You have our approval to place fill material in .02-acres of wetlands or waters for the purpose of
road maintenance at SR 1727 (Ellis Mtn. Road), as you described in your application dated 20 October
1994. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 2745. This certification allows you to use Nationwide Permit Number 3
when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786.

Subject: Nationwide Permit No. 3 to replace existing pipe
along SR 1727 (Ellis Mtn. Rd.) adjacent to Mulberry Ck.

Dear Mr. Thomas,
The Department of Transportation is scheduled to grade, drain
base, and pave primarily, along the existing roadway of SR 1727
(Ellis Mtn. Rd)., in Wilktes County during the 1994-1995 fiscal
year. Due to the-proximity of a ,small stream, Mulberry Creek
Class C, we are requesting-a 404 Nationwide permit no. 3 to allow
us to upgrade the 2 existing crass line drainage structures that
will need replacing, and or extending.
Attached is a straight line sketch with proposed erosion control,
stream, pipe crossing, and marked county map.
By copy of this letter I am asking Ms. Stephanie Goudreau Mt.
Region Coordinator with the North Carolina Wildlife Resources
Commission to comment directly,,to you concerning the 404
Nationwide Permit request.

Also by copy of this letter, I am requesting authorization to
proceed under-,.Section 4401 of-the•Clean Water Act from the Division
of Environmental Management.—
We would like to begin construction as soon as possible. If
further information is required, please let me know. Your early
review and consideration will be greatly appreciated.

EROSION CONTROL SCHEDULE
(1) All adequate temporary erosion control measures Will be
installed before clearing and grubbing operations begin.
(2) As construction progresses temporary and permanent
erosion control devices shall be installer) in a timely
manner,' according to any special permit requirements
and /or requirements set out in,G.S. 113A-57.
MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY
Pursuant to G.S. 113A-57(3), Provisions for a ground
cover sufficient to restrain erosion must be
acromp.lished within 30 working days or 120 calendar
days .following completion of construr lon or
