Dear Mr. Everett:
You have our approval to place fill' material in 4,036 square feet of wetlands or waters for the
purpose of replacing a bridge at Bridge #4, SR 1300 over Cullie Creek, as you described in your
application dated 26 February 1996. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section

RECOMMENDED CONDITIONS OR PERMIT RESTRICTIONS: That the bridge be replaced with
another span bridge rather than four culverts. Aside from removing creek bottom uses in a PNA, the
culverts would tend to have a more restrictive effect on stream flow. Additionally, with the increased `
elevation proposed, creek navigability would be enhanced for use by small boats (i.e. canoes or kayaks).
It is recommended that the project be done in such a manner so as to not cause turbidity outside the

Dear Mr. Dorney:
Enclosed is the application of Aaron C. Everett, District Engineer with
the North Carolina Department of Transportation, for Department of the Army
authorization and a State Water Quality Certification to place fill material
in approximately 4,000 square feet of wetlands and open water, and dredge
800 square feet of wetlands in and adjacent to Cullie Creek, for the purpose
of replacing Bridge No. 4, and raising the existing road elevation of SR 1300,
near Merrimon, in Carteret County, North Carolina. Your receipt of this
letter verifies your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by April 26, 1996, the District Engineer will deem that
waiver has occurred.

Town of Merrimon with four 128" X 83" X 60' corrugated steel pipe arches and to raise the existing
road elevation.

9. NARRATIVE DESCRIPTION:
Project Setting
The project is located on SR 1300, near Merrimon, on Cullie Creek in Carteret
County. Cullie Creek is a tributary of Adam's Creek. A 50'-long existing bridge
spans the 35' to 40' wide creek. Vertical clearance under the existing bridge is
approximately 2.5' to 3'. An extensive marsh system vegetated with black needlerush
Juncus roemerianus, sawgrass Cladium jamaicense and cattails Typha spp. border both
sides of the creek. Cullie Creek is classified SA NSW and is open to shellfishing.
The area is also a designated Primary Nursery Area.
A CAMA Major Permit (#249-89) had been issued for the same project in 1989
but the project was never undertaken and the permit expired in 1992. Since the
issuance of the original permit, conditions at the site have not changed.
Project Description
The applicant proposes to replace an existing bridge with four 128" X 83" X 60'
corrugated steel pipe arches and to raise the elevation of the adjacent road
approximately 1'. The project includes removing the old bridge and "prepping" an
area 63' X 70' (the site of the existing bridge) for installation of the four culverts. The
area will be excavated to approximately -6 below MHW, the pipe arches installed, and
the area backfilled. The applicant also proposes to raise the road elevation which will
widen the road bed by approximately 2' on end side.
Anticipated Impacts
The project as proposed would involve the following AECs: Coastal Wetlands,
Estuarine Waters, Public Trust Areas and the Estuarine Shoreline. Excavation and
filling activities within the 63' X 70' area where the culverts are to be placed directly
removes approximately 786 ft2 of Coastal Wetlands and approximately 3,250 ft2 of
open water habitat and creek bottom (Public Trust). According to the applicant,
approximately 800 ft' of additional Coastal Wetlands would also be excavated to
facilitate water flow through the culverts. Approximately 1,560 ft2 of high ground
would be disturbed for culvert installation and another 27,000 ft' for the raising of the
road. Excavation and filling activities would probably result in an increase short-term
and localized turbidity levels. The applicant proposes to implement Best Management
Practices (i.e. silt fences and check dams) to minimize any adverse effects which may
be caused by project related sedimentation.
