottom, stretched and supported by steel posts. The silt fence reduces the water flow while remaining the sediment. Box 250 Bryson City, NC 28713 Dear Mr. Styles: You have our approval, in accordance with the attached conditions and those listed below, to relocate 0.02 acres of waters for the purpose of widening SR 1545, as you described in your application dated 8 July 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3103. This certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. In addition, you should &et any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. DOT shall follow the DOT/DEHNR stream relocation guidelines for the relocated stream segment. If there is a net loss of stream length, off-site mitigation is required either through the Wetlands Restoration Program or off-site mitigation. DWQ shall be copied on the stream relocation plans and written approval from DWQ must be received before the stream is moved. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
