C. Department of Transportation resulting in 15.74 acres of wetland impact in Cumberland County pursuant to an application filed on the 27th day of October, of 1994 to seek after-the-fact approval of fill to complete the CBD Loop in Fayetteville. The Application provides adequate assurance that the discharge of fill material into the waters of Cape Fear River in conjunction with the proposed development in Cumberland County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (50 NTUs in streams and rivers not designated as trout waters by DEM; 25 NTUs in all saltwater classes, and all lakes and reservoirs; 10 NTUs in trout waters). 2. A stormwater pond shall be constructed by DOT to handle local runoff as described. in the 11 May 1995 letter. Compensatory mitigation for this project shall be done at the Bull Farm mitigation site. DEM shall be copied on all as-built and monitoring reports. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon .?.r expiration of the 404 or CAMA permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. N.C. DIVISION OF ENVIRONMENTAL MANAGEMENT March 14, 1996 The N.C. Department of Transportation (DOT) applied for an individual permit to fill 14.44 acres of (mostly) bottomland hardwood forest wetlands on 6 July 1992. Mitigation was proposed on a 2:1 acre basis. The Division of Environmental Management (DEM) issued the 401 Certification on 30 July 1992. DEM turnaround was rapid due to preapplication meetings with DOT and DEM staff. A revised Certification was issued on 10 December 1992 after the Corps of Engineers (COE) and DOT revised the wetland acreage to be affected. On 28 October 1994, DOT applied for an after-the-fact permit to retain fill in an additional 15.74 acres of wetlands in the adjacent segment of the CBD Loop. These wetlands had been filled without a permit. DEM performed a site visit on 22 November 1994 with DOT. DEM had three major concerns about the project which were transmitted-to DOT on 29 November 1994. The first concern involved the significant uses that the wetlands had been performing. Stormwater pollutants from an existing junk yard was being filtered by the wetlands that DOT had filled. The surface water from the junk yard and other development had been directed to a rip rapped ditch and then into a large canal. DEM requested that stormwater be routed into an adjacent area to replace some of the functions that the wetland had been performing. The second DEM concern was secondary development from an access road. This road was constructed to provide access to the junk yard and other wetland properties. DEM believed that purchase of these properties could have provided partial mitigation for the unavoidable wetland fill. On-site restoration of the Wilkes Road site was the third issue of concern. DEM requested that DOT commit to replanting the site after the fill is removed and well as engineering a ditch to prevent the draining of adjacent wetlands. DOT responded to our concerns on 3 February 1995 (received 14 February 1995)• Since DOT had completed construction, they considered diverting stormwater into the area impracticable. DOT considered the secondary wetland impacts to be subject to the 404 permitting process independent of the road. DOT stated that a feasibility study had determined the purchase of the properties served by the access road to cost approximately $200,000 more than constructing the road. DOT agreed to perform all the requests at the Wilkes Road site. Since all of the concerns had not been adequately addressed, DEM requested a meeting with DOT. A meeting between DEM and DOT was held on 17 March 1995. DEM presented DOT with two options regarding the stormwater issue. DEM also stated that the lateral ditches would be draining adjacent wetlands and therefore DOT needed to quantify these additional impacts. These concerns were sent to DOT in writing on 17 March 1995. DOT agreed to design a stormwater pond in as letter dated 15 May 1995. A final proposal for compensatory wetland mitigation was received on 26 May 1995. Since all of our concerns had been addressed, a 401 Certification was issued on 30 May 1995 which included conditions for mitigation and a stormwater pond to protect downstream water quality. cbd.his :F N.. As you are aware, there has been a great deal of coordination for this permit modification. Most recently, the N.C. Division of Environmental Management has requested additional information concerning on-site mitigation opportunities. NCDOT personnel investigated the vicinity of the project for potential mitigation areas. In general, the area of this project contains development or existing forest. North and east of the interchange, the area has been developed by several businesses. In the southeast quadrant, wetlands have been eliminated to the canal bank. On the opposite bank, any wetlands which may have existed were filled by commercial development. The southwest quadrant is the only area near the interchange which is not predominately developed. This quadrant contains the proposed service road and the existing junkyard. The remainder of this quadrant consists of mature wetland and upland forest. This canopy extends south about 1,200 feet and west slightly more. An investigation of this area revealed that most of this forest appears to be wetland. Consequently, any mitigation in this area would consist of preservation. l Based on this investigation, the NCDOT decided that there were no reasonable and feasible on-site mitigation opportunities for this section of the project. Consequently, the NCDOT has proposed using the Bull Farm Mitigation Site for this project. The mitigation plan for this site has already been submitted for review. A site visit was made on April 27, 1995 by representatives of the NCDOT and the N.C. Division of Environmental Management (DEM). During this site visit, NCDOT biologists examined the areas adjacent to the service road and junkyard. They observed that these areas are predominately jurisdictional wetlands with intact vegetative communities and mature canopy trees. Based on this finding, it is apparent that shifting alignment of the service road would not minimize wetland impacts. In fact, wetland impacts would increase since more wetland forest would be cleared for a new alignment. 9 t .. :W, The mitigation potential for adjacent areas was also considered. Most of the surrounding area consists of intact wetland systems. Consequently, on-site mitigation would be primarily limited to preservation. In general, this type of mitigation has only been viable as part of a larger plan which included wetland restoration, creation or enhancement. It is the NCDOT's position that on-site mitigation options are not available. The NCDOT has been coordinating with the DEM to design a stormwater retention pond near the interchange. This pond should help to address the DEM's water quality concerns. A final copy of this pond design will be forwarded to your agency when it is approved by the DEM. It is the NCDOT's position that the project as proposed represents the least- damaging, most practicable alternative for this project. He said that according to DOT, the stormwater pond is in a wetland area. I believe that this location is a wetland. Scot said that the 6000 square ft. pond is adequately sized and will protect water quality. Scot also informed me that DOT should vegetate the swale that is downstream of the stormwater pond and drains into the canal. DOT is aware of Scot's requirement. They did not object. The pond is not located in the most favorable location. I attempted to have DOT install the pond on the other side of the road, near the canal. This location is not a wetland according to Hal Bain. However, I do believe that the pond will protect water quality and therefore recommend that we issue the 401 Certification with the following conditions: A) A 6000 square foot wet detention pond will be installed adjacent to Ramp D and the 24 inch RCP drainage structure. A fence will be installed around the entire basin with a gate. B) The ditch at the outlet of the 24 inch RCP will be vegetated with cattails or aquatic plant species. Dear Sir: The North Carolina Department of Transportation (NCDOT) applied on October 19, 1994 for after-the-fact Department of the Army authorization to place fill in wetlands to allow completion of the CBD Loop in Fayetteville. Since that date, the NCOT has received comments on this request from the N.C. Division of Environmental XIanagement (?v'CDENf) and the N.C. Wildlife Resources Commission (NCWRC), both letters dated November 29, 1994. These comments were discussed briefly at the January 1995 interagency permit review meeting. This letter is intended as a formal response to the comments. Both agencies commented on the proposed work at Wilkes Road. In response, the NCDOT is willing to commit to grading the site to natural grade, and to replanting the area once grading is complete. The wetland area at this site consisted of a medium aged stand of mixed stand of pine and hardwoods. Consequently, the NCDOT will plant a seedling mixture of loblolly pine (emus !Leda), sweetgum Uuidambar s aciflua), tulip poplar (Liriodendron tulipifera), black gum (N 1sa sylyatica), and red maple (Acer rabrum) at the site. This planting will be done by state forces after the CBD project is complete. The NCDOT has also engineered the lateral roadway ditch to ensure that it will not drain adjacent wetlands, in accordance with the request of NCDEK ?a Bc y.b-u?ies also commented on the proposed service road located adjacent to the NC 87 US -`,01 interchange. In April of 1992, a study was conducted to determine if a service road was required at this location. This study concluded that construction of the service road would cost less than buying out all of the adjacent property. This estimate has been reexamined by the NCDOT's Roadway Design Branch. According to current cost estimates, construction of the service road will save the State approximately $194,760. This cost estimate does not include any costs associated with assessment and/or remediation of hazardous materials found in the junkyard. It seems likely that some level of contamination has occurred. Both agencies suggested that this area could be used as mitigation for project impacts. The property appears to consist primarily of forested wetlands. Aside from cleanup of the junkyard, there seems to be no potential for wetland restoration, creation, or enhancement. It has been the NCDOT's experience that the permitting agencies are generally unwilling to accept preservation-type mitigation. A high mitigation ratio is usually involved, which reduces the value of the property as mitigation. Consequently, it is the NCDOT's position that this property is unsuitable for mitigation. The NCDOT studied potential mitigation in the project area during coordination for the permit for the CBD Loop project. During this coordination, it was determined that project impacts would be mitigated off-site, and the proposed Bull Farm mitigation bank has been developed for that purpose. Both agencies mentioned the potential for secondary development associated with the service road. It is apparent to the N ICDOT that if secondary development be proposed in wetlands, these proposals would be subject to the 404 process independently of the road. The NCDEM suggested that a small mitigation site could be constructed in one of the ramps at the US 301 - NC 87 interchange. This site is depicted on Sheet 1 of 3 at Site IV of the after-the-fact request (A copy of this sheet is attached). The NCDEM refers to a pipe which is proposed to drain directly to a lateral ditch. This pipe is depicted by a heavy black line near the right end of the sheet. This pipe is proposed to drain under the roadway to a lateral ditch, which empties into the large canal shown at the top of the sheet. The NCDEM has proposed that this pipe be diverted into the wetland area between the existing ramp and the new ramp, where a lateral V ditch is shown. This pipe and the ramp fill were already in place at the time of the NCDOT's site visit with the NtiTCDEM to review the after-the-fact application. During this site visit, the area between the ramps was still at its natural elevation. Sheet 1 shows that this area between the ramps would be filled during project construction. Since the site visit, this work has been completed. To accommodate the NCDEM's request, the NCDOT would have to remove the fill at the site and reconstruct the drainage pipes in this area. Since the impacts at this site have been described in the permit application, the NCDOT does not consider this reconstruction practical. I r -... Based on this site visit, the following additional information is required by DEM before a 401 Water Quality Certification decision can be made. By copy of this letter, the DEM is requesting that the Corps of Engineers place this project on hold until this information is available. I. On-site restoration of wetlands -site IV: It appears that the unavoidable wetland impact near site IV can be partially mitigated on site in the area between Business I-95, the CBD Loop and the newly constructed off-ramp connecting the two roadways. This can be accomplished after the planned removal of the existing ramp. Based on our site visit and review of the Public Notice, it appears that wetlands that were filled on sites IV and V were removing pollutants in runoff primarily from the existing junk yards and other development in the nearby area. This surface runoff has now been directed to a rip rapped ditch and into the adjacent large canal. This runoff should be diverted via a pipe beneath ramp A and loop A into the remnant wetlands and ramp (to be removed). This site should be designed to sheetflow runoff via. a flow spreading device through this site. Water can then exit beneath Ramp A and Loop A near Business I-95. We believe that this is an avoidable impact. Purchase of the land (especially the junk yard) will provide a mitigation (restoration) site for DOT for unavoidable fill at sites IV and V. Please examine this alternative to determine whether fill for the access road can be avoided. We are also concerned with cumulative and secondary impacts on wetlands in this area if the access road is built. III. On-site restoration - Wilkes Road site. We agree that restoration of this 2.24 acre site is unlikely in the short term since up to 6 feet of hydric soil has been removed. However we ask that DOT commit to replanting the site after removal of the fill as well as engineering of the large ditch which is parallel to the road to ensure that it will not drain adjacent wetlands. We believe that if this area eventually becomes jurisdictional wetlands that DOT should be allowed to claim the area as wetland mitigation. However we agree with DOT staff that quick (in less that 5 years), successful restoration is unlikely and concur with DOT's decision not to attempt to count restoration of this site as mitigation for this project. The following description of the work is taken from data provided by the applicant and from observations made during a site visit by a representative of the Corps of Engineers. Plans submitted with the application show three significant work areas that were not indicated on the plans included in the original Public Notice for this project issued July 23, 1992. The first area is located at the Wilkes Road (SR 2210) interchange with the CBD Loop where a temporary road has been constructed in wetlands to carry traffic while the Wilkes Road overpass is being built. Although the road is temporary and will be removed once the bridge is completed, wetlands at the road site have been undercut to a minimum depth of 6 feet and the overburden has been disposed of. Therefore, restoration of this site is not considered to be feasible. Project area wetlands contained a medium aged stand of mixed pine and hardwoods growing on Roanoke (typic ochraquult) and Johnston loams (cumulic humaquept). Total impacts to wetlands at this location is 2.24 acres. The second area is located at the new overpass of the CBD Loop at U.S. 301 within the southeast and southwest quadrants of the newly constructed interchange. Due to the amount of fill material already in place, the type of habitat that was displaced by the unauthorized fill is unknown. The area is mapped as containing Roanoke loam and presumably was forested prior to construction of the new interchange. Total impacts to wetlands at this site were estimated to be 11.3 acres. The NC DOT also proposes to construct a new road from U.S. 301 south of the newly constructed interchange to provide access to property that will be isolated by construction of the CBD Loop. The proposed road would be maintained by the state and will require the clearing and grubbing of a 60 foot corridor through a mixed stand of loblolly pine (Pinus taeda) and various % It -2- species of hardwoods. Total impacts to wetlands at this location are 2.2 acres. The NC DOT proposes to mitigate unavoidable impacts to waters and wetlands associated with this project at the proposed Sampson County (Bull Farm) mitigation site. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is *not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. -3- Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Dear Sir: The North Carolina Department of Transportation (NCDOT) was notified by your agency on June 23 that work on the proposed project was not in compliance with the 404 permit issued August 3, 1993. Specifically, construction was underway in wetlands that were not identified in the permit application, and had not been reviewed for permit authorization. A meeting was held at the project site on July 1, 1994 to review the areas of concern. This meeting was attended by representatives of the NCDOT, U.S. Soil Conservation Service, and your agency. Your representatives requested that a permit modification request be prepared for the additional work in wetlands, and submitted as quickly as possible. The NCDOT regrets the delay in responding to this request. The wetlands at the previously unidentified sites were delineated within a week of the site visit and an application was prepared. Due to requests by Cumberland County, the design had to be slightly modified. This required a revision to the drawings. Another site visit was held on October 17, 1994 with Mr. Scott McClendon to review the new wetland boundaries. Mr. McClendon recommended several minor revisions, which are included in this application. The impacted areas are found at three general locations: the interchange of NC 87 and US 301, a service road near this interchange, and Wilkes Road where the new CBD loop crosses. The interchange and service road are part of project U 0508CA, and the Wilkes Road area is part of U-00508CB. G) The interchange of US 301 and NC 87 is being enlarged to accommodate the new roadway. This has required the construction of new ramps adjacent to the existing.ones, and a enlarged roadway footprint at this location. Because of the amount of fill already in place, it is not feasible to determine the precise wetland limits at this location which existed prior to construction. The NCDOT has estimated the extent of these wetlands, and these are illustrated as Sites 4 and 5. These estimates were obtained by examining the soil profiles at the new fill limits, the county soil survey, the National Wetland Inventory Map, and the natural grade depicted in our roadway plan cross sections. Generally speaking, if hydric soil was found at the new fill limit, the area under the fill was assumed to be wet up to the old fill limit. The NCDOT believes that this is a generous estimate. This results in an estimated total of 11.3 acres of wetland impacts at the interchange. A new service road is proposed southwest of the interchange. This service road is necessary to provide access to properties which would otherwise have been isolated by the controlled access CBD Loop. The roadway will be twenty feet wide with shoulders four feet wide. The wetland impacts along this road were more easily and accurately examined. Although the vegetation had been removed, the natural grade had not been greatly disturbed. Wetland impacts along this roadway were determined by examining the soil profi a d adjacent vegetation. This resulted in an estimate 2. acres of impact along this road. An additional impact occurs at Wilkes Road. At this location, a bridge is being constructed on the existing Wilkes Road alignment to carry the road over the new CBD Loop. A detour has been constructed south of the existing road to carry traffic while the bridge is built. Once the bridge is finished, the detour will be removed. Unfortunately, it is not considered feasible to restore the site of the detour to its original state due to the amount of undercutting required by the detour's construction. The NCDOT's design at this site has been slightly modified at this location due to requests by Cumberland County. The County requested that turn lanes be included at the landfill entrance north of Wilkes Road. The project activity, involving approximately 16 acres of wetland fill, is a part of the Fayetteville Central Business District Loop in Cumberland County. At this point in time, the coordinated viewpoint record does not include a response on the Section 401 Certification. There is indication that the review by the Division of Environmental Management is in a "hold" status. Only one other cooperating agencies submitted written comments as a part of their form response. The Wildlife Resources Commission submitted comments much earlier and it appears a copy was forwarded to your office. However, for the record, the recommendations of that November 29 memorandum are included herein: 1) The fill material placed in wetlands at the Wilkes Road overpass should be removed and the area graded to existing ground level. The area should be revegetated with native species and allowed to return to a natural state. Although it is unlikely that this area will return to wetland conditions, it will provide bank stabiliza- tion and shading for the stream and serve as habitat for some wild- life species. 2) The proposed service road south of the US 301 interchange should not be constructed unless there is an upland alternative. We feel that providing this level of access will only encourage further destruction of these wetlands from secondary development pressure. If NCDOT must purchase this property because the service road is not con- structed it is recommended this area be used for on-site mitigation. The cost of purchasing the property should be compared to that of the service road before this is dismissed as an option. 3) We oppose the use of the Sampson County mitigation site for these impacts until onsite mitigation options are studied. Until it is clear that the Sampson County site contains sufficient mitigation credits for the projects which have been permitted to debit it, we feel NCDOT should look for other mitigation options for this project. The property south of the US 301 interchange does present an oppor- tunity for onsite mitigation. The recommendations of the Commission seem reasonable to the writer and are generally supported by this viewpoint position. Scott McLendon and Mike Smith of my staff with Ms. Tracy Conrad, and Messrs. Steve Devitt, Andrew Nottingham, Gordon Cashin, Barney O'Quinn, J.T. Cain, and Greg Price of the North Carolina Department of Transportation (NCDOT) and Mr. John Ray of the United States Department of Agriculture, Soil Conservation Service (SCS). The purpose of this meeting was to address the unauthorized filling of jurisdictional wetlands associated with construction of the Central Business District (CBD) Loop, Fayetteville, Cumberland County, North Carolina. During this meeting, the following sites along the construction corridor were examined to determine if completed and on-going work was in compliance with the subject Department of the Army (DA) permit issued August 3, 1993: - Site 1 was located at the crossover of the new NC 87 at Wilkes Road (SR 2210) where a new road and associated ditches were being constructed in jurisdictional wetlands located parallel to Wilkes Road. This work was not part of the permit application nor was it indicated to Corps personnel during previous site visits. The road will provide a temporary detour while the Wilkes Road overpass is being constructed. While the surface of the road will be obliterated when work is completed on the overpass, there are no plans to restore the affected wetland area. Accordingly, wetland impacts associated with this portion of the project, must be determined. - Site 2 was located at the new interchange of NC 87 at US 301. Although the permit application and drawings indicated that the northern terminus of the entire project was at the "old" NC 87 (south of the US 301 interchange), the project actually extends to Gillespie Street. It was apparent that construction of the southeast and southwest quadrants of the interchange has resulted in an unknown amount of adverse impact to waters and wetlands of the United States. In addition, a new road has been constructed through adjacent wetlands to provide access from US 301 to private property located west of the new alignment. This work was al.1p not part of the permit application nor was it indicated to Corps personnel during previous site visits. According to Mr. O'Quinn, a former member of your staff completed an environmental assessment for that portion of the project located between US 301 and Gillespie Street and found no evidence of wetlands along this segment of the project. As discussed, we concur with your staff with this finding. We also concur that and further, no wetlands have been impacted in the northwest and northeast quadrants of the new interchange. It is our understanding that NCDOT staff will determine impacts to wetlands associated with construction of ramps in the southwest and southeast quadrants, and will provide us with a copy of your file memorandum concerning the wetlands located between US 301 and Gillespie Street. r -2- - Site 3 was located at the southern terminus of the project where the new alignment intersects with East Mountain Drive (SR 2283) and the finished 4-lane portion of NC 87. NCDOT staff has examined this portion of the project, and have determined that no wetlands exist in the adjacent pasture fields that were not considered as Prior-Converted wetlands by the SCS. In the future, you are cautioned that if Corp personnel are not afforded the opportunity to examine the entire project corridor, NCDOT will be held responsibile for any enforcement action we would pursue if it is later determined that such areas meet the definition of a wetlands under our regulatory jurisdiction. It was agreed that the following actions must be completed to begin to bring this project into compliance: 1. NCDOT must determine the impact to the wetlands associated with the unauthorized road construction at the Wilkes Road overpass. You must also provide information on all restorative measures that will be taken this site. 2. NCDOT must determine the impact to the wetlands associated with the unauthorized construction of the interchange at US 301. 3. NCDOT must determine the impact to the wetlands associated with construction of the new access road located west of the "new" NC 87. As youy agreed onsite, you must cease and desist from any further work in wetlands associated with this access road until this matter can be resolved. We expect receipt of the required information within 30 days of your receipt of this letter. We will then determine the appropriate action necessary to bring this project into compliance with the terms and conditions of the subject permit. Staff biologists of the N. C. Wildlife Resources Commission (NCWRC) have reviewed the information provided by the U.S. Army Corps of Engineers. Our comments are provided in accordance with certain provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661- 667d). The NCDOT has placed fill in wetlands at three locations on the CBD Loop which were not included in the original permit issued August 3, 1994. The first location is at the Wilkes Road interchange where a temporary road was constructed in wetlands to carry traffic while the overpass is being built. Wetland impacts at this location are 2.24 acres. The second location is at a newly constructed overpass of the CBD Loop at US 301 in the southeast and southwest quadrants of the interchange. Wetland impacts at this location are estimated to be 11.3 acres. W, Memo Page 2 November 29, 1994 The third location is a service road to be constructed ....'from-US 301 t-o an isolated property just south of the new CBD Loop interchange. Total wetland impacts at this location are approximately 2.2 acres. Mitigation proposed by NCDOT for these impacts involves the use of the Sampson County (Bull Farm) mitigation site. We recommend-that the proposed project._be modified to incorporate the following recommendations prior to issuance of a wetlands fill permit or attending water quality certification: 1. The fill material placed in wetlands at the Wilkes Road overpass should be removed and the area graded to existing ground level. The area should be revegetated with native species and allowed to return to a natural state. Although it is unlikely that this area will return to wetland conditions, it will provide bank stabilization and shading for the stream and serve as habitat for some wildlife species. 2. The proposed service road south of the US 301 interchange should not be constructed unless there is an upland alternative. The property that will be isolated by the CBD Loop construction is mostly forested wetlands with a small portion being used as a junkyard. We feel that providing this level of access will only encourage further destruction of these wetlands from secondary development pressure. If NCDOT must purchase this property because the service road is not constructed, it is recommended this area be used for on-site mitigation. The cost of purchasing the property should be compared to that of the service road before this is dismissed as an option. 3. We oppose the use of the Sampson County mitigation site for these impacts until onsite mitigation options are studied. Until it is clear that the Sampson County site contains sufficient mitigation credits for the projects which have been permitted to debit it, we feel NCDOT should look for other mitigation options for this project. Dear Sir: The North Carolina Department of Transp6rtation (NCDOT) was notified by your agency on June 23 that work on the proposed project was not in compliance with the 404 permit issued August 3, 1993. Specifically, construction was underway in wetlands that were not identified in the permit application, and had not been reviewed for permit authorization. A meeting was held at the project site on July 1, 1994 to review the areas of concern. This meeting was attended by representatives of the NCDOT', U.S. Soil Conservation Service, and your agency. Your representatives requested that a permit modification request be prepared for the additional work in wetlands, and submitted as quickly as possible. The NCDOT regrets the delay in responding to this request. The wetlands at the previously unidentified sites were delineated within a week of the site visit and an application was prepared. Due to requests by Cumberland County, the design had to be slightly modified. This required a revision to the drawings., Another site visit was held on October 17, 1994 with Mr. Scott McClendon-to review the new wetland boundaries. Mr. McClendon recommended several minor revisions:` which are included in this application. The impacted areas are found at three general locations: the interchange of NC 87 and US 3019 a service road near this interchange, and Wilkes Road where the new CBD loop crosses. The interchange and service road are part of project U- 0508CA, and the Wilkes Road area is part of U-00508CB. I J. .The interchange of US 301 and NC 87 is being enlarged to accommodate the new roadway. This has required the construction of new ramps adjacent to the existing ones, and a enlarged roadway footprint at this location. Because of the amount of fill already in place, it is not feasible to determine the precise wetland limits at this location which existed prior to construction. The NCDOT has estimated the extent of these wetlands, and these are illustrated as 'Sites 4 and S. These estimates were obtained by examining the soil profiles at the new fill limits, the county soil survey, the National Wetland Inventory Map, and the natural grade depicted in our roadway plan cross sections. Generally speaking, if hydric soil was found at the new fill limit, the area under the fill was assumed to be wet up to the old fill limit. The NCDOT believes that this is a generous estimate. This results in an estimated total of 11.3 acres of wetland impacts at the interchange. A new service road is proposed southwest of the interchange. This service road is necessary to provide access to . properties which would otherwise have been isolated by the controlled access CBD Loop. The roadway will be twenty feet wide with shoulders four feet wide. The wetland impacts along this road were more easily and accurately examined. Although the vegetation had been removed, the natural grade had not been greatly disturbed. Wetland impacts along this roadway were determined by examining the soil profile and adjacent vegetation. This.resulted in an estimated 2.20 acres of impact along this road. An additional impact occurs at Wilkes Road. At this location, a bridge is being constructed on the existing Wilkes Road alignment to carry the road over the new CBD Loop. A detour has been constructed south of the existing road to carry traffic while the bridge is built. Once. the .bridge is finished, the detour will be removed. Unfortunately, it is not considered feasible to restore the site of the detour to its original state due to the amount of undercutting required by the detour's construction. The NCDOT's design at this site has been slightly modified at this'location_due to requests by Cumberland County. .The County requested that turn lanes be included at the landfill entrance north of Wilkes Road. This required the extension of construction limits to include these turn lanes, and. slightly increased the amount of-wetland impact. This revision is depicted in the drawings. A total of 2.24 acres of wetland impact are expected in the Wilkes Road vicinity. a r-' This results in a combined total of 15.74 acres of wetland impact, the majority of which is estimated to be underneath the new fill at the NC 87/US 301 interchange. Please consider this as a modification request to the existing permit for the CBD Loop (Action Id No. 199202767). Mitigation for the 15.74 acres will.be performed at the-Bull Farm Mitigation Site in Sampson County in coordination with your agency. Impacts to wetlands at the Wilkes Road site and the new access road were confirmed from the field investigation utilizing the 1987 Corps of Engineers Wetland Delineation Manual. As discussed, we concur that a total of 15.74 acres of wetlands have been impacted by the unauthorized activity at the three sites. During this meeting, Mr. J. T. Cain, the Resident Engineer on this project was verbally instructed to cease and desist from any further work in wetlands on the entire project until a complete application for the unauthorized work was received in this office. On October 21, a complete application for the unauthorized activity was recieved and Mr. Barney O'Quinn was informed by telephone that work may resume on the project. You are reminded that all work in wetlands on the unpermitted portions of the project is undertaken entirely at NCDOT's risk pending our final permit decision. O'QUINN, POST OFFICE BOX 25201, RALEIGH, NORTH CAROLINA, 27611-5201, has applied for a Department of the Army (DA) after-the-fact permit TO PLACE FILL MATERIAL IN AN ADDITIONAL, 15.74 ACRES OF WETLANDS TO ALLOW COMPLETION OF THE CENTRAL BUSINESS DISTRICT (CBD) LOOP (TIP #U-0508CA & CB) IN FAYETTEVILLE, CUMBERLAND COUNTY, NORTH CAROLINA. This public notice does not imply, on the parts of the Corps of Engineers or other agencies, either favorable or unfavorable opinion of the work performed; but it is issued to solicit comments regarding the factors on which a final decision will be based. Legal action has been suspended pending the outcome of this consideration. A portion of the work was originally authorized pursuant to a DA permit issiied August 3, 1993. The following description of the work is taken from data provided by the applicant and from observations made during a site visit by a representative of the Corps of Engineers. Plans submitted with the application show three significant work areas that were not indicated on the plans included in the original Public Notice for this project issued July 23, 1992. The first area is located at the Wilkes Road (SR 2210) interchange with the CBD Loop where a temporary road has been constructed in wetlands to carry traffic while the Wilkes Road overpass is being built. Although the road is temporary and will be removed once the bridge is completed, wetlands at the road site have been undercut to a minimum depth of 6 feet and the overburden has been disposed of. Therefore, restoration of this site is not considered to be feasible. Project area wetlands contained a medium aged stand of mixed pine and hardwoods growing on Roanoke (typic ochraquult) and Johnston loams (cumulic humaquept). Total impacts to wetlands at this location is 2.24 acres. The second area is located at the new overpass of the CBD Loop at U.S. 301 within the southeast and southwest quadrants of the newly constructed interchange. Due to the amount of fill material already in place, the type of habitat that was displaced by the unauthorized fill is unknown. The area is mapped as containing Roanoke loam and presumably was forested prior to construction of the new interchange. Total impacts to wetlands at this site were estimated to be 11.3 acres. The NC DOT also proposes to construct a new road from U.S. 301 south of the newly constructed interchange to provide access to property that will be isolated by construction of the CBD Loop. The proposed road would be maintained by the state and will require the clearing and grubbing of a 60 foot corridor through a mixed stand of loblolly pine (Pinus taeda) and various 8 -2- species of hardwoods. Total impacts to wetlands at this location are 2.2 acres. The NC DOT proposes to mitigate unavoidable impacts to waters and wetlands associated with this project at the proposed Sampson County (Bull Farm) mitigation site. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is *not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. 7 ? -r -3- Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Environmental Management (NCDEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act.
