Based on this review, we have determined that the proposed fill is covered by General Water Quality Certification No. 2745. A copy of the General Certification is attached. This Certification is necessary for coverage under Corps of Engineers' Nationwide Permit.No. 3. This action completes DEM's review under Section 401 of the Clean Water Act. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)' days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This is a request for a 404 Permit (#3 Maintenance) due to the need to replace an existing 48' length of 24" CMP (Sta. 30+75) which has deteriorated and to improve the safety of the entire road for the motoring public. Another larger pipe at Sta. 33+50 will hopefully remain undisturbed. These pipe carry small streams which are tributaries to Tom's Creek and empty into the Yadkin River. These streams appear to be in a High Quality Water Zone; however, by copy of this letter I am asking Mr. Joseph Mickey, Jr., N. C. Wildlife Resources Commission, District Fisheries Biologist to comment directly to you concerning the 404 Nationwide Permit Request. We will implement all necessary erosion and sediment control measures during project construction and will expend every effort to complete the work quickly. I am sending a sketch with the proposed erosion control plan along with a marked map. Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. Generally, the order of installation of the erosion control measures.will be as follows: Temporary Silt Basins shall be installed before clearing and grubbing begins. Silt Fences and temporary silt ditches shall be installed after clearing and before grading. Temporary Stone ditch checks shall be installed as soon as ditchline is established. Pipe Outlet and inlet protection wild be done as soon as the pipe is installed. Seeding and other permanent erosion control measures are to be implemented as soon as practical.
