Box 250 North Wilkesboro, N.C. 28659 Dear Mr. Bennett: 3-r 4 © o F-U !J February 27, 1995 Wilkes County DEM Project # 95190 a I You have our approval to place fill material in 0.20 acres of wetlands or waters for the purpose of bank stabilization and pipe replacement on three independent sites along Stone Mountain State Park road formerly known as SR 1739, as you described in your application dated 21 February 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2745 and 2665. These certifications allow you to use Nationwide Permit Numbers 3 and 13 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. The N. C. Department of Environment, Health and Natural Resources Division of Parks and Recreation, through Mr. Allen Jeffreys, has requested the Department of Transportation to perform improvements to the existing road that runs through Stone Mtn. State Park. These request involve (3) three independent sites. Site 1 and 3 will require bank stabilization, and sites 1,2, and 3 will require pipe replacements. These request were made to eliminate the frequent flooding and erosion of said road. The Departmnt of Transportation is proposing to raise the grade, drain, and base, primarily along the existing roadway at sites 1, and 3. Site 2 will be a complete relocation moving entirely away from stream. Due to the proximity of a said stream we are requesting a 404 Nationwide permit no. 3 to allow us to upgrade the 3 existing cross line drainage structures that will need replacing, and or extending, and a 404 Nationwide permit no. 14 for bank stabilization along. stream bank.at sites 1, and 3. Attached is a straight line sketch with proposed erosion control, stream, stream embankment, pipe crossing, and marked county map. By copy of this letter.I am asking Ms. Stephanie Goudreau Mt. Region Coordinator with the North Carolina Wildlife Resources Commission to comment directly to you concerning the 404 Nationwide Permit request. A request will be made on this project for a Temporary Encroachment in the Trout Water Buffer Zone of East Prong of Roaring River and I am asking Ms Goudreau to comment directly to me concerning the Trout water buffer zone encroachment. Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. Clear only enough area and install the downstream measures siich as silt check dams, silt screens, and silt basins as noted on plan. 2. Excavate the 2' base tall ditch. 3. Excavate and install the roadway culvert. 4. Install sediment control measures at 'Inlet as noted on plan. 5. Tristall add.itionn.l pipe outlet protection and inlet protection as noted. EROSION CONTROL SCNEDULF (1) All adequate temporary erosion control measures will be installed before clearing and grubbing operations begin. (2) As construction progresses temporary and permanent erosion control devices shall be installed in a timely manner, according to any special permit requirements and /or requirements set out in G.G. 113A-57. MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY P»rGuant to G.S. 113A-57(3), Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days following completion of construction or development, whichever period is shorter, except as provided in 15A NCAC 4B .0024(e). DESIGN STANDARDS IN SENSITIVE WATERSHEDS Pmrsnant to G.S. 113A-57(3) provisions for a ground rover sufficient to restrain erosion must be provided for any portion of A land-disturbing activity in a HQW zone within 15 working days or 60 calendar days following completion of construction or development, whichever period is shorter. (3) All siltation and erosion control devices shall be properly maintained until no longer needed. (4) On projects performed by D.O.T. Maintenance Forces, request will promptly be made to the Division Roadside Environmental Unit for stage and permanent seeding. (5) Any removal of siltation devices will be based on they condition of established ground cover of that area the device iR serving. SECTION 1042 HIP RAP MATERIALS 1012-1 PLAIN RIP RAP. Stone for plain ri1) rap shall consistof field stotie or rough unllewn quarry stone. The stone shall he sound, tough, dense, resistant to the action of air and water, and suitable in all other respects for the purpose intended. Where broken concrete from demolished structures or pavement is avail- able, it may be used in place of stone provided that such use meets with the approval of the Engineer. However, the use of broken concrete which contains reinforcing steel will not be permitted. The stone or broken concrete shall be graded to meet the following requirements: 1. For Class 1 Rip Rap. Stone shall vary in weight from 5 to 200 pounds. At least 30 percent of the total weight of the rip rap shall be in individual pieces weighing a mininium of 60 pounds each. Not more than 10 percent of the total weight of the rip rap may be in individual pieces weighing less than 15 pounds each. 2. For Class 2 Rip Rap. Stone shall vary in weight from 25 to 250 pounds. At least 60 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 100 pounds each.
