District Engineer NC DOT Post Office Box 250 North Wilkesboro, N.C. 28679 Dear Mr. Bennett: [D EHNR December 20, 1995 Ashe County DEM Project # 951265 FIL You have our approval to place fill material in 0.03 acres of wetlands or waters for the purpose of replacing pipe along SR 1502 (Joe Badger Road), as described in your application dated 4 December 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3026. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. North fork New River class-C-trout Dear Mr. Thomas, The Department of Transportation is scheduled to perform minor improvements by widening, stabilizing, and draining, primarily along the existing roadway, an extension of SR 1502 which is to be added to the state'mairitained,system. Due to the proximity of North Fork New River class-C-trout we are requesting a 404 Nationwide permit no. 3 to allow us to upgrade the 1 existing cross line drainage structure that will need replacing, and or extending. Attached is a straight line sketch with proposed erosion control, stream, stream embankment, pipe crossing, and marked county map. By copy of this letter I am asking Ms. Stephanie Goudreau Mt. Region Coordinator with the North Carolina Wildlife Resources Commission to comment directly to you concerning the 404 Nationwide Permit request. Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. SECTION 1042 HIP RAP MATERIALS 1042-1 PLAIN RIP RAP. Stone for plain rip rap shall consist of fie Id stone or rough unhewn quarry stone. The stone shall be sound, tough, dense, resistant to the action of air and water, and suitable in all other respects for the purpose intended. Wliere broken concrete from demolished structures or pavement is avail- able, it may be used in place of stone provided that such use meets with the approval of the Engineer. However, the use of broken concrete which contains reinforcing steel will riot be permitted. The stone or broken concrete shall be graded to meet the following requirements: 1. Fot• Class 1 Rip Raft. Stone shall vary in weight from 5 to 200 pounds. At least 30 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 60 pounds each. Not more than 10 percent of the total weight of the rip rap may be in individual pieces weighing less than 15 pounds each. 2. For Class 2 Rip Rap. Stone shall vary in weight from 25 to 250 pounds. At least 60 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 100 pounds each.
