Moore District Engineer NC DOT Route 1, Box 169-C Marion, N.C. 28752 FILE cop y Dear Mr. Moore: You have our approval to place fill material in 0.05 acres of wetlands or waters for the purpose of road maintenance at SR 1739 (Owl Hollow Road), as you described in your application dated 22 June 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2745. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any-of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. C. 28801 Subject: SR 1739 - Owl Hollow Road 1994-1995 Rural Paving Project Application for Nationwide Permit Dear Mr. Chapin: 401 ISSUED I am attaching a straight line diagram with erosion control plan, an application form for a nationwide permit, and a county map section relative to the paving of SR 1739 Owl Hollow Road in McDowell County. Owl Hollow Road is presently 14 to 16 feet wide. We plan to pave the road 18 feet wide and increase the typical section. The proposed typical section is also attached. Grading will be light to moderate. The project begins at SR 1737 and continues in a northerly direction for 0.9 miles. We propose to replace/extend two (2) pipes with a live stream at survey stations 29 + 95 and 46 + 80. We also propose a channel change on the left from survey station 46 + 80 to survey station 49 + 24. By a copy of this letter, we are asking Stephanie Goudreau, North Carolina Wildlife Resources Commission Mountain Region Coordinator, to comment directly to you concerning the nationwide permit request. Moore State of North Carolina Department of Transportation Route 1, Box 169C Marion, North Carolina 28752 Dear Mr. Moore: Referenci§ your June 22, 1995 application for Department of the Army (DA) authorization to replace/extend 2 culverts and relocate a 244 linear foot section of an unnamed tributary to Muddy Creek in conjunction with the pav' g and widening of S.R. 1739 (Owl Hollow Road), near Marion, in McDowell County, North Carolina. The project begins at S.R. 1737 and continues a 0. northerly direction for 0.9 miles. As a result of the work, approximat ?Te acre of headwater wetlands and stream channel will be impacted. This phas been coordinated with the NC Wildlife Resources Commission (WRC). For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6. published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid until the nationwide permit is modified, reissued or revoked. All the nationwide permits are scheduled to be modified, reissued or revoked prior to 21 January 1997. It is incumbent upon you to remain informed of changes to the nationwide permits. We will issue a public notice announcing the changes when they occur. Furthermore, if you commence or are under contract to commence this activity before the date the nationwide permit is modified or revoked, you will have twelve months from the.date of the modification or revocation to complete the activity under the present terms and conditions of this nationwide permit.
