Dept. of Transportation P.O. Box 250 North Wilkesboro, NC 28659 Dear Mr. Bennett: You have our approval to place fill material in 0.02 acres of wetlands or waters for the purpose of upgrading SR 1569, as you described in your application dated 19 March 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3026. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Applicant is reminded that High Quality Waters sediment and erosion control measures should be used for this project. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of,this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. SECRETARY 28659 RECEIVED MAR 2 6 1996 ENVIRONMENTAL SCIENCES ?-,..-IJ Subject: Nationwide Permit No. 2'Z to replace existing pipe along SR 1569 adjacent to small stream trib. to Darnell Branch class-c-trout. Dear Mr. Thomas, The Department of Transportation is scheduled to grade, drain base, and pave primarily along the existing roadway of SR 1569 (Darnell Branch Rd)., in Wilkes County during the 1996-1997 fiscal year. Due to the proximity of a small stream being a trib to Darnell Branch Class-c-trout we are requesting a 404 Nationwide permit no. 3 to allow us to upgrade the B'zzxisting cross line drainage structures that will need replacing, and or extending. Attached is a straight line sketch with proposed erosion control, stream, stream embankment, pipe crossing, and marked county map. By copy of this letter I am asking Ms. Stephanie Goudreau Mt. Region Coordinator with the North Carolina Wildlife Resources Commission to comment directly to you concerning the 404 Nationwide Permit request. A request will be made on this project for a Temporary Encroachment in the Trout Water Buffer Zone of Darnell Branch and I am asking Ms. Goudreau to comment directly to me concerning the Trout water buffer zone encroachment. 9 Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. We would like to begin construction as soon as possible. If further information is required, please let me know. Your early review and consideration will be greatly appreciated. Sincerely, 46?r D. K.
