Department of Transportation resulting in 0.17 acres of wetland impact in Carteret County pursuant to an application filed on the 16th day of December of 1994 to replace the bridge (#38) on SR 1316 over Cullie Creek. The Application provides adequate assurance that the discharge of fill material into the waters of Ollie Creek in conjunction with the proposed development in Carteret County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92- 500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (50 NTUs in streams and rivers not designated as trout waters by DEM; 25 NTUs in all saltwater classes, and all lakes and reservoirs; 10 NTUs in trout waters). Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or LAMA permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Dear Mr. Dorney: Reference your letter dated February 6, 1995, requesting that the N.C. Department of Transportation respond to concerns specified in that letter that could result in denial of the requested 401 Certification. We have confirmed with David Taylor, N strict Manager of the Morehead City Field Office of the N.C. Division of Marine Fisheries, that cullie creek dopy not serve as habitat for any population of anadrolnous fish, therefore removal of that use is not an issue. Because there are no impacts to anadromous fish and minimal impacts to wetlands and waters, we do not intend to replace the existing bridge with a bridge. The comparative cost of a bridge to the proposed culverts is estimated at $75,000 versus $28,000, respectively. Furthermore, long--term maintenance costs for culverts are minimal while bridges cost approximately $2000 a year to maintain. The existing bridge is located in a curve, thus the wider road section over the pipes will allow a wider shoulder, thus improving the safety for the public. The crossing itself cannot be eliminated, thus there are no practicable alternatives to this project as proposed. We hope that this letter will address the concerns raised and allow permitting of this project to move forward. PROJECT SUMMARY: The applicant proposes to replace an existing bridge with three 117" X 79" corrugated steel pipe arch culverts approximately 60' in length and upgrade and pave SR 1316. NARRATIVE DESCRIPTION: Project Setting The project is located on SR 1316 near Merrimon on a tributary of Cullie Creek in Carteret County. Cullie Creek is a tributary to Adam's Creek. A 40'-long existing wooden bridge currently spans the tributary. Vertical clearance under the bridge is only 18" to 24". The tributary flows in a northerly direction and reaches Cullie Creek approximately 275' downstream from the bridge. Approximately 500' to 600' west of the bridge location, Cullie Creek turns and parallels the existing roadway. For approximately 100', the creek approaches within 15' to 18' of the roadside ditch. An extensive brackish marsh system vegetated with black needlerush Juncus roemerianus) dominates the area. Patches of giant cordgrass S artina cynosuroides) can be found scattered throughout the marsh. The roadside ditches are vegetated with salt meadow grass (S. patens , bulrush Sci us sp.), and cattail (Tynha sp.). Neither this tributary of Cullie Creek nor Cullie Creek itself are designated as a Primary Nursery Area. Both creeks are Class SA NSW waters. The area is not open to shellfishing. Project Description The applicant proposes to replace an existing bridge with three 117" by 79" corrugated steel pipe arch culverts approximately 60' in length, and to upgrade and pave SR 1316. The project includes "preping" an area 70' X 57' (the site of the existing bridge) for installation of the three culverts. The "preping" process involves excavating the area to a depth of -7' below MHW, installing the three culverts, constructing the inlet headwalls, and backfilling the area with sand and stone. Approximately 600 yds3 of fill is proposed to be placed below the mean high water line. In addition, the applicant proposes to upgrade and pave the road, providing two 10' lanes with 6'-wide shoulders. Anticipated Impacts The project as proposed would involve the following AECs: Coastal Wetlands, Estuarine Waters, Public Trust Areas, and the Estuarine Shoreline. Excavation and filling activities within the 70' X 57' area where the culverts are to be placed, directly removes approximately 253 ft2 of Coastal Wetlands and approximately 2,280 fe of aquatic habitat in creek bottom (Public Trust Area). Approximately 1,457 ft2 of high ground (Estuarine Shoreline) would also be affected by the excavating and filling activities. These excavation and filling activities would probably result in short-term and localized turbidity within the Estuarine Waters of the tributary to Cullie Creek. Also at the same time, the applicant proposes to upgrade and pave the road. This FIELD INVESTIGATION REPORT North Carolina Department of Transportation/Carteret County PAGE # 3 activity would destroy another 7,200 ft2 of Coastal Wetlands as a result of the placement of fill for the 6'-wide road shoulders. In addition, approximately 15,000 ft2 of high ground (existing dirt road) would be graded and paved. These filling activities approach within 15' of the Estuarine Waters of Cullie Creek and therefore increase the potential for short-term, localized turbidity as well as for long-term increased runoff into Cullie Creek. The applicant proposes to implement Best Management Practices to minimize any adverse effects which may be caused by project-related sedimentation. Specifically, the applicant proposes to install a silt fence at the top of the back slope of the proposed roadway ditch from the bridge location to a point where the edge of the creek is more than 75' from the excavation and filling activities. NARRATIVE DESCRIPTION: Project Setting The project is located on SR 1316 near Merrimon on a tributary of Cullie Creek in Carteret County. Cullie Creek is a tributary to Adam's Creek. A 40'-long existing wooden bridge-currently spans the tributary. Vertical clearance under the bridge is only 18" to 24". The tributary flows in a northerly direction and reaches Cullie Creek approximately 275' downstream from the bridge. Approximately 500' to 600' west of the bridge location, Cullie Creek turns and parallels the existing roadway. For approximately 100', the creek approaches within 15' to 18' of the roadside ditch. An extensive brackish marsh system vegetated with black needlerush Juncus roemerianus) dominates the area. Patches of giant cordgrass S artina cynosuroides) can be found scattered throughout the marsh. The roadside ditches are vegetated with salt meadow grass (S. patens , bulrush Sci us sp.), and cattail T ha sp.). Neither this tributary of Cullie Creek nor Cullie Creek itself are designated as a Primary Nursery Area. Both creeks are Class SA NSW waters. The area is not open to shellfishing. Project Description The applicant proposes to replace an existing bridge with three 117" by 79" corrugated steel pipe arch culverts approximately 60' in length, and to upgrade and pave SR 1316. The project includes "preping" an area 70' X 57' (the site of the existing bridge) for installation of the three culverts. The "preping" process involves excavating the area to a depth of -7' below MHW, installing the three culverts, constructing the inlet headwalls, and backfilling the area with sand and stone. Approximately 600 ydss of fill is proposed to be placed below the mean high water line. In addition, the applicant proposes to upgrade and pave the road, providing two 10' lanes with 6'-wide shoulders. Anticipated Impacts The project as proposed would involve the following AECs: Coastal Wetlands, Estuarine Waters, Public Trust Areas, and the Estuarine Shoreline. Excavation and filling activities within the 70' X 57' area where the culverts are to be placed, directly removes approximately 253 ft2 of Coastal Wetlands and approximately 2,280 ft2 of aquatic habitat in creek bottom (Public Trust Area). Approximately 1,457 ft2 of high ground (Estuarine Shoreline) would also be affected by the excavating and filling activities. These excavation and filling activities would probably result in short-term and localized turbidity within the Estuarine Waters of the tributary to Cullie Creek. Also at the same time, the applicant proposes to upgrade and pave the road. This FIELD INVESTIGATION REPORT North Carolina Department of Transportation/Carteret County PAGE #3 activity would destroy another 7,200 ft2 of Coastal Wetlands as a result of the placement of fill for the 6'-wide road shoulders. In addition, approximately 15,000 ft2 of high ground (existing dirt road) would be graded and paved. These filling activities approach within 15' of the Estuarine Waters of Cullie Creek and therefore increase the potential for short-term, localized turbidity as well as for long-term increased runoff into Cullie Creep. The applicant proposes to implement Best Management Practices to minimize any adverse effects which may be caused by project-related sedimentation. Specifically, the applicant proposes to install a silt fence at the top of the back slope of the proposed roadway ditch from the bridge location to a point where the edge of the creek is more than 75' from the excavation and filling activities. Everett District Engineer SUBJECT: Secondary Road Construction Project in Carteret County - SR 1316 (Royal Road) This is to provide information requested by Mr. M. Ted Tyndall, Field Representative, DENHR, in his letter dated August 31, 1994. The additional information is relative to subject construction project activities near the proposed bridge replacement location at Cullie Creek. This information was inadvertently omitted in the original permit application. The area of concern is where Cullie Creek, after leaving the bridge site running in a northerly direction, turns and parallel$ the roadway, then approaches the roadway coming within 15' - 18' of the proposed roadway ditch. This area is approximately 100' in length and located approximately 500' west of the Cullie Creek bridge. Please find attached revised plan drawing and cross-section copies for your review. It is proposed to install silt fence at the top of the back slope of the proposed roadway ditch from the bridge location to where the edge of creek distance from excavation activities is greater than 75 feet.
