After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2735. This certification allows you to use General Permit Number 031 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. SECRETARY RECEIVED OCT 3 01995 ENVIRONMENTAL SCIENCES Please find enclosed herewith erosion control plans, an application form for a Nationwide Permit, and a county map section locating SR 1164, Owl Hollow Road, in Polk County. SR 1164 is a gravel road that we propose to clear, grub, grade, pave, and replace/extend pipes for a distance of 1.62 miles. Grading will be light to moderate. We are requesting permission to replace and extend pipes in live streams noted on plans at survey stations 12+70 and 31+25. Pipes will be replaced using our standard method of pipe installation described in the erosion control plans. NCDOT "Best Management Practices for Protection of Surface Waters" and proper phasing of erosion control items will be used to minimize and control sedimentation and erosion. Due to the proximity of an outbuilding and driveway located left of survey stations 32+00 - 34+50, we are requesting permission to relocate the channel of a small stream alongside survey station 31+25 - 34+50 RT. This relocation is necessary to upgrade SR 1164 to minimum NCDOT standards. A straight line type plan diagram and cross- sections representing proposed and existing conditions of the channel change area are enclosed. The proposed channel is a three (3) foot trapezoidal channel with 1.5:1 side slopes, lined with NCDOT Class B Erosion Control Stone to a minimum height of 1.5 feet. The existing stream gradient of 6.0% will remain the same in the proposed channel. Please note that this unnamed tributary to Walnut Creek is not classified as a DEM Trout Water. 0 Mr. Steve Lund Page 2 October 18, 1995 By copy of this letter, we are asking Mr. David Yow, N.C. It is made of permeable filter fabric buried at the bottom, stretched and supported by steel posts. The silt fence reduces the water flow- while retaining the sediment. They may also be used to divert water flow to protected . outlets. Silt fences need to be checked after each significant rainfall to ensure there effectiveness. They must be maintained on a regular basis. Silt fences shall not be installed across streams, ditches, or waterways. AREAS OF USE: • At toe of fill sections where sediment runoff can be stored and contained . inside the'project limits. DESIGN CRITERIA: Material With Wire Without Wire Fabric Type 3 Class A Type 3 Class B• Steel posts length 5 ft 5 ft. Post spacing 10 ft. 6 ft. maximum 17 March, 1992 SILT BASIN TYPE-B: E A silt basin type-B is a temporary basin built to collect sediment flowing through a drainage way. The silt basin is built at the base of the ditch with its Iength being at least 2 times the width of the basin- The type-$ silt basin is generally built in conjunction with temporarycrock silt checks and other devices that control or slow down water flow. This device must be monitored closely and cleaned out on a regular basis until grass is established along the ditch line and sedimentation is no longer a problem. AREAS OF USE: • In conjunction with temporary rock-silt checks and other devices used in drainage ditches. Stone for plain rip rap shall consist of field stone or rough unhewn quarry stone. The stone shall be sound, tough, dense, resistant to the action of air and water, and suitable in all other respects for the purpose intended. Where broken concrete from demolished structures or pavement is available; it may be used in place of stone provided that such use meets with the approval of the Engineer. However, the use of broken concrete which contains reinforcing steel will not be permitted. All stone shall meet the approval to the Engineer. While no specific gradation is required, the various sizes of the' stone shall be equally distributed within the required size range. The size of an individual stone particle will be determined by measuring its long dimension.
