Box 558 Elkin, N.C. 28621 Dear Mr. Atkins: ro AT -OVA ?EHNR September 14, 1994 Alleghany County DEM Project # 94847 FILE Uh You have our approval to place fill material in 0.17 acres of wetlands or waters for the purpose of road maintenance at SR 1303-A, as you described in your application dated 12 September 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2745. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. We will be replacing and or extendir>. pipe culverts at the following locations: 0+40 -Y-, 28+30 -L-, 32+40 -L-, 39+50 -L , 50+10 -L-, 57=70 -L ,and 64+40 -L-. These pipe culverts all involve live streams. We will also be extending or replacing various other culverts throughout the project which do no involve live streams. We will be encroaching upon the stream bank (Name of stream unknown) to obtain the necessary shoulder widths as follows: Left Station 4-+-35+- to Station 6+50+-, Left Station 7+00+- to Station 10+00+-, Left Station 23+00+- to Station 28+00+-, Right Station 28+00 i-- to Station 29+00+-, Left Station 32+00+- to Station 35-+-00+-, Left Station 39+00+- to Station 43+00-+--, Right Station 634-50+- to Station 64+50+-, and Left Station 67+00-i- to Station 68+00+-. Slight alignment shifts will be made to obtain a safe shoulder width Left of Station 39+00 to Station 43+00 and Right of Station 63+50 to Station 64+50. We will place Class B Rip Rap along the toe of fills to help in preventing siltation of the adjoiuring streams. We are requesting a,104 Nationwide Permit (#3 Maintenance) from your agency. I am sending a straight line sketch with the proposed erosion control, stream, and cross SeCtiorrs of the affected areas. In addition, l am sending a typical section of the road, general notes on erosion control and a marked reap. By copy of this letter I am asking Ms. Stephanie Goudreau, Mountain Region Coordinator of the North. Carolina Wildlife Resources Commission to comment directly to you concerning the 404 Nationwide Permit request. This work does not appear to involve any DEHNR designated trout streams. Also, by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. Generally, the order of installation of the erosion control measures will be as follows: Temporary silt basins shall be installed before clearing and grubbing begins. Silt fences and temporary silt ditches shall be installed after clearing and before.grading. Temporary stone ditch checks shall be installed as soon as ditchline is established. Pipe outlet and inlet protection will be done as soon as the pipe is installed. Seeding and other permanent erosion control measures are to be implemented as soon as practical.
