APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Bennett:
You have our approval to place fill material in 0.01 acres of wetlands or waters for the purpose of
upgrading the drainage structures along SR 1111 in Ashe County, as you described in your application dated 4
September. 1996. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 3026. This certification allows you to use Nationwide Permit Number 3 when
it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. For this approval to be valid, you must follow the conditions listed in the attached certification
and any additional conditions listed below. The applicant is reminded that sediment and erosion control
measures should adhere to the design standards for sensitive watersheds (T15A:0480024). In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but not
limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act. If you have any questions, please telephone John Domey at 919-733-1786.

Dear Mr. Thomas,
The Department of Transportation is scheduled to grade, drain
base, and pave primarily along the existing roadway of SR 1111
(Big Flatts Church Rd.) in-Ashe County during the 1996-1997 fiscal
year. This is a needed.safety project to eliminate a hazardous
curve. Due to the proximity of a-small stream (Couches creek class
WS IV+) we are requesting a 404 Nationwide permit no. 3 to allow
us to upgrade the 1 existing cross line drainage structures that
will need replacing.
Attached is a straight line sketch with proposed erosion control,
stream, stream embankment, pipe crossing, and marked county map.
By copy of this letter I am asking Ms. Stephanie Goudreau Mt.
Region Coordinator with the North Carolina Wildlife Resources
Commission to comment directly to you concerning the 404
Nationwide Permit request.

Also by copy of this letter, I am requesting authorization to
proceed under Section 401 of the Clean Water Act from the Division
of Environmental Management.
We would like to begin construction as soon as possible. If
further information is required, please let me know. Your early
review and consideration will be greatly appreciated.

EROSION CONTROL SCHEDULE
(1) All adequate temporary erosion control measures will be
installed before clearing and grubbing operations begin..
(2) As construction progresses temporary and permanent
erosion control devices shall be installed in a timely
manner, according to any special permit requirements
and /or requirements set out in.G,s. 113A-57.
MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY
Pursuant to G.S. 113A-57(3), Provisions for a ground
cover sufficient to restrain erosion must be
accomplished within 30 working days or 120 calendar
days following completion of construction or
development, whichever period is shorter, except as
provided in 15A NCAC 4B..0024(e).
DESIGN STANDARDS IN SENSITIVE WATERSHEDS
Pursuant to G.S. 113A-57.(3) provisions for a ground
cover, .sufficient to restrain. ero'gion must be
_provided for any portion of.a land-disturbing
activity in a HQW zone within 15 working days or, 60
calendar days- following completion of. construction'
or development,' whichever period is shorter.
(3) All siltation and eroson'control dew-e4 shall be
properly maintained until no longer needed.
(4) On projects performed by D.O.T'. Maintenance Forces,,
request will promptly be. made to the Division Roadside
Environmental Unit for stage and permanent seeding.
(5) Any removal of siltation devices will be based on the
condition of established ground cover of that area the
device i4 serving.
CONSTRUCTI-ON SEOUENCE FOR INSTALLING ROADWAY CULVERTS
1. Clear only enough area and install the downstfedfii measures
siic:h as silt check dams, silt screens, and silt basins as
noted on plan.
2. Excavate the 2' base tail ditch.
3. Excavate and install the roadway culvert.
4. Install sediment control measures at Inlet as h0ted on
plan.
5. Install additional pipe outlet protection and ltilet
protection as noted.

RIP RAP MATERIALS

1042-1 PLAIN RIP RAP.
Stone for plairl rip rap shall consist of fieldstone or •rough ullhewn quarry
stone. The stone shall be sound, tough, dense, resistant to the action of air
and water, and suitable in all other respects for the purpose intended.
Where broken concrete from denlolished structures or pavement is avail-
able, it may be used in place of stone provided that such use meets with the
approval of the Engineer. However, the use of broken concrete which
contains reinforcillg steel will not be permitted.
The stone or broken concrete shall be graded to meet the following
requirements:
1. For Class 1 Rij3 Rap. Stone shall vary in weight from 5 to 200 pounds.
At least 30 percent of the total weight, of the rip rap shall be in
individual pieces weighing a minimum of 60 pounds each. Not more
than 10 percellt of the total weight of the rip rap nay be in individual
pieces weighing less than 15 pounds each.
2. For Class 2 Rip Rap. Stone shall vary In weight from 25 to 250
pounds. At least 60 percent of the total weight of the rip rap shall be in
individual pieces weighing a minimum of 100 pounds each. Not more
than 5 percent of the total weight of the rip rap may be in individual
pieces weighing less than 50 pounds each.

HIGH QUALITY WATERS
1. Uncovered areas are limited at any given. time to a maximum total area
of 20 acres.
2. Erosion and sedimentation control measures shall be designed to provide
protection from the 25 year storm.
3. Large Type-A basins shall be designed and constructed with a settling
efficiency of at least 70% for the 40 micron soil particle size transported
by runoff from the 2 year stoma.
4. Newly constructed channels shall be constructed with side slopes no
steeper than 2:1, unless slopes are to be'stabilized by methods other than
vegetation.
5. A ground cover sufficient to restrain erosion must be provided for any
