Franklin Vick Planning and Environmental Branch North Carolina Department of Transportation Post Office Box 25201 Raleigh, North Carolina 27611-5201 Dear Mr. Vick: This is in response to your letter of June 6, 1995 requesting modification of Special Condition No. 2 of your Department of the Army (DA) permit issued on June 20, 1994 which authorized the discharge of fill materials into approximately 6.8 acres of waters and wetlands in the headwaters of Fourmile Creek and Flat Branch to construct a 2.5-mile long segment of the Charlotte Outer Loop Highway (I-485) between the planned Rea Road interchange and Providence Road south of Charlotte, Mecklenburg County, North Carolina. Specifically your request was to modify Special Condition No. 2 in order to allow the North Carolina Department of Transportation to retain indefinite ownership and management of the Porter Road Swamps Mitigation Area. While we can appreciate the difficulties you have experienced in locating a suitable, local conservation organization, we still believe that local, onsite management of the area would best insure its continued maintenance, protection and preservation. We also believe that the public interest would be best served by allowing some low-intensity use of the area such as scientific study and research, educational programs, wildlife photography and the like. Your concerns over potential development of the site or unauthorized sale of portions of the property could be addressed through deed restrictions or similar legal mechanisms. Therefore, Special Condition No. 2 of the referenced DA permit is hereby modified to require the transfer of the Porter Road Swamps Mitigation Area to an appropriate conservation organization by June 20, 1996. All other terms and conditions of the original permit remain in full force and effect. Printed on 0 Recycled Paper -2- We are aware that the Charlotte-based Catawba Lands Conservancy (CLC) would accept donation of the Porter Road Swamps site and has prepared a management plan for the area that involves a cooperative stewardship agreement among the CLC, Mecklenburg County Parks and Recreation Department, the North Carolina Herpetological Society, and the University of North Carolina at Charlotte. The CLC is also prepared to engage in a fund raising campaign to establish a management endowment for the site. Their basic mission statement as well as specific objectives for the site are highly compatable with our goals for the area. These waters and wetlands are located in the headwaters of Four Mile Creek and Flat Branch and you have requested authorization to proceed with construction under DA Nationwide Permit No. 26. A number of public interest concerns have surfaced from our review of your proposed project. Most of these concerns have been expressed to you by my Regulatory staff in your monthly permit coordination meetings and remain unresolved at this time. Our concerns are as follows: a. The proposed road would cross two mafic depressional swamps, which are rare wetlands of the piedmont region. Locally there are less than a dozen known examples of this wetland type in Mecklenburg County and they are all generally small in size (1-3 acres) so their areal extent is not great. The North Carolina Natural Heritage Program has identified these wetlands as significant both regionally and statewide for their natural area values, unique vegetation associations and potential. for rare and uncommon plant and animal species. Surveys are ongoing at this time so the full implications of your proposed fill are unknown. b. The cumulative effects of highway construction across the two depressional swamps in question are also of concern. The source of hydrology for these wetlands comes from surface runoff. Disruption of the normal hyroperiod from ditching, diversion of runoff, sedimentation, and lack of. culverting would have adverse effects well beyond the immediate footprint of the fill. Because wetland hydrology persists in these areas due to the presence of a shallow clay hardpan, we are also concerned about the effects throughout the wetland of substrate removal from the road corridor. It is very probable that the overall negative impact to these depressional swamps will be far in excess of the 1.5 acres per wetland that you have indicated in your nationwide permit application. -2- c. Mafic depressional swamps were not identified or considered in the environmental impact statement process for the Southern Outer Loop Highway. We recognize your recent efforts to look at alternative alignments through this area, but the information provided thus far is not sufficient for us to conclude that avoidance or minimization of impacts to these wetlands is not practicable. In particular, further consideration is due of minor shifts in roadway alignment, reducing the fill area, minimizing clearing, grubbing and excavation, and minimizing the disruption of hydrology. d. My Regulatory staff has previously recommended compensatory mitigation for unavoidable impacts to mafic depressional swamps and encouraged you to explore the preservation and management of other wetlands of this type within the county. Your permit request contains no mitigation proposal. Based on the above, I find that the proposed activity would have more than minimal adverse effects on the environment, and that these concerns cannot be adequately addressed within the time constraints of the pre-discharge notification process of the nationwide permit or by the nationwide permit general conditions. I have therefore concluded that your proposed construction of this 2.5 mile segment of the Charlotte Outer Loop Highway does not qualify for authorization by nationwide permit but should undergo a full public interest review. Please submit an individual DA permit application to initiate this process. Because this section of road would not be functional without the proposed mafic depressional swamp crossings, the permit process must consider the totality of wetland impacts throughout the project area. We have considered your request and conducted additional review of the project site. We find that construction of a concrete fill trail confined to the authorized limits of the roadway approach fill at both McMullen and McAlpine Creeks would have only minimal impacts to wetlands that have been previously disturbed. We also find, however, that extension of fill trails into the undisturbed wetlands within your right-of-way would disrupt wetland hydrology over a wide area and would lead to additional wetland fill when the public greenway trails are eventually linked in this area. We have also required Mecklenburg County to boardwalk over similar wetlands on McMullen Creek in an earlier permit action. Therefore, the authorization to construct elevated boardwalk through wetlands is hereby modified to allow the construction of 14-foot-wide concrete trail only within the limits of the authorized roadway approach fills (240 linear feet at McAlpine Creek, 235 linear feet at McMullen Creek). The South Charlotte Outer Loop from NC 51 to Rea Road (T.I.P. Nos. R-0211DA/DB/DD) involves two sites, the Mecklenburg County park at Mallard Creek Church Road, and the property on Little Sugar Creek at NC 51 and Leitner Drive. The West Charlotte Outer Loop from NC 49 to I-77 (T.I.P. No. R-2248AA) and South and East Charlotte Outer Loop from Rea Road to Idlewild Road (T.I.P. Nos. R-0211DC/EA/EB and part of R-2123AA) collectively involve two sites, Porter Road Swamp and a property at Long Creek in north Charlotte. Site work was begun at the two Mallard Creek Church Road sites in February, 1994, as required. After a full month beyond the first day of site construcion, the subcontractor hired for this project defaulted on the contract. They believed that the work would cost more than they had agreed upon in the contract, and refused to proceed further with no construction. Therefore, NCDOT had to take time to hire another subcontractor. The new subcontractor has committed to completing all excavation and seeding required on the sites by July 26, 1994, barring extraordinary climatic events. Subsequently, placement of groundwater monitoring wells on the newly graded sites will be conducted by the NCDOT Geotechnical Unit. Planting of bottomland hardwood seedlings by the subcontractor will begin on or after November 15, 1994, with a completion date of December 31, 1994. An as-built report will be submitted to the Corps and Division of Environmental Management at that time. Monitoring of groundwater wells and vegetative sampling plots, along with the required progress reports, will follow in the spring of 1995. The 21-acre property on Little Sugar Creek was recently re-surveyed by NC-DOT. The property-agent had been notified by the developer of the adjacent property of errors in the available floodplain and road maps, and had requested this additional work prior to completion of the site negotiations. A copy of the deed for this property will be transmitted to you as soon as possible after the July 15, 1994 closing date. NCDOT will be completing contour mapping of the site in July. Given the time required for site planning, agency review; plus preparation and awarding of contracts, we expect to begin construction on this site in 1995, with monitoring of plantings to begin in the spring of 1996. Right-of-way negotiations are progressing for the mafic depression preservation site, Porter Road Swamp. We expect to close on this property in early to mid August, 1994, with a copy of the deed to be transmitted to you as soon as possible. NCDOT has tried unsuccessfully to acquire two ponds adjacent to the Charlotte Outer Loop, and the Walker Branch mafic depressions for additional mitigation. We will therefore need to debit mitigation credits from the Long Creek mitigation site. This site is currently under appraisal, and we expect to close on the property in mid- September, 1994. A copy of the deed will be transmitted to you upon receipt. The site owner was able to provide us a boundary survey, but NCDOT will need to do additional surveys of elevations, sewerlines, streams, and treelines. As with the site at Little Sugar Creek, we anticipate site planning and review to proceed well into 1995, with monitoring to begin in the spring of 1996. NCDOT personnel will be visiting the three bottomland hardwood mitigation sites on Monday, June 27, 1994, to discuss grading, hydrology, and other site details. We plan to be at the site on Little Sugar Creek at 10:30 a.m., and invite any resource agency personnel interested to attend this field meeting. PHONE (919) 733-- 384 FAX (919) 733-9428 NORTH CAROLINA MECKLENBURG COUNTY NORTH CAROLINA DEPARTMENT OF TRANSPORTATION AND ALICE JOHNSTON RIGHT OF WAY DONATION PROJECT: R-2248 AA & AB THIS AGREEMENT, made and entered into this the - S41 day of , 1994, between the DEPARTMENT OF TRANSPORTATION, an agency of the State of North Carolina, hereinafter referred to as the Department, and ALICE JOHNSTON, hereinafter referred to 'as the Owner; W I T N E S S E T H: WHEREAS, 'the Department has prepared and adopted plans to make certain street and highway constructions and improvements in Mecklenburg County under Project R-2248 AA and AB, said plans consisting of the construction of the Charlotte Outer Loop from I-77 to Brown Grier Road (the Project); and, WHEREAS, the Owner has property needed by the Department for right of way and construction purposes for the Project and has agreed to donate certain right of way subject to the conditions hereinafter set forth. NOW, THEREFORE, the parties hereto, each in consideration of the promises and undertakings of the other as herein provided, do hereby covenant and agree, each with the other, as follows: ?5 -2- 1. The Department has completed plans identifying the right of way needed for construction of the first portion of the Project. The first segment, Project R-2248AA, will be constructed from I-77 to NC 49. In accordance with Departmental procedures, the property will be appraised and an offer of just compensation made to the Owner for the right of way needed to construct R-2248AA. The Department and the Owner has reached an agreement for the acquisition of said right of way in the amount of $580,800.,00. 2. The Department is currently designing project plans identifying the right of way needed for construction of the second segment of the Project. The second segment, Project R-2248AB, will be constructed from NC 49 north to Brown-Grier Road. The Owner is aware that she has the right to have the property appraised and an offer of just compensation made to her for the necessary right of way for Project R-2248AB. The estimated right of way is approximately 35 acres. The Owner, recognizing the benefits of the Project, agrees to donate, at no expense to the Department, the estimated right of way needed for construction of Project R-2248AB. The Department shall prepare the appropriate conveyance document to be executed by the Owner conveying the right of way on both segments of the Project to the Department at the same time. When the Department has finalized the right of way plans for the second segment, any surplus right of way will be conveyed back to the Owner, or her successor, at no expense. In the 11'? , CL-Cl'- -3- event additional right of "way or easements are needed, the Owner agrees to convey said right of way to the Department at no expense. Additional right of way and/or easements must be requested by the Department, and conveyed by the Owner, prior to the let of the second segment. Additional right of way shall not exceed 5 acres. The Owner also agrees to grant any additional temporary easements and/or permanent drainage easements needed to construct the projects. 3. The Department shall revise the letting date for Project R-2248AB in the Transportation Improvement Program to show a June 1996 let date. The Department shall make a "best faith" effort to let the project in June 1996. 4. The obligations of the Owner set out in this Agreement remain with the property. In the event, the Owner sells or conveys the property and the new owner is not willing to donate the additional needed right of way, the Department is not obligated to any specific construction schedule for Project R-2248AB. 5. The Owner reserves the right for herself, her successors and assigns to include additional or to upgrade proposed landscaping, fencing, lighting, utilities, or other similar improvements in the Department's construction contract(s) subject to 100% reimbursement by the Owner for any additional costs incurred as a result of such additions or upgrades. Reimbursement shall be based upon any excess costs incurred as a result of such additions or upgrades for any improvement included in the contract, or added to the contract after letting, that is over and above the Department's specifications for the project. Cost will be the actual cost for the materials and labor charged by the contract°yAdditional improvements or upgrades are subject to approval by the Department and will be constructed in accordance with departmental standards and regulations. Reimbursement shall be one lump sum payment upon -4- completion of the work and within thirty (30) days of invoicing by the Department. Collateral, in a form acceptable to the Department, must be submitted by the Owner prior. to letting of the contract(s), or prior to the contract being amended, for the estimated. excess cost of the additional improvements and upgrades. 6. The Owner agrees to convey to the Department forty five (45) acres for wetlands mitigation purposes required by the state environmental agencies to constructim these projects. The Department shall make payment to the Owner in the amount of $994,050.00 for this mitigation area. The Department agrees to maintain said tract for mitigation purposes for a period of ten (10) years and agrees not to discharge,or deposit or permit the discharge or deposit during such ten (10) year period of dredged or fill material in or on any portion of such property constituting "wetlands" under the Federal Clean Water Act. Nothing herein shall relieve the Department from arry obligation imposed by applicable law. 7. The obligations and covenants of the parties contained in paragraphs 2 through 6 above shall inure to the benefit of and bf binding on the successors and assigns of the parties and shall survive the closing of the conveyances contemplated in this Agreement. Z) l_ Applications and DOT's DOT has submitted two applications for Individual Permits on the Charlotte Outer Loop. The first application is for a 2.5 mile segment that would impact 5.2 acres of wetlands. The second application is for a 9.5 mile segment that would impact 13.4 acres of wetlands. Wetland impacts total 18.6 acres (see attached maps). We have made site inspections of most of these wetlands. DOT has an alignment that cannot be relocated due to development up to the right-of-way. The table on the next page lists the wetland sizes, types and rating. DOT's applications will impact 4.5 acres of mafic depressions and approximately 14 acres of bottomland hardwoods along small streams. Mafic depressions are a unique wetland type that is found exclusively in Mecklenburg County. Mafic depressions perform limited water quality functions because they are rainwater feed. They provide excellent amphibian and wildlife habitat. DOT proposes to preserve a 45 acre site within Mecklenburg County as wetland mitigation. The site includes approximately 17 acres of mafic depressions and approximately 28 acres of upland buffer to allow the wetland to continue to function properly. With all of the development occurring in the county, we believe that the 45 acres of mafic depression/upland mitigation adequately compensates for DOT impacting 4.5 acres of mafic depression. Our regulations require us to protect existing uses (Antidegradation water quality standard). Bottomland hardwood wetlands serve important water quality functions such as water storage, streambank stabilization, and pollutant removal. Since DOT is not proposing to replace the wetlands that perform water quality functions, there will be a loss of these uses in violation of the Antidegradation standard. Therefore, I propose that we condition the 401 Certification to require DOT to mitigate at a 1:1 ratio for the 10 acres of significant water quality related wetlands (high-lighted in table). We are not requesting mitigation for all wetland impacts, and the mitigation ratio is less than the standard 2:1 for wetland creation. The Corps and other Federal agencies will not require mitigation beyond the mafic depression preservation. Needless to say, DOT does not want to be required to do any additional mitigation. DOT needs a 401/404 decision by 1 June 1994 to meet their bid let deadlines. If you concur with this recommendation, I'll write a Certification with an additional condition to 'require 10 acres of bottomland hardwood mitigation for these projects. Biologists on the N. C. Wildlife Resources Commission (NCWRC) staff have reviewed the information provided by the U.S. Army Corps of Engineers. Our comments are provided in accordance with certain provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661- 667d). The proposed project involves constructing a 2.5 mile segment of 4-lane divided highway with full control of access, as part of the Charlotte Outer Loop. Impacts to wetlands include 4.5 acres of depressional swamp and 0.70 acres of alluvial forest. Mitigation proposed by NCDOT for these impacts involves preservation of an area known as Porter Road Swamps located Southwest of Charlotte. This site consists of approximately 17.5 acres of depressional swamp with approximately 27 acres of upland buffer. Memo Page 2 May 18, 1994 The NCWRC feels that the proposed mitigation is adequate for the 4.5 acres of depressional swamp to be. impacted by construction of the proposed facility. It should be noted that this is considerably less than the normal preservation ratio of 10 to 1. Due to the quality of the Porter Road Swamp site and the important role that an upland buffer plays in maintaining the integrity of these depressional areas, we agree with including the upland areas in the mitigation ratio. However, our acceptance of this proposal is contingent upon NCDOT actually obtaining the Porter Road Swamps site. The NCWRC remains concerned about the additional 0.70 acres of alluvial Brest impacts. NCDOT has proposed no mitigation for this wetland type. The NCWRC requests that NCDOT propose in-kind mitigation for the additional 0.70 acres of forested wetland impacts or credit these impacts to mitigation sites for other segments of the Charlotte Outer Loop. We recommend that the proposed project be modified to incorporate the preceding recommendations prior to issuance of a wetlands fill permit or attending water quality certification. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed construction of a 2.5-mile long segment of four lane, controlled access, divided highway that is part of a planned circumferential loop around the City of Charlotte. The proposed road would impact approximately 1.6 acres of stream channel at 4 separate crossings. These streams are small, headwaters tributaries to Fourmile Creek. An additional 5.2 acres of forested wetlands would be affected at five separate locations within the headwaters of Flat Branch, a tributary to Sixmile Creek. The majority of the wetland area (4.5 acres) consists of depressional swamp dominated by overcup and willow oak. Depressional swamps are rare wetlands of the southern piedmont occupying shallow depressions on broad upland flats or ridge tops and are characterized by clay soils and surface ponding of runoff and rainfall. The remaining wetlands (0.70 acres) consist of narrow borders of alluvial forest along shallow drainways vegetated with such species as sweet gum, willow oak, red maple and green ash. One small pond is also proposed to be filled. The footprint of the proposed roadfill through wetland areas is generally between 220 and 240 feet wide. Approximately 27,700 cubic yards of material would be discharged into waters and wetlands for this project. Fill for the road would be obtained from unspecified upland borrow areas. In order to mitigate for these intended wetland impacts, the applicant proposes to preserve approximately 17.5 acres of depressional swamp and associated wetlands together with approximately 27 acres of forested upland buffer area at a site known as the Porter Road Swamps located southwest of Charlotte. The purpose of the proposed work is to provide a new public highway facility. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. These waters and wetlands are located in the headwaters of Four Mile Creek and Flat Branch and you have requested authorization to proceed with construction under DA Nationwide Permit No. 26. A number of public interest concerns have surfaced from our review of your proposed project. Most of these concerns have been expressed to you by my Regulatory staff in your monthly permit coordination meetings and remain unresolved at this time. Our concerns are as follows: a. The proposed road would cross two mafic depressional swamps, which are rare wetlands of the piedmont region. Locally there are less than a dozen known examples of this wetland type in Mecklenburg County and they are all generally small in size (1-3 acres) so their areal extent is not great. The North Carolina Natural Heritage Program has identified these wetlands as significant both regionally and statewide for their natural area values, unique vegetation associations and potential for rare and uncommon plant and animal species. Surveys are ongoing at this time so the full implications of your proposed fill are unknown. b. The cumulative effects of highway construction across the two depressional swamps in question are also of concern. The source of hydrology for these wetlands comes from surface runoff. Disruption of the normal hydroperiod from ditching, diversion of runoff, sedimentation, and lack of culverting would have adverse effects well beyond the immediate footprint of the fill. Because wetland hydrology persists in these areas due to the presence of a shallow clay hardpan, we are also concerned about the effects throughout the wetland of substrate removal from the road corridor. It is very probable that the overall negative impact to these depressional swamps will be far in excess of the 1.5 acres per wetland that you have indicated in your nationwide permit application. -2- c. Mafic depressional swamps were not identified or considered in the environmental impact statement process for the Southern Outer Loop Highway. We recognize your recent efforts to look at alternative alignments through this area, but the information provided thus far is not sufficient for us to conclude that avoidance or minimization of impacts to these wetlands is not practicable. In particular, further consideration is due of minor shifts in roadway alignment, reducing the fill area, minimizing clearing, grubbing and excavation, and minimizing the disruption of hydrology. d. My Regulatory staff has previously recommended compensatory mitigation for unavoidable impacts to mafic depressional swamps and encouraged you to explore the preservation and management of other wetlands of this type within the county. Your permit request contains no mitigation proposal. Based on the above, I find that the proposed activity would have more than minimal adverse effects on the environment, and that these concerns cannot be adequately addressed within the time constraints of the pre-discharge notification process of the nationwide permit or by the nationwide permit general conditions. I have therefore concluded that your proposed construction of this 2.5 mile segment of the Charlotte Outer Loop Highway does not qualify for authorization by nationwide permit but should undergo a full public interest review. Please submit an individual DA permit application to initiate this process. Because this section of road would not be functional without the proposed mafic depressional swamp crossings, the permit process must consider the totality of wetland impacts throughout the project area. We do not feel that any of the alternatives designed to minimize i.I:,pacts would be justified, considering the impacts to local communities and escalation of costs that would be associated with these measures. Therefore; we propose mitigation for the impacts to be incurred by this project. We are discussing the acquisition of Porter Road Swamp with the Crosland Group, who currently have an option on the property which includes this system, and are planning development of the uplands onsite. The Porter Road Swamp is one of the largest, highest quality mafic depression systems in North Carolina. The site report prepared by the North Carolina Natural Heritage Program is included with this package. This report details the location and biological characteristics of Porter Road Swamp. Although the Crosland Group do not intend to develop the 17.5 acres of mafic depressions on this property, they are not planning to preserve extensive upland buffers around these depressions We have tentatively discussed acquisition of a total of 45 acres of this site, which would include the .:tails depressions together with about 37 acres of upland buffer. The Crosland Group is currently preparing a provisional site plan to reflect this proposed NCDOT mitigation area. Further negotiations on purchase o this site will be contingent upon approval of the mitigation site for the purposes of this project. Application is hereby made for a Department of the Army permit as required for such activities. V" NCDOT has studied two feasible alternative corridors that would completely avoid the two mafic depressions to be impacted by the preferred corridor. Both alternates diverge from the preferred alignment just east of the Rea Road interchange, and converge with the preferred route just west of NC 16 (Providence Road). Alternate 1 follows the existing alignment approximately 150 feet to the north. This alternate would impact approximately 1.5 acres of one mafic depression located just north of Site #'10. Furthermore, this alternate would impact a golf course at the Piper Glen subdivision and would require condemnation of five houses at the Raintree subdivision. Alternate 2 curves to the south, crossing Tom Short Road approximately 550 feet south of the preferred corridor. This alternate would impact approximately 1.0 acre of a mafic depression located 400 feet southeast of Providence Road West. Additional impacts would include condemnation of at least twenty-four houses in the Brittany Oaks subdivision. Both alternatives would involve substantial increases in noise levels at adjacent subdivisions. The proposed alignment occurs in the species range of Helianthus schweinitzii. The flowering season for this species extends from mid-September to mid-October. As positive identification of this species is best made duri.ig the flowering season, a survey was conducted in all suitable habitat along all of the alternative corridors on October 11 and 12; 1993. This species was not observed within any of. the potential project corridors. A fiber-optic cable is to be placed within a conduit and buried beneath the highway (Sheet 10). The conduit will cross the road just east of a mafic depression (Site ?6). Please inform us if any additional permits will apply to this work.
