Box 5189 Horseshoe, N.C. 28742 FILE Pury Dear Mr. Swain: You have our approval to place fill material in 0.01 acres of wetlands or waters for the purpose of replacing and extend pipe along SR 1138, Lake Adger Road, as you described in your application dated 14 July 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2735. This certification allows you to use General Permit Number 031 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Box 5189 RECEIVED Horse Shoe, NC 28742 July 14, 1995 JUL 2 5 1995 ENVIRONMENTAL SCIENCES BRANCH Subject: SR 1138, Lake Adger Road Grading and Paving Dear Mr. Lund: I am attaching a straight line diagram with erosion control plans, an application form for a Nationwide Permit, and a county map section locating SR 1138, Lake Adger Road in Polk County. SR 1138 is a gravel road that we propose to clear, grub, pave, and replace/extend pipes for a distance of 1.35 miles. Grading will be moderate. We are requesting permission to replace and extend pipes in live streams noted on plans at survey stations 13+80 and 50+70. Pipes will be replaced using our standard method of pipe installation described in the erosion control details - Appendix A of the erosion control plans. NCDOT Best Management Practices and proper phasing of erosion control items will be used to minimize and control sedimentation and erosion. Please note that pipe crossings at live streams are perpendicular to our roadway. By copy of this letter, we are asking Mr. David Yow, N.C. Wildlife Resources Commission, to comment directly to the Corps of Engineers concerning the Nationwide Permit request. Upon review for the Corps of Engineers, we are requesting that Mr. Yow forward a copy to us (NCDOT) as well. By copy of this letter, we are also asking Mr. Ed Ingle, Area Roadside Environmental Engineer (NCDOT), to comment directly to us on the above project. w? L: /,I L 2 7Y z5 /a? - - covv0 12 March, 1992 ERC ..r r PIPE INSTALLATION All pipe installed on the project will be installed using the standard method of pipe installation - Method "A", Standard No. 300.01B of the NCDOT - "Roadway Standard Drawings". All pipes shall be laid in accordance with section 300 of the North Carolina Department of Transportation "Standard Specifications for Roads and Structures", January 1, 1990. Pipes will be installed in the dry wherever possible. Pipes laid in streams large enough to support trout will be installed six (6) inches below the stream bed to allow the bottom of the pipe to silt over so that trout movement will be over a natural stream bed. The silt basin is built at the base of the ditch with its length being at least 2 times the width of the basin. The type-B silt basin is generally built in conjunction with temporaryrock silt checks and other devices that control or slow down water flow. This device must be monitored closely and cleaned out on a ' regular basis until grass is established along the ditch line and sedimentation is no longer -a problem. The stone shall be of a hard, durable nature and shall range in size as follows: Class Size A 211 - 6f. $ 5° - 15" All stone shall meet the approval of the Engineer. While no specific gradation is required, the various sizes of stone shall be equally distributed within the required size range. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions, those conditions outlined in the August 25, 1995 WRC letter (which you have already received), and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). You should contact Mr. John Dorney, telephone (919) 733-1786, regarding the above mentioned water quality certification. This nationwide permit does not relieve you of the responsibility to obtain other required state or local approval. This verification will be valid until the nationwide permit is modified, reissued or revoked. All the nationwide permits are scheduled to be modified, reissued or revoked prior to 21 January 1997. It is incumbent upon you to remain informed of changes to the nationwide permits. We will issue a public notice announcing the changes when they occur. Furthermore, if you commence or are under contract to commence this activity before the date the nationwide permit is modified or revoked, you will have twelve months from the date of the modification or revocation to complete the activity under the present terms and conditions of this nationwide permit.
