Box 250 North Wilkesboro, NC 28659 Dear Mr. Bennett: ?A4L7EHNR March 20, 1997 Ashe County WQC 401 Project #970210 You have our approval, in accordance with the attached conditions, to place fill material in wetlands or waters for the purpose of maintaining SR 1552, as you described in your application dated 2 March 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3127. This Certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stonmwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specked in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter. 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. 'J Subject: Nationwide Permit No. 3 to replace 5 existing pipe along SR 1552 adjacent to unknown trib. to North Fork New River HQW Dear Mr. Thomas, The Department of Transportation is scheduled to grade, drain base, and pave primarily along the existing roadway of SR 1552 (Richardson Rd.) in Ashe County during the 1996-1997 fiscal year. Due to the proximity of an unknown stream being a trib to North Fork New River HQW we are requesting a 404 Nationwide permit no. 3 to allow us to upgrade the 5 existing cross line drainage structures that will need replacing, and or extending. Attached is a straight line sketch with proposed erosion control, stream, stream embankment, pipe crossing, and marked county map. By copy of this letter I am asking Ms. Stephanie Goudreau Mt. Region Coordinator with the North Carolina Wildlife Resources Commission to comment directly to you concerning the 404 Nationwide Permit request. Ank Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. Stone foi- plain rip rap shall consist of fieldstone or rough unhewn quarry stone. The stone shall be sound, tough, dense, resistant to the action of air and water, and suitable in all other respects for the purpose intended. Where broken concrete from deniolished structures or pavement is avail- able, it may be used in place of stone provided that such use meets with the approval of the Engineer. However, the use of broken concrete which contains reinforcing steel will not be permitted. The stone or broken concrete shall be graded to meet the following requirements: 1. For Class 1 Rip Rap. Stone shall vary in weight from 5 to 200 pounds. At least 30 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 60 pounds each. Not more than 10 percent of the total weight of the rip rap may be in individual pieces weighing less than 15 pounds each. 2. For Class 2 Rip Rap. Stone shall vary in weight from 25 to 250 pounds. At least 60 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 100 pounds each. Not more than 5 percent of the total weight of the rip rap may be in individual pieces weighing less than 50 pounds each. 691 EROSION CONTROL SCHEDULE (1) All adequate temporary erosion control measures will be installed before clearing and grubbing operations begin. (2) As construction progresses temporary and permanent erosion control devices shall be installed in a timely manner, according to any special permit requirements and /or requirements set alit in.r.S. 113A-57. Clear only enough area and install the downsti-e-AM neasures such as silt check dams, silt screens. and silt basins as noted on plan. 2. Excavate the 2' base tail ditch. 3. Excavate and install the roadway culvert. 4. Install sediment control measures at inlet as noted on plan. 5. Install additional pipe outlet protection and inlet protection as noted. i HIGH QUALITY WATERS 1. Uncovered areas are limited at any given time to a maximum total area of 20 acres. 2. Erosion and sedimentation control measures shall be designed to provide protection from the 25 year storm. 3. Large Type-A basins shall be designed and constructed with a settling efriciency of at least 70% for the 40 micron soil particle size transported by runoff from the 2 year storm. 4. Newly constructed channels shall be constructed with side slopes no steeper than 2:1, unless slopes are to be stabilized by methods other than vegetation. 5.
