This General Certification is issued in conformity with the requirements of Section
1 Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina

The State of North Carolina certifies that the specified category of activity will not
violate the a licable rovision of Sections 301, 302, 303, 3Qb and 307 of Public Laws 92-
pp p
500 and 95-217 if conducted in accordance with the conditions contained in this General
Certification.
Conditions of Certification;
1. All stream crossings must be perpendicular to the channel. The disturbed area
of waters shall be no wider than 10 feet and must be minimized to the
maximum extent practical.
2, As rovided in established state and local programs, sediment and erosion

control practices shall be utilized to prevent violations of the appropriate
turbidit water uality standards (50 NTU in streams and rivers not designatecl

as trout waters by the Environmental Management Commission (EMC); 25
NTU in all saltwater classes, and all lakes and reservoirs; and 10 NTU in EMC
classified trout waters).
3. The activity must comply with all conditions specified in 33 CFR Part 330.b

C. Nationwide Permit Conchtlons, as published in the Federal Register on
November 22, 1991 and the conditions outlined in the Wilmington District
Corps of Engineers Public Notice, Status of Nationwide Permits in North
Carolina, dated February 25,1993.
4. The a licant must obtain all 10ca1, state and federal authorizations required for

this activity prior to commencing work.
5. This Certification shall expire when Nationwide Permit 12, referenced in
Condition 2, is reissued, expires or is modified.
Non-com liance with or violation of the conditions of this certification by a specific

fill activity shall result in revocation of this certification for that activity.
The Director of the North Carolina Division of Environmental Management may
re uire submission of a formal application for individual certification for any project in this
q

category of activity if it is determined that the project is likely to have a significant adverse
effect upon water quality or degrade the waters or wetlands so that existing uses of the
wetland or downstream waters are precluded.
A public hearing may be held for a specific application for coverage under this
General Certification prior to a certification decision if deemed in the best interest of the
public by the Director of the North Carolina Division of Environmental Management.
