Box 250 North Wilkesboro, NC 28659 Dear Mr. Bennett: ?EHNFi August 21, 1996 Ashe County DWQ Project # 960761 You have our approval to place fill material in 0.05 acres of wetlands or waters for the purpose of replacing pipes at SR 1325, as you described in your application dated 7 August 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3026. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Caps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Due to the proximity of a small stream being a trib. to Big Peak creek Class-C-trout-+ we are requesting a 404 Nationwide permit no. 3 to allow us to upgrade the 6 existing cross line drainage structures that will need replacing, and or extending. Maintenance Forces, regl.iest will promptly be made to the Division Roadside Environmental Unit for stage and permanent seeding. (5) Any removal of siltation devices will be based on the condition of established ground cover of that area the device 11 serving. SECTION 1042 HIP RAP MATERIALS 1042-1 PLAIN RIP RAP. Stone for plain rip rap shall consist of fieldstone or rough unhewn quarry stone. The stone shall be sound, tough, dense, resistant to the action of air and water, and suitable in all other respects for the purpose intended. Where broken concrete from demolished structures or pavement is avail- able, it may be used in place of stone provided that such use meets with the approval of the Engineer. However, the use of broken concrete which contains reinforcing steel will not be permitted. The stone or broken concrete shall be graded to meet the following requirements: 1. Foi• Class 1 Rip Rap. Stone shall vary in weight from 5 to 200 pounds. At least 30 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 60 pounds each. Not more than 10 percent of the total weight of the rip rap may be in individual pieces weighing less than 15 pounds each. 2. For Class 2 Rij) Rap. Stone shall vary in weight from 25 to 250 pounds. At least 60 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 100 pounds each. Not more than 5 percent of the total weight of the rip rap may be in individual pieces weighing less than 50 pounds each. 691 HIGH QUALITY WATERS 1. Uncovered areas are limited at any given time to a maximum total area of 20 acres. 2. Erosion and sedimentation control measures shall be designed to provide protection from the 25 year storm. 3. Large Type-A basins shall be designed and constructed with a settling efficiency of at least 701% for the 40 micron soil particle size transported by runoff from the 2 year storm. 4. Newly constructed channels shall be constructed with side slopes no steeper than 2:1, unless slopes are to be stabilized by methods other than vegetation. 5.
