Department of Transportation resulting in 0.31 acres of wetland impact in McDowell County pursuant to an application filed on the 20th day of January of 1995 to improve US 221/NC 226 between SR 1501 and SR 1434. The Application provides adequate assurance that the discharge of fill material into the waters of Tom's Creek in conjunction with the proposed development in McDowell County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92- 500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (50 NTUs in streams and rivers not designated as trout waters by DEM; 25 NTUs in all saltwater classes, and all lakes and reservoirs; 10 NTUs in trout waters). 2. DOT shall use DOT Stream Relocation Guidelines for all stream relocation work for this project. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such demands are made, this Certification shall be final and binding. This the 17th day of March, 1995. Modified permits for this activity were issued on May 15, 1995 by the Corps of Engineers and March 17, 1995 by the N.C. Division of Environmental Management. The N.C. Wildlife Resources Commission commented favorably on the project by letter dated March 1, 1995. Unfortunately, a problem has arisen at the project site which needs to be corrected. The driveway of an adjacent property owner was partially washed out during a heavy rainfall earlier this year. The driveway was repaired by NCDOT with rip rap. Shortly thereafter, another storm washed the driveway out again. The washed out rip rap and sand has accumulated downstream creating a large island and blocking a portion of Tom's Creek. The NCDOT is proposing to excavate this sand and rip rap material from Tom's Creek and restore the creek to its natural condition. It is estimated that this will require excavating 65 cubic yards of material. 14 OSt??4? The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the U.S. Army Corps of Engineers. Plans submitted with the application indicate the existing road will be widened to 64-foot-wide with four traffic lanes and one turning lane. The roadway will be bordered by curb and gutter and 8-foot-wide berms throughout the project length. Tom's Creek and an unnamed tributary will be impacted by the project. A new channel approximately 1,260 feet long and 15 to 30 feet wide will be excavated adjacent to the old channel which is approximately 1320 feet long and 10 to 15 feet wide. Approximately 107 cubic yards of fill will be placed below ordinary high water in the old channel while a total of 1443 cubic yards of fill will be placed for the entire project. Approximately 0.31 acres of wetlands dominated by tag alder will be filled by the project. Plans showing the work are included with this public notice. This project is covered under the Final Environmental Impact Statement (FEIS) for Project R-204, signed by the Federal Highway Administration in 1979. This FEIS addressed impacts for the entire Marion Bypass project, most of which has already been completed. This application refers to the remaining 2.0 mile long section at the north end of the by-pass project. Material for stabilization and maintenance of roads on the applicant's upland property. Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. The North Carolina Wildlife Resources Commission (NCWRC) has reviewed revised plans by the North Carolina Department of Transportation (NCDOT) to reduce the length of Toms Creek to be relocated in conjunction with the widening of US 221-NC 226 from SR 1501 to SR 1434. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d.). The NCDOT has reexamined the design of this project and has eliminated most of the previously proposed channel change on Toms Creek. This was achieved by reducing the roadway shoulder, steepening the roadway fill slopes, and armoring with riprap from station 100+00 to 106+50. An 8-foot berm will be maintained between the existing channel bank and the toe of the proposed roadway fill. A channel change will still be required from station 100+00 to 100+50 and from station 102+50 to 103+50 for a total of 150 feet of relocation. Original plans called for 1260 feet of relocation. We are pleased that the NCDOT was able to design a less damaging alternative. The following recommendations should be implemented by the NCDOT to further minimize adverse impacts to fisheries and wildlife resources: 1) Dimensions of the new channel should match the old channel. j 199201260 Page 2 March 1, 1995 2) Riprap should only be placed from the edge of the stream bank bottom to 2.5 feet up the stream bank. 3) Native tree species should be planted along the new channel sections. Species such as tag alder, dogwood, and black willow will be planted along the east bank while larger species such as river birch, black cherry, black walnut, and sycamore will be planted along the west bank. 4) The survival rate of newly planted should be monitored by the NCDOT during August-September of each growing season until success criteria (50 percent survival for at least 3 years) have been met. This permit was based on a design which required approximately 1260 feet of stream channel relocation, 156 cubic yards of fill below ordinary high water, and fill in 0.31 acres of wetlands. Since this permit was issued, the North Carolina Department of Transportation (NCDOT) has reexamined the design of this project, and has determined that a less damaging alternative is preferable to the purpose of the project. The proposed construction revision will eliminate most of the previously proposed channel change. This will be done by reducing the roadway shoulder from 8 feet to 4 feet and steepening the roadway fill slopes from 2:1 to 1-1/2:1 with rip rap armoring from survey station 100+00-L-LT. to station 106+50-L-LT. A minimum 8 foot berm will be maintained between the existing channel bank and the toe of the proposed roadway fill. A channel change will still be required from station 100+00- L-LT. to station 100+50-L-LT. and from station 102+50-L-LT. to station 103+50-L-LT, a total of 150 feet of relocation. This modification will reduce wetland fill from 0.31 to 0.19 acres, and fill below ordinary high water from 156 to 47 cubic yards. 3-?; It is anticipated that all of the Special Conditions on the permit are still applicable except No. 12. This condition specifies that rootwads are to be used to enhance the relocated stream. Due to the reduced extent of stream relocation, the NCDOT does not believe that this condition is appropriate. Installation of the root wads will also require disturbance to the west bank of the creek which would otherwise not be required under the proposed revisions. The reforestation plan specified in Condition 10 is still included in the project plans. Enclosed you will find revised drawings which depict the proposed design.
