APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Bennett:
You have our approval, in accordance with the attached conditions and those listed below, to fill
in 0.02 acres of wetlands or waters for the purpose of paving SR 1185 at Jefferson, as you described
in your application dated 21 July 1997. After reviewing your application, we have decided that this
fill is covered by General Water Quality Certification Number 3103. This certification allows you to
use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. In addition, you
should get any other federal, state or local permits before you go ahead with your project including
(but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water
Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA
permit expires unless otherwise specked in the General Certification.
This approval is only valid for the purpose and design that you described in your application
except as modified below. If you change your project, you must notify us and you may be required
to send us a new application. If total wetland fills for this project (now or in the future) exceed one
acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7).
For this approval to be valid, you must follow the conditions listed in the attached certification and
any additional conditions listed below. Sediment and erosion control measures shall adhere to the
design standards for sensitive watersheds (T 15A:04B .0024).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification
and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

Dear Mr. Thomas,
The Department of Transportation is scheduled to grade, drain
base, and pave primarily along the existing roadway of SR 1185
(Dollar Rd.) in Ashe county during the 1997-1998 fiscal year. Due.
to the proximity of a small stream being a trib. to Buffalo
Creek Class C Trout we are requesting a 404 Nationwide permit no.
3 to allow us to upgrade the 1 existing cross line drainage
structures that will need replacing.
Attached is a plan sheet with proposed erosion control, stream,
stream embankment, pipe crossing, and marked county map.
By copy of this letter I am asking Ms. Stephanie Goudreau Mt.
Region Coordinator with the North Carolina Wildlife Resources
Commission to comment directly to you concerning the 404
Nationwide Permit request.

Also by copy of this letter, i am requesting authorization to
proceed under Section 401 of the Clean Water Act from the Division
of Environmental Management.
We would like to begin construction as soon as possible. if
further information is required,, please let me know. Your early
review and consideration will be greatly appreciated.

EROSION CONTROL SCHEDULE
(1) All adequate temporary erosion control measures will be
installed before clearing and grubbing operations begin.
(2) As constrl.lction progresses temporary and permanent
erosion control devices shall be installed in a timely
manner, according to any special permit requirements
and /or requirements set out in.G.S. 113A-57.
MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY
Pursuant to G.S. 113A-57(3), Provisions for a ground
cover sufficient to restrain erosion must be
acr:omplished within 30 working days or 120 calendar
days following completion of construction or
development, whichever period is shorter, except as
provided in 15A NCAC 4B .0024(e).
DESIGN STANDARDS IN SENSITIVE WATERSHEDS
Pi.irsuant to G.S. 113A-57(3) provisions for a ground
rover si.ifficient to restrain erosion must be
provided for any portion of a land-disturbing
mr•tivity in a HnW zone within 15 working days or 50
calendar days following completion of construction
or development, whichever period is shorter.
(3) All siltation and erosion control devices shall be
properly maintained until no longer needed.
(4) On projects performed by D.O.T. Maintenance Forces,
request will promptly be made to the Division Roadside
Environmental Unit for stage and permanent seeding.
(5) Any removal of siltation devices will be based on the
condition of established ground cover of that area the
device 11 serving.
CONSTRUCTION SEOUENCE FOR INSTALLING ROADWAY CULVERTS
1. Clear only eno»gh area and install the downstreatti measures
siirh a? siIt check dams, silt screens, and slit bdsins as
noted on plan..-
2. Excavate the 2' base tail ditch.
3. Excavate and install. the roadway culvert.
4. Install sediment control measures at inlet as noted on
plan.
5. Install srlditional pipe outlet protection and inlet
protection as noted.

HIP RAP MATERIALS
1042-1 PLAIN RIP RAP.
Stone for plain rip rap shall consist of field stone or- rough unllewn quarry
stone. The stone shall be sound, tough, dense, resistant to the action of air
and water, and suitable in all other respects for the purpose intended.
Where broken concrete from demolished structures or pavement is avail-
able, it may be used in place of stone provided that such use meets with the
approval of the Engineer. However, the use of broken concrete which
contains reinforcing steel will not be permitted.
The stone or broken concrete shall be graded to meet the following
requirements:
1. For Class 1 Rip Rap. Stone shall vary in weight from 5 to 200 pounds.
At least 30 percent of the total weight of the rip rap shall be in
individual pieces weighing a rninir7lum of 60 pounds each. Not more
than 10 percent of the total weight of the rip rap may be in individual
pieces weighing less than 15 pounds, each.
2. For Class 2 Rip Rap. Stone shall vary in weight from 25 to 250
pounds. At least 60 percent of the total weight of the rip rap shall be in
individual pieces weighing a minimum of I00 pounds each. Not more
than 5 percent of the total weight of the rip rap may be in individual
pieces weighing less than 50 pounds each.
