Subject: Transylvania County, Replacement of Bridge No. 31 over the Little River
on SR 1535; State Project No. 8.2000801; TIP No. B-3051; USACE
Action ID 199830388; DWQ Project No. 960623.
The U. S. Army Corps of Engineers (USACE) issued a Section 404 Nationwide Permit 23
(Categorical Exclusion) for the subject project on July 09, 1996. This permit expired on
January 21, 1997. The project was re-authorized by the USACE on February 18, 1998. The
replacement of Bridge No. 31 over the Little River on SR 1535 was let to construction in August
of 1998.
The recommended alternative has changed since the time of the most recent authorization. The
previous preferred alternative was to replace the bridge with a four-barrel reinforced concrete
box culvert. The new recommendation is to replace the bridge on existing location with a new
bridge approximately 28.8 meters (94.5 feet) in length with a width of 8.23 meters (27 feet
wide). The approach from the west will be 85 meters (279 feet) long. The eastern approach will
be 86.2 meters (283 feet) long. The new bridge will have three spans and will require in-stream
construction of bridge piers near the stream bank. This will require less in-stream activity than
the installation of a box culvert and the moratorium for in-stream activity between January 1 and
April 15 to avoid impacts on trout reproduction will be followed. Traffic will be detoured on
secondary roads during construction. The NCDOT will adhere to all environmental
commitments.
The NCDOT requests that the USACE modify the existing permit to include the current design

Dear Mr. Vick:
You have our approval to place fill material in wetlands or waters for the purpose of conducting
foundation test borings at Bridge No. 31 over Little River on SR 1535, as you described in your application
dated 11 June 1996. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3027. This certification allows you to use Nationwide Permit Number
6 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send`us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. In addition, you
should get any other federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh,.N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

The Categorical Exclusion for this project was approved on October 31, 1995. At
this time, foundation test borings are necessary in the channel and along the banks of the
Little River. This work will be necessary to obtain foundation information for design of
the structure. We have determined that this activity may be authorized under Nationwide
Permit No. 6 for Survey Activities. As this project occurs in a designated mountain trout
county, review by the U.S. Army Corps of Engineers and North Carolina Wildlife
Resources Commission is required. We hereby request approval of Nationwide Permit
No. 6 for the proposed work.

A scoping meeting for the subject bridge was held in the Highway
Building on November 16, 1994.

eligible for the National Historic Register. If this remains true, then this
project will not be subject to section 4(f).
Mr. F.D. Martin (Division 14 Engineer) has stated that road closure is
acceptable and that the bridge should be replaced in place.

Meeting minutes for the subject project were sent on February 9, 1995.
The meeting minutes indicated that the structure would be a bridge. Since
that time the Hydraulics Unit has noted that the structure recommendation
will be a culvert, not a bridge. The new culvert will be 3.7 meters X 3.4
meters (12 feet X 11 feet). Please note this in your files.

these sheets and the related review procedure is to have an early "meeting
of the minds" as to the scope of work that should be performed and thereby
enable us to better implement the project. A scoping meeting for this
project is scheduled for November 16, 1994 at 10:00 A. M. in the Planning
and Environmental Branch Conference Room (Room 434). You may provide us
