Box 250 North Wilkesboro, N.C. 28679 Dear Mr. Bennett: Subject: Proposed fill in Wetlands or Waters Road maintenance for pipe replacement, SR 1999 Wilkes County DEM Project #94247 We have reviewed your request for 401 Water Quality Certification to place fill material in 0.2 acres of wetlands or waters which are tributary to Roaring River for road maintenance for pipe replacement at SR 1999 in Wilkes County as described in your submittal dated 14 March 1994. Based on this review, we have determined that the proposed fill is covered by General Water Quality Certification No. 2745. A copy of the General Certification is attached. This Certification is necessary for coverage under Corps of Engineers' Nationwide Permit No. 3. This action completes DEM's review under Section 401 of the Clean Water Act. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Wilkes County during the 1992-1993 fiscal year. The purpose of this improvement is to eliminate hazardious horziontal curves for the safety of the traveling public. Due to the proximity of Roaring River Class B we are requesting a 404 Nationwide permit no. 3 for the 2 existing cross line drainage structures that will need ..replacing, extending, or upgrading. Attached is a straight line sketch with proposed erosion control, stream, stream embankment, pipe crossing, construction limits, and marked county map. Clear only enough area and install the downstream measures such as silt check dams, silt screens, and silt basins as noted on plan. 2. Excavate the 2' base tail ditch. 3. Excavate and install the roadway culvert. 4. Install sediment control measures at"inlet as noted on plan. 5. Install additional pipe outlet protection and inlet protection as noted. f? SECTION 1042 HIP RAP MATERIALS 1042-1 PLAIN RIP RAY. Stone for plain rip rap shall consist of fieldstone or rough unhewn quarry stone. The stone shall be sound, tough, dense, resistant to the action of air and water, and suitable in all other respects for the purpose intended. Where broken concrete from demolished structures or pavement is avail- able, it may be used in place of stone provided that such use meets with the approval of the Engineer. However, the use of broken concrete which contains reinforcing steel will not be permitted. The stone or broken concrete shall be graded to meet the following requirements: 1. For Class 1 Rip Rap. Stone shall vary in weight from 5 to 200 pounds. At least 30 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 60 pounds each. Not more than 10 percent of the total weight of the rip rap may be in individual pieces weighing less than 15 pounds each. 2. For Class 2 Rip Rap. Stone shall vary in weight from 25 to 250 pounds. At least 60 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 100 pounds each. Not more than 5 percent of the total weight of the rip rap may be in individual pieces weighing less than 50 pounds each. 691
