Box 250 North Wilkesboro, NC 28659 Dear Mr. Bennett: v?EHNR July 17, 1996 Ashe County DWQ Project # 960659 You have our approval to place fill material in 0.02 acres of wetlands or waters for the purpose of installing culverts at SR 1143, as you described in your application dated 3 June 1996 (received 10 July 1996). After reviewing your application, we have decided that this till is covered by General Water Quality Certification Number 3026. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Due to the proximity of a small stream being a trib to Old Field creek WS IV-trout-+ we are requesting a 404 Nationwide permit no. 3 to allow us to upgrade the 2 existing cross line drainage structures that will need replacing, and or extending. MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY Pursuant to G.S. 113A-57(3), Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 working clays or 120 calendar days following completion of construction or development, whichever period is shorter, except as provided in 15A NCAC 4B .0024(e). DESIGN STANDARDS IN SENSITIVE WATERSHEDS Pi.trsitant to G.S. 113A-57(3) provisions for a ground cover sufficient to restrain erosion must be provided for any portion of a land-disturbing activity in a HQW zone within 15 working days or 60 calendar days following completion of construction or development, whichever period is shorter. (3) All siltation and erosion control devices shall be properly maintained until no longer needed. (4) On projects performed by D.O.T. Maintenance Forces, regtieat will promptly be made to the Division Roadside Environmental Unit for stage and permanent seeding. Stone fo'r plain rip rap shall consist of fieldstone or rough unhewn quarry stone. The stone shall be sound, tough, dense, resistant to the action of air and water, and suitable in all other respects for the purpose intended. Where broken concrete from demolished structures or pavement is avail- able, it may be used in place of stone provided that such use meets with the approval of the Engineer. However, the use of broken concrete which contains reinforcing steel Nvill not be permitted. The stone or broken concrete shall be graded to meet the following requirements: 1. For Class I Rip Rap. Stone shall vary in weight from 5 to 200 pounds. At least 30 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 60 pounds each. Not more than 10 percent of the total weight of the rip rap may be in individual pieces weighing less than 15 pounds each. 2. For Class 2 Rip Rap. Stone shall vary in weight from 25 to 250 pounds. At least 60 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 100 pounds each. Not more than 5 percent of the total weight of the rip rap may be in individual pieces weighing; less than 50 pounds each. 691 HIGH QUALITY WATERS 1. Uncovered areas are limited at any given time to a maximum total area of 20 acres. 2. Erosion and sedimentation control measures shall be designed to provide protection from the 25 year storm. 3. Large Type-A basins shall be designed and constructed with a settling efficiency of at least 70% for the 40 micron soil particle size transported by runoff from the 2 year storm. 4. Newly constructed channels shall be constructed with side slopes no steeper than 2:1, unless slopes are to be stabilized by methods other than vegetation. 5.
