Box 25201 Raleigh, N.C. 27611 Dear Mr. Vick: You have our approval to place fill material in 45 square feet of wetlands and 600 square feet of waters for the purpose of replacing Bridge #6 on SR1318 at Pollock Swamp, as you described in your application dated 2 November 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3025. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. PROJECT SUNIMARY: NC DOT proposes to replace Bridge #6 at the crossing of SR 1318 and Pollock Swamp north of the Town of Edenton in Chowan County. The existing 19 ft. wide X 69 ft. long wooden bridge would be replaced with a 24 ft. wide X 105 ft. long concrete span. Vertical clearance is proposed to be reduced by 0.5 ft. NC DOT BRIDGE NO. 6, CHOWAN COUNTY BIO REPORT Page Two SITE DESCRIPTION The NC DOT owns and maintains Bridge # 6 at the crossing of SR 1318 and Pollock Swamp , approximately 2 miles north of the Town of Edenton, Chowan County. Pollock Swamp in the vicinity of the SR 1318 bridge is approximately 1200 ft. wide and is forested with mostly Taxodiwn distichum (bald cypress), Nyssa aquatica (black gum), Acer rubrum (red maple) and Magnolia virginiana (sweetbay magnolia). The shoreline adjacent to the existing bridge is predominately vegetated with the same overstory canopy. The waters of Pollock Swamp are classified by the Wildlife Resources Commission and the Division of Marine Fisheries as Inland Waters. These waters are classified by the Division of Environmental Management as CSW. The waters of Pollock Swamp are classified as Public Trust Waters by the Division of Coastal Management and is a part of the Estuarine System Area of Environmental Concern. Flow data are not readily available on Pollock Swamp although a very slow flow was observed on October 17, 1995. The existing channel of Pollock Swamp is often choked with Lintna spp. (duckweed). No submerged aquatic vegetation were noted during this investigation although emergents such as Saururus cernuus (lizards tail) and Polygonum amphibium (water smart weed) were present adjacent to the channel area and as groundcover in the adjacent swamp. The submitted plat work on NC DOT Bridge # 6 indicates the existing bridge is 19.2 ft. in width and 69 ft. in length, a mid-point water depth of - 6.0 ft. and a vertical clearance over Public Trust Waters of 4.5 ft. at normal water level conditions. During a field investigation on October 17, 1995 the channel water depth and vertical bridge clearance at the mid-point location of the bridge was 5 ft. 2 in. and 4 ft. respectively. The bridge is constructed of asphalt-covered wood planking supported by nine wood/concrete piles. The adjacent shorelines are stabilized with natural vegetation. PROPOSED WORD The DCM received an application on October 6, 1995 from the NC DOT requesting authorization to replace the existing bridge No. 6. NC DOT proposes to remove and replace the wooden bridge at Pollock Swamp with a 24 ft. wide reinforced concrete structure. The proposed 105 ft. long bridge structure consist of three 35 ft. long prestressed concrete spans supported on two 15 inch diameter bent piles. The proposed structure would provide a clearance over Public Trust Waters of about 4.0 ft. at normal water level conditions. Both existing approaches to Bridge # 6 would be widened to 36 ft. in width for a distance of 40 ft. from the proposed bridge structure. SR 1318 will be closed for the duration of the project. No temporary bridge bidge access will be needed. NC DOT BRIDGE NO. 6, CHOWAN COUNTY BIO REPORT Page Three ANTICIPATED EgPACTS NC DOT Bridge #6 has no known historical significance. The proposed project would require the placement of piles and fill which will directly impact and freshwater wetlands and Public Trust Waters. The new bridge structure would result in the filling of 600 sf. and the shading of 960 sf. of Public Trust Waters as well as the filling of 45 sf. of freshwater wetlands. Access to Public Trust Waters would be impacted by the proposed one-half ft. reduction in vertical clearance. Construction of the proposed project would temporarily increase turbidity within the stream channel and downstream. The NC DOT has not offered any compensation for the projected wetland or Public Trust losses or impacts. CAMA REVIEW The proposed development falls within the purview of the Chowan County Land-Use Plan. In its plan, the County expresses support for various state and federal programs, especially NC DOT road improvements. The County relies on existing regulations when dealing with impacts to the AEC's that can be permitted by regulatory agencies. If these permitting agencies issue a permit for the proposed work, it would be consistent with the Chowan County Land-Use Plan. Submitted by D. W. PROJECT SUMMARY: NC DOT proposes to replace Bridge #6 at the crossing of SR 1318 and Pollock Swamp north of the Town of Edenton in Chowan County. The existing 19 ft. wide X 69 ft. long wooden bridge would be replaced with a 24 ft. wide X 105 ft. long concrete span. Vertical clearance is proposed to be reduced by 0.5 ft. NC DOT BRIDGE NO. 6, CHOWAN COUNTY BIO REPORT Page Two SITE DESCRIPTION The NC DOT owns and maintains Bridge # 6 at the crossing of SR 1318 and Pollock Swamp , approximately 2 miles north of the Town of Edenton, Chowan County. Pollock Swamp in the vicinity of the SR 1318 bridge is approximately 1200 ft. wide and is forested with mostly Taxodium distichum (bald cypress), Nyssa aquatica (black gum), Acer rubrum (red maple) and Magnolia virginiana (sweetbay magnolia). The shoreline adjacent to the existing bridge is predominately vegetated with the same overstory canopy. The waters of Pollock Swamp are classified by the Wildlife Resources Commission and the Division of Marine Fisheries as Inland Waters. These waters are classified by the Division of Environmental Management as CSW. The waters of Pollock Swamp are classified as Public Trust Waters by the Division of Coastal Management and is a part of the Estuarine System Area of Environmental Concern. Flow data are not readily available on Pollock Swamp although a very slow flow was observed on October 17, 1995. The existing channel of Pollock Swamp is often choked with Limna spp. (duckweed). No submerged aquatic vegetation were noted during this investigation although emergents such as Saururus cernuus (lizards tail) and Polygonum amphibium (water smart weed) were present adjacent to the channel area and as groundcover in the adjacent swamp. The submitted plat work on NC DOT Bridge # 6 indicates the existing bridge is 19.2 ft. in width and 69 ft. in length, a mid-point water depth of - 6.0 ft. and a vertical clearance over Public Trust Waters of 4.5 ft. at normal water level conditions. During a field investigation on October 17, 1995 the channel water depth and vertical bridge clearance at the mid-point location of the bridge was 5 ft. 2 in. and 4 ft. respectively. The bridge is constructed of asphalt-covered wood planking supported by nine wood/concrete piles. The adjacent shorelines are stabilized with natural vegetation. PROPOSED WORK The DCM received an application on October 6, 1995 from the NC DOT requesting authorization to replace the existing bridge No. 6. NC DOT proposes to remove and replace the wooden bridge at Pollock Swamp with a 24 ft. wide reinforced concrete structure. The proposed 105 ft. long bridge structure consist of three 35 ft. long prestressed concrete spans supported on two 15 inch diameter bent piles. The proposed structure would provide a clearance over Public Trust Waters of about 4.0 ft. at normal water level conditions. Both existing approaches to Bridge # 6 would-be widened to 36 ft. in width for a distance of 40 ft. from the proposed bridge structure. SR 1318 will be closed for the duration of the project. No temporary bridge bidge access will be needed. NC DOT BRIDGE NO. 6, CHOWAN COUNTY BIO REPORT Page Three ANTICIPATED IMPACTS NC DOT Bridge #6 has no known historical significance. The proposed project would require the placement of piles and fill which will directly impact and freshwater wetlands and Public Trust Waters. The new bridge structure would result in the filling of 600 sf. and the shading of 960 sf. of Public Trust Waters as well as the filling of 45 sf. of freshwater wetlands. Access to Public Trust Waters would be impacted by the proposed one-half ft. reduction in vertical clearance. Construction of the proposed project would temporarily increase turbidity within the stream channel and downstream. The NC DOT has not offered any compensation for the projected wetland or Public Trust losses or impacts. CAMA REVIEW The proposed development falls within the purview of the Chowan County Land-Use Plan. In its plan, the County expresses support for various state and federal programs, especially NC DOT road improvements. The County relies on existing regulations when dealing with impacts to the AEC's that can be permitted by regulatory agencies. If these permitting agencies issue a permit for the proposed work, it would be consistent with the Chowan County Land-Use Plan. Submitted by D. W. Franklin Vick North Carolina Department of Transportation Post Office Box 25201 Raleigh, North Carolina 27611-5201 Dear Mr. Vick: Through coordination with the North Carolina Division of Coastal Management, we have learned of your Department's plans to replace NCDOT Bridge No. 6, located off State Road 1318, adjacent Pollock Swamp, near the Town of Edenton, Chowan County, North Carolina. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided by Nationwide Permit No. 14 for fills for roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed in waters of the United States is limited to a filled area of no more than one-third acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; C. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected highflows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and e. For fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer (DE) in accordance with the "Notification" general condition. Your work, located in the coastal area, is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and any required State authorization.. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid until the nationwide permit is modified, reissued or revoked, which will occur prior to January 21, 1997. It is incumbent upon you to remain informed of changes to the nationwide permits, which will be announced by public notice when they occur. If you commence, or are under contract to commence, this activity before the date the nationwide permit is modified or revoked, you will have twelve months from the date of the modification or revocation, to complete the activity under the present terms and conditions of this nationwide permit. According to said application NC DEPARTMENT OF TRANSPORTATION proposes to replace Bridge #6 at the crossing of SR 1318 and Pollock Swamp north of the Edenton, Chowan County. The existing 19' x 69' wooden bridge would be replaced with a 24' x 105' concrete span with the vertical clearance reduced by 0.5'. A copy of the entire application and additional information may be examined (or copies furnished upon request and payment of reproduction costs) during normal business hours at the office of Dennis W. Hawthorn, Division of Coastal Management, located at 1367 US 17 South, Elizabeth City, N.C., 919/264-3901, and/or the office of Deborah Sawyer, Division of Environmental Management, DEHNR Regional Field Office, Washington, N.C., 919/946-6481. The Division of Environmental Management proposes to take final action on this water quality certification on or before November 27, 1995. The issuance of the CAMA Major Development permit and the Section 401 Certification may deviate from this projected date depending upon the nature of the comments submitted and subsequent hearings that may result. All persons desiring to make comments should do so in writing to Roger N. Schecter, Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to November 22, 1995 for consideration in the CAMA permit decision, and to Mr. John Domey, Division of Environmental Management, P.O.
