APPROVAL of 401 Water Quality Certification with ADDITIONAL CONDITIONS

Dear Mr. Vick:
You have our approval, in accordance with the attached conditions, to place fill material in waters for the
purpose of constructing a bridge replacement at SR 1461, as you described in your application dated January
31, 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3114. This certification allows you to use Nationwide Permit Number 33 when it is
issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. Applicant is
reminded that HQW Best Management Practices for Sediment and Erosion Control shall be-us6 for this
project. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation
may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must
follow the conditions listed in the attached certification. In addition, you should get any other federal, state or
local permits before you go ahead with your project. Also this approval will expire when the accompanying
404 or CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of-the Clean Water

On April 4, 1995 the U.S. Army Corps of higincers issued a Nationwide Permit No. 23
(Action 11). 199502050 for the referenced project. It Was Subsequently determil

upland area.
A
Prior to construction, reference elevations will be taken in the temporary till area. The
area will then be restored to its original contour and rough surface texture based on the
reference elevations. The area is expected to recover naturally since the topsoil and seed
source will not be removed. No additional planting is proposed. Placement of the
temporary fill is expected to last 5 months, from February to June 97.
It will also be necessary to cross the river with a crane. Timber mats supported by steel
beams resting on the river bottom will be utilized to walk the crane across the river. This
material will immediately be removed from the river once the crane crosses it. The
crossing will be accomplished in a short period of time, probably one day.
Erosion controls comprised of temporary silt ditches, silt basins, and filter basins, as
shown in the plans, will be installed to control erosion of the disturbed earth material into
the river.
Please review this permit application for approval under a Section 404 Nationwide
Permit 33. By copy of this letter, it is also requested that the appropriate General Water
Quality Certification be issued by the North Carolina Division of Water Quality.

You have our approval, in accordance with the attached conditions and those listed below, to temporarily
place fill in 0.04 acres of wetlands or waters for the purpose of replacing Bridge 64 over Little River on SR
1461, as you described in your application dated 31 January 1997. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3114. This certification
allows you to use Nationwide Permit Number 33 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be
valid, you must follow the conditions listed in the attached certification and any additional conditions listed
below. Applicant is reminded that HQW Sediment and Erosion Control measures shall be used for this
project. In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and
Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA
permit expires unless otherwise specified in the General Certification.

On April 4, 1995 the U.S. Army Corps of Engineers N, sued a Nationwide Permit No. 23
(Action ID. 199502050) 11or the referenced project. It was subsequently determined
during a conversation between Mr. T. N. Parrott, NCDOT resident engineer in Durham
County and Mrs. Jean B. Manuele of the USAC:OF. that a Nationwide Permit No. 33
(Temporary Construction Access and Dewatering) would be necessary to allow
temporary fill into the Little River to facilitate bridge construction. The activities
proposed under this pemut are detailed in the attached drawings.
In order to remove the existing bridge abutments and drill new piers, a Type ll synthetic
drainage fabric will be placed on the bottom of the river and approximately 180 yd' of fill
material, consisting of class H rip rap and old bent material, will be placed on top of the
fabric. Hardwood mats will then be placed on top of the (ill material fior positioning of
the equipment used to drill the new pierc_ This will impact approximately 0.04 acres of
waters of the United States_ No wetlands will he impacted. All temporary fill will be
removal upon completion of the drilled pier work- The rip rap will be used as part of the
future slope protection while the old bridge abutments will be disposed of off-site in an
upland area.
