After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2735. This certification allows you to use General Permit Number 031 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. SR 1103 is a gravel road that we propose to clear, grub, grade, replace/extend pipes, and pave for a distance of 2.08 miles. Grading will be moderate to heavy. We are requesting permission to replace and extend pipes in live streams noted on plans at survey stations 12+60, 29+90, and 58+10. Pipes will be replaced using our standard method of pipe installation described in the erosion control plans. NCDOT "Best Management Practices for Protection of Surface Waters" and proper phasing of erosion control items will be used to minimize and control sedimentation and erosion. By copy of this letter to Mr. Richard Phillips, P. E. (DEHNR) we are requesting a variance to work in the Trout Water Buffer Zone at locations described as follows: STREAM STATION RANGE LOCATION Terry Creek 21+00 - 27+50 Lt. Trib. to Green River 51+00 - 56 +60 Lt. Green River 58+10 - 59+75 Rt. Please note that we do not propose to disturb fill slopes in these locations with the exception of pipe placement/replacement as indicated on the attached erosion control plans, and spot stabilization with Class I Rip Rap along Sta. 58+25 - 58+ 75 Rt. Silt Basin - 2 (S.B. 14) I TEMPORARY SILT FENCE: A temporary silt fence is commonly used at the toe of a fill section to prevent off- site sedimentation. It is made of permeable filter fabric buried at the bottom, stretched and supported by steel posts. The silt fence reduces the water flow while retaining the sediment. They may also be used to divert water flow to protected outlets. Silt fences need to be checked after each significant rainfall to ensure there effectiveness. They must be maintained on -a regular basis. Silt fences shall not be installed across streams, ditches, or waterways. AREAS OF USE: • At toe of fill sections where sediment runoff can be stored and contained inside. the project limits. DESIGN CRITERIA: Material With Wire Without Wire Fabric Type 3 Class A Type 3 Class B Steel posts length 5 ft 5 ft. Post spacing 10 ft. 6 ft. maximum 17 March, 1992 8 SECTION 1042 RIP RAP MATERIALS 1042-1 PLAIN RIP RAP. Stone for plain rip rap shall consist of field stone or rough unhewn quarry stone. The stone shall be sound, tough, dense, resistant to the action of air and water, and suitable in all other respects for the purpose intended. Where broken concrete from demolished structures or pavement is available, it may be used in place of stone provided that such use meets with the approval of the Engineer. However, the use. of broken concrete which contains reinforcing steel will not be permitted. All stone shall meet the approval to the Engineer. While no specific gradation is required, the various sizes of the' stone shall be equally distributed within the required size range. The size of an individual stone particle will be determined by measuring its long dimension. Stone or broken concrete for Rip Rap shall meet the requirements of Table 1042-1 for the clay-, and size distribution. Pipes will be installed in the dry wherever possible. Pipes laid in streams large enough to support trout will be installed six (6) inches below the stream bed to allow the bottom of the pipe to silt over so that trout movement will be over a natural stream bed.
