Dept. of Transportation Elkin District Office P.O. Box 558 Elkin, NC 28621 Dear Mr. Atkins: You have our approval, in accordance with the attached conditions, to place fill material in 0.006 acres of wetlands or waters for the purpose of upgrading SR 1104, as you described in your application dated 17 March 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3100. This Certification allows you to use General Permit Number 031 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447; Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Dear Mr. Jolly: The North Carolina Department of Transportation, District I Maintenance plans to Grade, Drain , Base and Pave SR 1104 (Camp Butner Road) in Aileghany County, to improve safety for the traveling public. (1) Sta. 22+40 there is a Spring Head ich flows into an existing 20' of 18' CMP which we plan to replace wit 3 ' of 18" CMP. From Sta. 22+40 to Sta. 23+ 40 there is a wet ditch line. (2) Sta. 35+70 there is a Spring Head which flows into an existing 30' of 10" CMP which we plan to replace with 30' of 15" CMP. (3) Sta. 3 0 there is an existing 24' of 15" RCP; which we plan to replace with 0' f 24" CMP. Also on Lt. from Sta 37+oo to 38+oo there is a wet ditch Me. These locations involve perpendicular unnamed streams which are tributaries to Rich Mtn. Creek which is a tributary to Bullhead Creek and Roaring River. We are requesting a 404 Nationwide Permit (#3 Maintenance) from your agency. Generally, the order of installation of the erosion control measures will be as follows: Temporary silt basins shall be installed before clearing and grubbing begins. Silt fences and temporary silt ditches shall be installed after clearing and before grading. Temporary stone ditch checks shall be.installed as soon as ditchline is established. Pipe outlet and inlet protection will be done as soon as the pipe is installed. Seeding and other permanent erosion control measures are to be implemented as soon as practical.
