Box 5189 Horse Shoe, NC 28742 Dear Mr. Swain: You have our approval to place fill material in 0.01 acres of wetlands or waters for the purpose of improving SR 1191, as you described in your application dated 2 May 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2735. This certification allows you to use General Permit Number 031 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an a djudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O, Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. SR 1191 is a gravel road that we propose to clear, grub, grade, pave, and replace/extend pipes for a distance of 0.53 miles. Grading will be moderate. We are requesting permission to replace and extend a pipe in a live stream as noted on the plans at survey station 7 + 90. The pipe will be replaced using our standard method of pipe installation described in the erosion control plans. NCDOT " Best Management Practices for Protection of Surface Waters" and proper phasing of erosion control items will be used to minimize and control sedimentation and erosion. By copy of this letter, we are asking Mr. David Yow, N. C. Wildlife Resources Commission, to comment directly to the Corps of Engineers concerning the Nationwide Permit request. Upon review for the Corps of Engineers, we are requesting that Mr. Yow forward a copy to us (NCDOT) as well. All pipes shall be laid in accordance with Section 300 of the North Carolina Department of Transportation "Standard Specifications for Roads and Structures", July, 1995. Pipes will be installed in the dry wherever possible. Pipes laid in streams large enough to support trout will be installed six (6) inches below the stream bed to allow the bottom of the pipe to silt over so that trout movement will be over a natural stream bed.
