SAMUEL HUNT III SECRETARY MAY 17 199j N1tTL Graphite Road Rural Paving Priority Permit I am attaching a straight line diagram with erosion control plan, an application form for a nationwide permit, and a county map section relative to the paving of SR 1408 Graphite Road in McDowell County. Graphite Road is presently 12 to 14 feet wide. We plan to pave the road 18 feet wide and increase the typical section. The proposed typical section is also attached. Grading will be moderate to heavy with removal of rock. This project begins at SR 1407 and continues in a northerly direction for 0.73 miles. We propose to replace/extend one pipe which carries a live stream at survey station 7 + 90. By a copy of this letter, we are asking Stephanie Goudreau, North Carolina Wildlife Resources Commission Mountain Region Coordinator, to comment directly to you concerning the nationwide permit request. Graphite Road is presently 12 to 14 feet wide. We plan to pave the road 18 feet wide and increase the typical section. The proposed typical section is also attached. Grading will be moderate to heavy with removal of rock. This project begins at SR 1407 and continues in a northerly direction for 0.73 miles. We propose to replace/extend one pipe which carries a live stream at survey station 7 + 90. By a copy of this letter, we are asking Stephanie Goudreau, Korth Carolina Wildlife Resources Commission Mountain Region Coordinator, to comment directly to you concerning the nationwide permit request. Moore State of North Carolina Department of Transportation Route 1, Box 169C Marion, North Carolina 28752 Dear Mr. Moore: Reference your May 11, 1995 application for Department of the Army (DA) authorization to replace/extend a culvert in an unnamed tributary to Mill Creek in conjunction with the paving and widening of S.R. 1408 (Graphite Road), near,,pld F in McDowell County, North Carolina. Graphite Road is presently 1/l t 14 et wide. You plan to pave the road 18 feet wide and increase e ypica section from S.R. 1407 northerly for 0.73 miles. As mention: a ve, o culvert will be replaced/extended at survey station 7+90. Less tha ?ne-tenth of an acre of headwater stream channel and wetlands will be impa ted by the construction. This project has been coordinated with the NC Wildl'/fe Resources Commission (WRC). For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and those conditions outlined in the May 30, 1995 WRC comment letter (which you have already received). This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for two years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. Also, this verification will remain valid for the two years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the two years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced or are under contract to commence, in reliance upon the nationwide permit, will remain authorized. This is provided the activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation.
