The Corps of Engineers (COE) issued a Section 404 Nationwide Permit 23 (Categorical Exclusion) for the subject project on July 9, 1996. This permit expired on January 21, 1997. The replacement of Bridge No. 352 over Buffalo Creek on SR 1506 is not scheduled to be let to construction until December 1998. Consequently, the Department of Transportation (DOT) needs to renew authorization for this work. The DOT received authorization under Section 404 Nationwide Permit 6 and the corresponding 401 Water Quality Certification from the Division of Water Quality to perform foundation investigations for the new bridge. Information regarding the project description has not changed since the distribution of the Categorical Exclusion (CE) in a letter dated July 2, 1996. The bridge will be replaced on approximately the same alignment, along with the associated approaches. Traffic will be maintained on a temporary bridge along the southern side of the existing bridge throughout construction. Attached to this letter is comments from Mr. Joe Mickey of the N.C. Wildlife Resources Commission (WRC). Mr. Mickey provided comments on the project as part of another request for a Section 404 Nationwide Permit 23 for TIP No. B-2910. 0) a The DOT requests that the COE reauthorize this bridge replacement project in Ashe County under a Section 404 Nationwide Permit 23. The DOT also requests any additional comment from the WRC to the COE on the project. Issuance of 401 Water Quality Certification by the Division of Water Quality is also requested. No B-2910 2) Replacement of Bridge No. 352 on SR 1506 over Buffalo Creek at Warrensville (31 The North Carolina Department of Transportation (NCDOT) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 per.-nit fror:l the U.S. c?iuy Comps Of EnginCerS. The NC",',', i\v has, reviIewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Neither bridge replacement No. 346 or No. 352 will impact NCWRC Designated Public Mountain Trout Water. Both streams in the project vicinity support game fish populations of smallmouth bass and rock bass and numerous nongame fish species. Information on the Bridge No. 352 replacement was not included in the information packet. Therefore, we assume that this bridge is being replaced with a bridge on the same location. Based on the information provided by the applicant and our information on the range of trout in the project area, we do not believe these projects will cause significant effects to waters supporting trout. Therefore, we do not object to the Bridge No. 346 replacement over Big Horse. Creek as proposed, and have no objection to the Bridge No. 352 replacement over Buffalo Creek with another spanning structure. If Bridge No. 352 is to be replaced with a box culvert, we would like the opportunity to review plans in the event we might need to revise our no objection comment since plans were not included for our review. Raleigh, NC 27611-5201 Dear Mr. Vick: You have our approval to place fill material in wetlands or waters for the purpose of conducting foundation test borings at SR 1506 over Buffalo Creek, as you described in your application dated 11 June 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3027. This certification allows you to use Nationwide Permit Number 6 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
