C. 28713 Dear Mr. Styles: FILE CORE You have our approval to place fill material in 0.02 acres of wetlands or waters for the purpose of widening and paving SR 1199 (Carl Arrington Road), as you described in your application dated 2 August 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If ,you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Field Office Room 75, Grove Park Ave. Asheville, NC 28801-2714 Dear Mr. Johnson, DIVISION OF HIGHWAYS Bryson City, NC 28713 August 2, 1995 q5M The North Carolina Department of Transportation is proposing to grade, drain, base and pave primarily along the existing roadway of SR 1199, Carl Arrington Road in Haywood County. In order to construct this project in accordance with our current secondary road standards, three pipe culverts along two tributaries of Richland Creek (DEM Class B), will have to be replaced. We are requesting authorization under Section 404 of the Clean Water Act to replace these culverts. I am sending a straight line diagram with our proposed erosion control construction limits at various sites along the project. In addition a typical section of the road, cross sections, drawings for the pipe culvert replacements, general notes and standards on erosion control measures, and a marked county map. The best management practices will be used to minimize and control sedimentation and erosion on this project. The construction foreman will review all erosion control measures daily to ensure sedimentation and erosion are being effectively controlled. If the planned devices are not functioning as intended, they will immediately be replaced with better devices. The rock silt screen will be in place prior to pipe construction and will remain in place until the project is stabilized. By copy of this letter I am asking Mr. David Yow, North Carolina Resources Commission, District Fisheries Biologist to comment directly to you concerning the 404 Nationwide permit request. rqa? Mr. Bob Johnson Page 2 August 2, 1995 A request is being made on this project for a temporary encroachment in two (2) small tributaries of Richland Creek. Site one (1) is a 72" cross pipe which needs to be extended on the inlet end. Sites two (2) and three (3) are non-standard pipes which run parallel to the road and need to be replaced with 24" crop. Sites two (2) and three (3) are in the same tributary. In addition, I am asking Mr. Yow and Mr. Ed Ingle, Area Roadside Environmental Engineer (NC DOT) to comment directly to me concerning the encroachment permits requested for these tributaries. Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from Division of Environmental Management. Certain nationwide permits require notification to the Corps of Engineers before work can proceed. They are as follows: NWP 5 (only for discharges of 10 to 25 cubic yards) NWP 7 NWP 13 (only for stabilization activities in excess of 500 feet in length or greater-than an average of one cubic yard per running foot) NWP 14 (only for fills in special aquatic sites; including wetlands, aquatic sites) and.must include a delineation of affected special t NWP 17 NWP 18 (required when discharge exceeds 10 cubic yards or the. discharge is in a special aquatic site and must include a delineation of the affected special aquatic site, including wetlands) N NWP WP 21 (mug include a delineation of affected special aquatic sites, including wetlands) includin? g(wetlanfor greater ds than I acre total itrtpaats'and must include a delineation of affected special aquatic sites, NWP 33 (must include a restoration plan of reasonable measures to avoid and minimize impacts to aquatic resources) NWP 37 NWP 38 (must include a delineation of affected special aquatic sites, including wetlands) For activities that may be authorized by 't6 above listed nationwide permits that require notification, the applicant shall not begin work a. Until notified that the work may proceed under the nationwide permit with any special conditions imposed by. the District Engineer. or b. If notified that an individual permit may be required, or c. Unless 30 days (calendar) have passed from the time a complete notification is received by the District Engineer and no notice has been received from the District Engineer, and required state approvals have been obtained. Required state approvals include: 1) a Section 401 water quality certification if authorization is requested for a discharge of dredged or fill material. and 2) an approved coastal zone management consistency determination if the activity will affect the coastal area. Use of NWP 12 also requires notification to the District Engineer, but work may not begin until written concurrence is received from the District Engineer. The time periods described above do not apply. Furthermore, requirements to notify the U.S. I~ish and Wildlife Service (USFWS), the National Marine Fisheries Service (NMFS), and the State Historic Preservation office (SHPO), as indicated below and on the notification form, do not apply. B. APPLICATION TO DEM FOR NATIONWIDE PERMIT SECTION 401 CERTI'F'ICATION. Certain nationwide permits require an appLcatim to DEM in order to obtain Section 401 water quality certification. They are NWP 6. NWP 12, NWP 15, NO 16, NWP 17, NW 21. NWP 33, NWP 34, NWP 38, and NWP 40. Certain nationwide permits were issued general certifu?tioas and require no a licadon. The are NWP 3, NWP 4 NWP 5. NWP 7, NWP 20, NWP 22, NWP 23 (regains notification to D qq ' and NWP 37. > 25, NWP 27, NWP 32, NWP 36, The following nationwide permits were issued general certifications for only limited activities: NWP 13 (for projects less than 500 feet in length), NWP 14 (for protects that Impact waters only), NWP 18 (for projects with less than 10 cubic yards of fill in waters only), and NWP 26 (for projects with less than or equal to one-third acre fill of waters or wetlands). 'C ? -- OR .. C ?? 12 March. 1992 TEMPORARY SILT FENCE: A temporary silt fence is commonly used at the toe of a fill section to prevent off- site sedimentation. It is made of permeable filter fabric buried at the bottom, stretched and supported by steel posts. The silt fence reduces the water flow while retaining the sediment. They may also be used to divert water flow to protected outlets. Silt fences need to be checked after each significant rainfall to ensure there effectiveness. They must be maintained on a regular basis. -Silt fences shall = be installed across streams, ditches, or waterways. These type-B rock silt checks help reduce the flow velocity and are generally made of class-B stone. They are used in ditches during construction where the grade meets and/or exceeds 3%. ALAS OF USE: • In channels, roadside ditch outlets, temporary silt ditches, and temporary diversions. • In conjunction with type-B silt basins. Rock silt screens shall be used to trap sediment transported by running water and shall be placed in the stream below the construction site within the right-of- way or easement boundary. The rock silt screen utilizes ,class B stone lined with #5 or #57 stone to produce a ripple-effect in the stream to settle the larger sediment particles transported in the stream from the construction site. The trapped sediment shall be cleaned out before the device is removed from the stream. AREAS OF USE: • In live streams below construction sites where construction occurs in or adjacent to the stream. ` • In live streams below a culvert construction site. • Where it can be cleaned before it is removed from stream.
